Capital Facilities Regional Manager Palisades Interstate Park Commission PO Box 427 3006 Seven Lakes Drive, Administration Building Bear Mountain, NY 10911-0427 Re: Lake Sebago Dam DEC Dam ID#: 196-0332 Ramapo (T), Rockland County Re: Lake Kanawauke Dam DEC Dam ID#: 196-0353 Haverstraw (T), Rockland County Dear Mr. Tesik: Berhanu Gonfa and I conducted a routine visual inspection at the above referenced high hazard dams on October 26, 2018 as part of the Department of Environmental Conservation’s (Department) ongoing Dam Safety program. I am writing to you because it is my understanding that you are, or represent, the owner of these structures. A copy of my Visual Observations is enclosed. The left/right nomenclature used in this letter and in the enclosed Visual Observation Report is based on looking downstream from the center of the service spillway at the dam’s crest. The condition of the both dams are similar to the condition noted in previous inspections. The observations noted in the enclosed visual observations are primarily maintenance items. These items should be addressed during your ongoing maintenance program. The table below details both of the dam’s current status for those sections of the regulations that have specific deadlines: Citation Requirement Status 673.6 Develop and implement an Inspection & Maintenance Plan (I&M Plan). Plan does not have to be submitted to the Department but needs to be available for inspection if requested. Guidance can be found at http://www.dec.ny.gov/lands/4991.html. Plan should be on file with the dam owner. 673.7 Develop and distribute to the local emergency responders an Emergency Action Plan (EAP) no later than August 19, 2010. EAP should be updated on an annual basis. EAPs submitted 1/6/2018. 673.8 Submit an Annual Certification to the Department by January 31 of each year (certification is for the previous year). An annual certification form can be found at: http://www.dec.ny.gov/docs/water_pdf/damsacf1010.pdf. 2017 Annual Certifications have been received. 673.13 Complete and submit to the Department an Engineering Assessment (EA) by August 19, 2012. EA must be performed by a New York State Professional Engineer. The EA must be updated every 10 years after the initial submittal. EA guidance is available at: http://www.dec.ny.gov/docs/water_pdf/damfengarpt.pdf. EAs have been submitted 8/3/2015. As you know, the Lake Sebago Dam presently does not meet the safety criteria (spillway capacity/stability) for a high hazard dam. The EA for the Lake Sebago Dam, prepared by URS, was received on 8/3/2015. According to the EA, the spillway is significantly undersized (capacity is only 33% of the SDF) and the embankment and the spillway do not meet the stability criteria. The inadequate spillway capacity and dam stability are serious dam safety issues which must be resolved. There are some alternate recommendations included in the EA to fix the deficiencies of the dam. The DEC (Department) has sought voluntary progress in addressing the deficiencies with the dam by willing parties. Please provide a written response within 30 days, providing your plan and a projected schedule for rehabilitation of the dam. Before beginning any work, please be sure to check for compliance with applicable provisions (Regulation 53 and 53A) regarding the State Agency Environmental Audit.
