STATE OF MOTION TO CONTINUE This cause came on for the Court?s consideration of the State of Ohio?s ?Motion To Continue? ?led on November 14, 2019, requesting a continuance of the jury trial previously scheduled to commence on Monday, November 18, 2019, at 8:30 o?clock am. The State of Ohio has also submitted a Memorandum in support of its motion to continue The Court finds that on November 14,2019, the Defendant filed a ?Defendant Memorandum Contra To The State of Ohio 3 Motion To Continue The Jury Trial Scheduled For November 18, 2019, Which' 15 Due To Be Filed By State Of Ohio By The End Of The Business Day On November 14, 2019. Having considered the arguments of each party,'the Court finds that the State of Ohio?s ?Motion To Continue? is not well taken. Noting, however, that the State of Ohio further argues that if its motion to continue is denied ?the court should exclude the 198 pages of documents (and references to them) as well as the newly disclosed witnesses? (apparently referring to Charlie Reader, Brian Reader, and Kayla Slusher), the Court reserves ruling upon the State?s requests to exclude such evidence, references, and witnesses, which requests may be renewed and argued on November 18, 2019, prior to voir dire of prospective jurors. The Court further notes that the Defendant?s memorandum contra states that ?the ?Daily files? material furnished to the State was never intended to be introduced at trial but merely used to help the witness refresh his memory if necessary.? It is therefore ORDERED that the State of Ohio?s Motion To Continue filed on November 14, 2019, be, and hereby is, overruled and denied.
