At the conclusion of the grand jury proceedings, the Grand Jury found no evidence to believe any criminal offense had occurred causing or related to the death of Clinton Joseph Harrington. This investigation is now closed. SUPPLEMENTAL DETAILS DPS SENSITIVE 06/1 012019 15:09 REPORT OF INVESTIGATION Page Thursday, 10/18/2018, I, Company Texas Ranger John Lingle, was notified by Victoria County Sheriff's Office Chief Deputy Roy Boyd of a custodial death that had occurred in the Victoria County Jail in Victoria, Victoria County, Texas. 1.2 I responded to DeTar Hospital Navarro, 506 San Antonio Street, Victoria, Texas, and began my investigation. 1.3 This investigation continues. 2.1 On Thursday, 10/18/2018, 1, Company Texas Ranger John Lingle, was notified by Victoria County Sheriff's Office Chief Deputy Roy Boyd of a custodial death that had occurred in Victoria County, Texas. 2.2 I was advised inmate Clinton Joseph Harrington was found unresponsive in his cell at approximately 7:49 PM. 2.3 Harrington was treated on scene by jail staff and EMS before being transported to DeTar Hospital Navarro, where he was pronounced dead. 2.4 I responded to DeTar Hospital Navarro, 506 San Antonio Street, Victoria, Texas, and began my investigation. 2.5 I arrived at DeTar Hospital Navarro at approximately 8:52 PM and met with Victoria County Sheriff?s Office Chief Deputy Roy Boyd, Jail Captain Charles Williamson, Jail Lieutenant Bryan Irvin, and Crime Scene Unit Lieutenant John Davis. 2.6 Upon my arrival, I was directed to the hospital station where Clinton Joseph Harrington?s body was. 2.7 Harrington had been pronounced dead at 8:36 PM by attending physician Amanda Tinsley. 2.8 Harrington was on a yellow ?backboard? that was placed on a hospital bed. 2.9 Harrington was wearing a yellow Victoria County Jail shirt and blue boxer style underwear. DPS SENSITIVE 06/10/201915209 REPORT OF INVESTIGATION Page 3 of 21 2.10 I observed an intubation tube exiting from Harrington?s mouth, an IV in his right arm, and an IV in his right shin, along with various medical leads attached to his body. 2.11 Upon pulling up on Harrington?s shirt, I could see indentations on Harrington's chest that I know from training and experience to be from the automated CPR machine utilized by EMS personnel. 2.12 There were no other visible scratches, scrapes, or marks on Harrington consistent with a struggle or fight. 2.13 I took photographs of Harrington as I found him for evidentiary purposes. 2.14 Victoria County Precinct 4 Justice of the Peace John Miller responded to the scene and released the body to Crossroads Mortuary to be transported to the Travis County Medical Examiner?s Office for an autopsy. 2.15 Terry Owen from Crossroads Mortuary took custody of Harrington?s body, and I assisted him in placing Harrington's body into a body bag, which I then sealed with evidentiary tag #2817222, which I photographed at approximately 9:35 PM. 2.16 I obtained a copy of all DeTar Hospital Navarro paperwork for Harrington related to that night. 2.17 Exhibit SZ.P1 is a copy of all DeTar Hospital Navarro paperwork as given to me. 2.18 I advised Captain Williamson that I would need statements from all on?duty personnel at the jail and Captain Williamson advised they were already working on supplements to the jail?s reporting paperwork. 2.19 I then responded to the Victoria County Jail located at 101 N. Glass Street, Victoria, Victoria County, Texas, arriving at approximately 9:50 PM. 2.20 At the jail I took evidentiary photographs of the scene as I found it. DPS SENSITIVE 06/10/201915:09 REPORT OF INVESTIGATION Page 4 of 21 2.21 Harrington had been housed in the Medical 1 infirmary cell, which I was advised was under 24-hour video surveillance. 2.22 I was also advised Harrington had shared his cell with Bryant Emil Grady. 2.23 I requested a copy of all jail videos from that night as well as a copy of all reports in reference to Harrington?s incarceration. 2.24 I conducted an interview of Bryant Grady in the VCSO Investigations Division interview room. The interview started at approximately 10:37 PM and was video and audio recorded. 2.25 Grady was visibly upset from having found Harrington, whom he said he had shared a cell with for about one week. 2.26 Grady stated to me that Harrington was talking constantly and hallucinating while he was in his cell. Grady said Harrington had been hallucinating for several days. 2.27 Grady said Harrington talked about a lady trying to come down or fall down from the ceiling. 2.28 Grady said Harrington fell earlier in the day and hit his head, but jail staff was not notified. Grady said Harrington said he fell earlier in the day as well, but Grady did not witness that fall. 2.29 Grady said Harrington did not eat his dinner that evening when it was provided. 2.30 Grady said he had talked with Harrington in the past about Harrington ?detoxing? off of methadone. 2.31 Grady said he thought Harrington was already dead when he discovered him unresponsive in his cell. 2.32 I asked Grady if he had seen anyone harm or mistreat Harrington and Grady said DPS SENSITIVE 06/10/201915:09 REPORT OF INVESTIGATION Page 5 of 21 2.33 Grady said jail staff responded quickly when he ?hit the button? to notify them Harrington needed help. 2.34 Grady described behavior from Harrington that seemed strange to him, including him hitting the walls of his cell with his hands at times. 2.35 I took photographs of Grady after the interview documenting the fact he had no marks, scratches, or bruises on him. 2.36 Exhibit 82.P2 is a containing all crime scene photos taken by me on 10/18/2018. 2.37 On 10/19/2018, I traveled to the Travis County Medical Examiner?s Office and attended the autopsy for Clinton Joseph Harrington, which was conducted by Dr. Hannah Bielamowicz. 2.38 At the conclusion of the autopsy, Dr. Bielamowicz advised the preliminary ruling was ?pending? as there were more tests/toxicology needed to make a determination. 2.39 Dr. Bielamowicz released a brown paper bag containing the clothing worn by Harrington, designated as Exhibit SZ.P3. 2.40 Exhibit 82.P4 is a copy of the Travis County Medical Examiner Office Release of Evidence Form as signed by myself and Dr. Bielamowicz. 2.41 This investigation continues. Exhibits: S2.P1 De Tar Navarro Hospital paperwork for Clinton Joseph Harrington S2.P1 containing all photos taken by Ranger Lingle on 10/18/2018 82.P1 Brown paper bag containing Harrington's clothing - Travis County ME Office Property Release Form DPS SENSITIVE 06/10/2019 15:09 REPORT OF INVESTIGATION Page 6 of 21 3.1 On Monday, 10/22/2018, I, Company Texas Ranger John Lingle, traveled to the Victoria County Sheriff?s Office to pick up all jail paperwork, videos, and witness statements. 3.2 Victoria County Jail Captain Charles Williamson and Lieutenant Carol Hulsey provided me with all paperwork the jail had for Harrington. 3.3 Exhibit is a copy of the VCSO Jail log checks for a 12 hour period on 10/18/2018 indicating that all required 30-minute checks were conducted. 3.4 Exhibit 83.P2 is a copy of all UTMB ?Sick Call? requests as filled out by Harrington during his incarceration. 3.5 On 09/16/2018, Harrington had requested to speak to a doctor about ?weining off of methadone? (sic). 3.6 On 09/19/2018, Harrington requested a medical cell due to shaking, twitching, and nausea. 3.7 On 09/21/2018, Harrington complained of anxiety, pain, and shaking. 3.8 On 09/28/2018, Harrington completed a request stating he couldn?t sleep due to anxiety and pain. 3.9 On 09/29/2018, Harrington completed a request stating he could not sleep, was experiencing extreme pain and anxiety, shaking, tremors, restlessness, and pain. Harrington also stated he could not lay down on his mat from pain caused by two back surgeries. 3.10 On 10/02/2018, Harrington requested Band?Aids for a toenail he had ?ripped off.? 3.11 On 10/03/2018, Harrington requested a bigger shower because he said he had claustrophobia from PTSD that would cause him to panic uncontrollably from the confined space. 3.12 Harrington filled out a second request on 10/03/2018 stating he was experiencing extreme shaking and he could no longer take care of his own needs due DPS SENSITIVE 06/10/201915:09 REPORT OF INVESTIGATION Page 7 of 21 to panic attacks and PTSD. 3.13 On 10/05/2018, Harrington was assisted with filling out a Victoria County Jail Inmate Request for Assistance form stating he was suffering from severe opioid withdrawals, asking for a bond reduction so he could seek medical attention himself. 3.14 See Exhibit S3.P3, which was incorrectly dated 9/6/2018 on the bottom. 3.15 Exhibit S3.P4 is a copy of the Best Recovery Health Care Medication records for Harrington. 3.16 Harrington was prescribed a detox regimen from methadone that saw him taper off over the time period from 09/18/2018 through 09/26/2018. This treatment plan was prescribed by Dr. L. Carroll from Best Recovery Health Care. 3.17 Harrington was still taking Abilify 5 mg and Fluoxetine (generic Prozac) 20 mg pills on a daily basis according to medical records. 3.18 Exhibit S3.P5 is a copy of the jail nurses notes for Harrington. 3.19 The nurse's records stated vital signs were taken from Harrington on multiple occasions during his incarceration. 3.20 The nurse?s notes provide detailed descriptions of the care given to Harrington after each of his ?sick call? requests. 3.21 Exhibit S3.P6 is a copy of a statement by RN Meredith Caruso reference statements made to her by Harrington?s cell mate, Bryant Emil Grady. 3.22 Investigator Robert Ontiveros provided me with DVDs of all jail recordings, as well as a copy of my interview with Harrington?s cellmate on 10/18/2018. 3.23 Exhibit S3.P7 is a copy of the investigative report completed by Investigator Ontiveros detailing his assistance with this investigation. DPS SENSITIVE 06/10/201915209 REPORT OF INVESTIGATION Page 8 of 21 3.24 Exhibit 33.P8 is a DVD containing my interview of Harrington?s cell mate Bryant Grady. 3.25 Exhibit S3.P9 is a DVD containing all Victoria County Jail video footage from approximately 5:45 PM until Harrington left the jail with EMS personnel. 3.26 Exhibit S3.P10 is a DVD containing footage from the Medical 1 jail cell from 8:48 AM to approximately 8:00 PM on 10/18/2018. 3.27 I was provided with extra copies of these three videos, which were sent to Dr. Hannah Bielamowicz at the Travis County Medical Examiner?s Office in order to assist them with their autopsy determination. 3.28 During my interview with Grady, he stated he believed Harrington had fallen at approximately 11:00 AM, but review of the jail videos indicate the falls happened at approximately 8:53 AM and approximately 9:03 AM. 3.29 At 8:53 AM Harrington rolled off of the side of his bed, but sits up and can be seen talking with Grady shortly after. 3.30 At 9:03 AM Harrington falls from a standing position backwards and strikes his head on the floor of the cell. He had picked up an envelope and an article of clothing and appeared to be walking towards either the table or shower when he lost his balance and fell. 3.31 Harrington appears to retain consciousness the entire time as he can be seen grabbing his head and writhing in pain. Grady immediately gets up cans over to check on him at this point. 3.32 At approximately 9:06 am Grady assists Harrington into sitting on the end of Harrington?s bed and hands Harrington the envelope he had been carrying. 3.33 In reference to the events leading up to Harrington?s passing, Grady can be seen trying to get Harrington?s attention at approximately 7:45 pm. 3.34 At approximately 7:46 Grady pushes the button to alert jail staff that assistance was needed in Medical 1 cell. Grady pushes the button several times and be seen talking to jail staff through the door. DPS SENSITIVE 06/10/201915:09 REPORT OF INVESTIGATION Page 9 0f 21 3.35 Victoria County Jail staff remove Grady and enter the cell at 7:49 pm and LVN Theresa Borgohain checks for Harrington?s pulse. 3.36 Jailer Madison Hencerling immediately begins administering CPR and numerous jail staff enter the cell to assist. 3.37 Nurse Borgohain returns and an AED is hooked up to Harrington. 3.38 Jailer Hencerling and Nurse Ashley Black continue CPR on Harrington until EMS arrives, and Jailer Hencerling continues compressions after EMS arrival. 3.39 Victoria Fire Department EMS arrive in the cell at approximately 7:58 pm. 3.40 EMS removes Harrington?s yellow VCSO Jail pants in order to administer an IV line into his right shin. 3.41 Jailer Hencerling is relieved from chest compressions at approximately 7:20 pm when the automated chest compressor is utilized by EMS personnel. 3.42 EMS leaves with Harrington enroute to DeTar Navarro Hospital from the Medical 1 cell at approximately 8:07 pm, where he was pronounced dead at approximately 8:36 pm by attending physician Amanda Tinsley. 3.43 Exhibit S3.P11is a copy of the Victoria County Jail Incident Report to include statements from on duty personnel. 3.44 Exhibit S3.P12 is a copy of all jail related magistration paperwork showing Harrington?s reasons for incarceration to be Possession of a Controlled Substance PG 3<289, Possession of a Controlled Substance PG 1 <1g, Possession of Marijuana 202. 3.45 These charges stemmed from a crash that Harrington was involved in on 09/09/2018, his date of arrest and incarceration. 3.46 Exhibit S3.P13 is a copy of Victoria County Jail Booking Report for Harrington to include his medical/mental health questionnaire filled out at the time of his booking. DPS SENSITIVE 06/1 012019 15:09 REPORT OF INVESTIGATION Page 11 0f 21 4.2 The official cause of death was determined to be ?Complications of Selective Serotonin Reuptake Inhibitor Therapy.? 4.3 Other contributing conditions were listed as ?Hypertensive Cardiovascular Disease.? 4.4 The manner of death was listed as ?Natural.? 4.5 These determinations were made by Dr. Hannah Bielamowicz, Forensic Pathology Fellow, and Dr. Vickie Willoughby, Deputy Medical Examiner. 4.6 Dr. Willoughby noted in her report that Harrington had excess fluid in his lungs (pulmonary congestion), an enlarged heart (cardiomegaly), and mild narrowing (atherosclerosis) of one of the coronary arteries that supplied blood to the heart. 4.7 Dr. Willoughby also noted there was scoliosis of the spine with evidence of surgical repair, and an incidental Meckel?s diverticulum (outpouching of the small intestine). 4.8 Toxicology results showed there were no illegal drugs in Harrington's system at the time of his death, and separate toxicology tests were also done to rule out the presence of cannabinoids and novel substances. 4.9 Toxicology testing on postmortem blood did demonstrate an elevated level of fluoxetine and its metabolite (norfluoxetine), in addition to Metoprolol and Hydroxyzine. 4.10 A separate test run through NMS labs detected the presence of aripiprazole, hydroxyzine and its metabolite (cetirizine), and metoprolol. 4.11 Dr. Willoughby stated in her report the cause of the elevated levels of fluoxetine was unknown. She stated that a possible cause could be due to interactions of other medications including aripiprazole and hydroxyzine, which can disrupt the metabolism of these drugs. 4.12 All drugs present in Harrington's system were prescribed to Harrington. Harrington listed Prozac 40mg (quantity 2) on his personal property form at the Victoria County Jail, along with methadone 100mg (quantity 1 k) and Abilify (Aripiprazole) 5mg (quantity 2). DPS SENSITIVE 06/10/2019 15:09 REPORT OF INVESTIGATION Page 12 0f 21 4.13 See Exhibit S4.P1, Victoria County Jail Personal Property/Currency Report, dated 09/09/2018. 4.14 Harrington was seen by William Metzger on 10/01/2018 and 10/08/2018, and both of these appointments reference his Fluoxetine prescription while making a note of body tremors. 4.15 Harrington was moved to the infirmary of the Victoria County Jail on 10/06/2018 per Detention Officer Parma due to Harrington shaking and sweating. Jail records stated that Harrington felt he was being ?punished? by being placed into an infirmary cell and wanted to go back to the general population. 4.16 Harrington saw Kimberly Warneke on 10/11/2018, and notes were made about the same noted prescriptions and their amounts. Harrington stated to Warneke that he was not taking Hydroxyzine at home. 4.17 Dr. Warneke made note that Harrington did not appear to have Serotonin at that time. 4.18 Other Correctional Managed Care paperwork showed RN Meredith Caruso and Edna Larson and Peggy West to have reviewed the prescriptions for Harrington as well. 4.19 See Exhibit S4.P2, Correctional Managed Care Paperwork, for full details. 4.20 In reference to Harrington's methadone detox program, I spoke with Dr. Bielamowicz, and she stated ill effects from methadone detox would normally quit in two weeks or less. 4.21 Harrington's methadone detox program ended on 09/26/2018, 31days before his death. 4.22 Dr. Willoughby noted in her report that serotonin could occur due to the accumulation of toxic levels of serotonin over time. 4.23 Dr. Willoughby stated that in Harrington's case, ?It is possible that interactions between these drugs may have contributed to the development of DPS SENSITIVE 06/101201915209 REPORT OF INVESTIGATION Page 13 of 21 S5 serotonin and/or cardiac A heart that is enlarged by chronic high blood pressure is at an increased risk of developing congestive heart failure and (abnormal heart which can cause sudden death)?. 4.24 See Exhibit S4.P3, Medical Examiner Report, for full autopsy details. 4.25 I have spoken with Victoria County District Attorney Constance Filley Johnson reference this case, and I will be presenting my findings to the Victoria County Grand Jury in the near future. 4.26 This investigation continues.
