LEWIS, ORDER in his official capacity as Senior Chairman of the House Select Committee on Redistricting, et al., Defendants. THIS MATTER comes before the Court upon non-party Nueces County, Texas?s Motion for Review of Certified Copies of Nueces County Documents, filed August 80, 2019. In its motion, Nueces County requests that certified copies of all ?Hofeller files? thought to belong to Nueces County be provided by Plaintiffs to Nueces County for its review. No party objects to the motion. Counsel for Nueces County also informed the Court by email on September 16, 2019, that Nueces County and Plaintiffs had reached an agreement on cost- sharing pending further order of the Court granting Nueces County?s motion. After considering this motion and having reviewed the record, the Court, in its discretion, hereby GRANTS the motion. The Court hereby orders that, pursuant to the cost- sharing agreement entered into between Plaintiffs and Nueces County, Plaintiffs shall provide to Nueces County copies of the 1,902 Hofeller files that Plaintiffs have identified as likely relating to Dr. Hofeller?s work for Nueces County. The Court further orders that no original documents which belong to Nueces County be destroyed or altered without notice to Nueces County and an opportunity to be heard. Pursuant to this Court?s order entered September 24, 2019, the Hofeller files (which includes the files to be provided to Nueces County pursuant to this Order) are currently designated in accordance with the parties? existing April 5, 2019, Consent Protective Order. Unless extended by the Court, the designation of shall expire at 1 1:59 pm. on October 27, 2019. This order is not intended to preclude or impair any other court of competent jurisdiction from exercising its discretion and compelling inspection, production, or dissemination of any of the 1,902 files that shall be provided to Nueces County.
