area. a common area of an apartment building or dormitory. or a common area of a privately owned commercial shopping center. mail or
other group of commercial retail establishments. disturbs the peace of others by violent. profane. indecent or boisterous conduct or
language or by the making of unreasonably loud noise that is intended to cause annoyance or alarm to another person. and who persists in
such conduct after being requested to desist by a law-enforcement of?cer acting in his lawful capacity. is guilty of disorderly conduct. a
misdemeanor. and. upon conviction thereof. may be committed to the custody of the division of corrections for twenty-four hours or ?ned not

I further state that this complaint is based on the lollowmg facts: On the above date the defendant was the Family Dollar on 72??

Virginia St Charleston WV screaming profanities at of?cers on scene with an unrelated incident. The defendant was warned by multiple
officers including PTLM C. Thaxton to stop using profanities and the defendant ingored the warnings and contiued to use profanity with
children and other customers in the area. This offense occurred at 712 Virgina St in Charleston WV. Kanawha County.
