Strengthen Protections Against Damaging or Destroying Pipeline Facilities

Section 60123(b) of title 49, United States Code, is amended?

(1) in the heading, by striking ?Penalty for Damaging or Destroying Facility? and inserting
?Penalty for Damaging, Destroying or Interfering with Operation of 3 Fa cility?;

(2) by striking ?damaging or destroying" and inserting ?damaging, destroying or interfering
with the operation of and

(2) by inserting after "any activity affecting interstate or foreign commerce,? the following:
?including any facility that is under construction,?.

Speci?c Changes to Federal Statue Amend 49 USC ?60123(b) to read (new text bolded):

Penalty for Damaging or Destroying Facility. person knowingly and willfully
damaging, or destroying, or interfering with the operation of, an interstate gas pipeline facility,
an interstate hazardous liguid pipeline facility. or either an intrastate gas pipeline facility or
intrastate hazardous liguid pipeline facility that is used in interstate or foreign commerce or in
any activity a ?ecting interstate or foreign comm erce, including any facility that is under
construction, or attempting or conspiring to do such an act, shall be fined under title 18,
imprisoned for not more than 20 years, or both, and, if death results to any person, shall be
imprison ed for any term of years or for life.
