The Defendant states that the following facts are true, and the parties
agree that they establish a factual basis for the offense to which the Defendant
is pleading guilty pursuant to Fed. R. Crim. P. 1 

My name is Darcy Hoff.

On or about August 11, 2018, I knowingly and intentionally distributed
heroin, which I had reason to believe contained fentanyl, to 
in Sioux Falls, South Dakota. used the heroin/fentanyl
mixture I sold to him and shortly thereafter overdosed from it. First responders
administered two doses of Narcan to which revived
him. But for the use of the heroin fentanyl mixture, would

not have overdosed. This caused a substantial risk of

 

 

death.
