We' ve sent a near-final draft up to OGC for review. Simultaneously, we're cleaning up some minor language and plan to let HHStake a look next week before sending it through ExecSec.Barring any significant changes from OGC,we anticipate this moving very quickly up the chain. • I convened and directed a meeting on the redrafting of the ICE-DOLMOA on deconfliction in worksite enforcement. ICEanticipates having an outline of what we want to see in a new MOA within the first two weeks of January. With so many terminat ions, it is clear that DACA standards are insufficient for the purpose of protecting legal residents of the United States. It may also be the case that USCISdoes not have the capacity to adequately vet illegal aliens fo r DACA purposes. DACA recipients include murderers, child molesters, individuals involved in fraud schemes, gang members, and many other types of criminals. After the Associated Press highlighted ICE'sarrest of 15 DACA recip ients with criminal arrests during an enforcement action in 2015, the news outlet admitted that because criminal aliens benefit from DACA, it "could undermine the integrity of the government's program." Quoted in the article was House Judiciary Committee Chairman Bob Goodlatte, who said: "With few fraud detection measures and effective background checks in place, it's no surprise that ICEarrested over a dozen DACA recipients last week, most of whom had already been convicted of a crime . I and other members of the House Judiciary Committee have expressed concern about this for years." 14 It is important to remember that DACA' s guidelines allow applicants to have up to two misdemeanors on the ir records and still qual ify. Below are some recent example s of DACA recipients involved in significant criminal activity. Some cases are ongoing and suspects are considered innocent until proven guilty . Massive Fraud: ICE's Homeland Security Investigations (HSI) San Francisco reported Rajubhai Patel plead guilty to one count of money laundering in U.S. Distr ict Court in the Southern Distr ict of Texas. Patel is a citizen of India and resided in the United States based on his grant of DACA status which has since been revoked. These charges relate to Patel's role in a massive call center scam operated by a Transnat ional Crim inal Organization (TCO). The TCO controlled call centers in India would extort individuals in the United States by impersonating U.S. government officials, typica lly Department of Homeland Security (DHS) or Internal Revenue Service officers, and demanding victims purchase deb it/gift cards and/or wire funds. Attempted murder of law enforcement: Syed Owais Zafar, a citizen of Pakistan, entered the United States on October 12, 2003 as an imm ediate fam ily member of a foreign government official (A-2). On January 9, 2014, USCISgranted Zafar DACA status until January 8, 2016, and later extended it until November 11, 2017. On March 23, 2016, an immigration judge in Arlington, VA, administratively closed Zafar's removal proceedings because he was a DACA recipient. On June 26, 2017, the Smyth County, VA, Sheriff's Office arrested Zafar on three counts of Attempted Capital Murder of a law enforcement off icer, Disregard or Elude, Endanger; Reckless Driving, and Vehicle with Flashing Lights-Injury/Property. The same day, ICE lodged an imm igrat ion detainer and a warrant of arrest with Southwest Virgin ia Regional Jail in Abingdon, VA. On July 5, 2017, USCIS terminated Zafar's DACA due to the seriousness of his pending charges. The Joint Terrorism Task Force confirmed that while detained, Zafar made terroristic threats such as: "Death to America" and "I'm going to get some brothers down here to blow this place up." Zafar's criminal court date is scheduled for September 15, 2017 . Quadruple homicide. Emmanuel Jesus Rangel-Hernandez was charged with four counts of first-degree murder in February 2015 in connection with a three-day shooting spree that resulted in the death of "America's Next Top Model" contestant Mirjana Puhar, a Serbian refugee. 15 According to USCIS,Rangel had been arrested by ICE in 2012 after an arrest on drug charges. USCISapproved his DACA application in August 2013 "notwithstanding a TECSrecord indicating that he was a known gang member". Administrative removal proceed ings were closed in December 2013. Murder: Oliver Mauricio Funes-Machado, a citizen of Honduras, was arrested on March 3, 2005 by the United States Border Patrol (USBP) in Laredo, TX and served a Notice to Appear pursuant to section 212(a)(6)(A)(i) of the Immigration and Nationality Act (INA), as an alien present in United States without being admitted or paroled. Funes, a juvenile at the time, was travelling with his aunt, and they were both subsequently released by USBP.On December 6, 2005, an Immigrat ion Judge ordered Funes removed from the United States to Hondu ras, in absentia. On October 11, 2013, USCISapproved Funes's DACA application valid until June 24, 2015 and then extended it until October 21, 2017. On March 6, 2017, the Franklin County (North Carolina) Sheriff's Department arrested Funes outside of his home in Zebulon, NC for First-degree Murder of his mother. The follow ing day, ICE's Enforcement and Removal Operations (ERO) received an Immigration Alien Response (IAR) from the Law Enforcement Service Center (LESC)due to Funes' arrest for murder. Funes was identified as an alien present in the United States illega lly and subject to a fina l order of removal. Child abuse: On January 19, 2016, ICE's ERO in Phoenix encountered Francisco Javier Rios-Covarrubias, a citizen of Mexico, at the Maricopa County Sheriff's Office. Rios entered the United Stated without inspection on an unknown date. After not icing that Arrieta appeared excessively nervous , t he officer asked whether there was contraband in the vehicle . Arrieta disclosed the presence of a firearm and ammunition, and a consent search of the veh icle produced a pisto l and over 7,200 rounds of ammunition . Arr ieta was then arrested. While Arrieta was in custody, aut horit ies determined that he was a citizen of Mexico and that he was in receipt of DACA.17Arrieta entered a cond it ional gui lty plea of being an alien illegally and unlawfu lly in the United States in possession of a firearm affect ing interstate and foreign commerce . Violent rape and assault; molestation: Mexican citizen Salvador Diaz-Garcia, 23, first received DACA in 2013 and had it extended mult iple times through 2019 until it was terminated in August 2017 after being charged with second-degree assault and rape charges in a vicious attack against a 19-year-old woman near Seattle , Washington. Media reports that woman was attacked in her apartment comp lex' s gym and left with severe facial injuries, "including a broken jaw and dang ling ear" . On July 7, 2017, the Iowa District Court for Crawford County convicted Garduno for Sexual Abuse, 2nd degree, for which Garduno was given a 25 year suspended prison sentence . Given its direct relationship to economic and population growth, immigration policy is the most fundamental way that "nations let their people control thei r destiny." Ironically, however, exactly one year before that speech, the U.N. began a process to undermine U.S. sovereignty over immigration and contradict U.S. law. On Sept. 19, 2016, the U.N. General Assembly adopted the New York Declaration for Refugees and Migrants, in which it "decided to develop a global compact for safe, orderly and regular migration," to be adopted in 2018. That "global compac t would set out a range of principles, comm itments and underst andings among Member States regarding international migration in all its dimensions [and] deal with all aspects of international migration, including the humanitarian, developmenta l, human rightsrelated and other aspects of migration ." Many dealings between nations should be subject to international norms, including com merce, trade and diplomacy . Immigration , however, is not one of them. Migration patterns are not uniform, and certain count ries receive more migrants, both legal and illegal, than others . As a judge, I heard cases involving aliens from around the world. Obama administration policies encouraged these aliens to venture to the Southwest border from Africa, Asia and Latin America to enter the United States illegally. As a result, between 2014 and 2016, illegal immigration was largely unchecked. In response, the American people elected a president who prom ised to bring immigration under control. The proposed U.N. "global compact" threatens to undermine those efforts, however . Applying the same principles to entry into the United States as to, for example, Bangladesh or Mali, would create an unworkable enforcement regime along the U.S. border. That appears to be the goal of the proposed global compact, however. As Paragraph 49 of the declaration states, the U.N. "commit[s] to strengthening global governance of migration." For example, Paragraph 33 states that the U.N. "will consider reviewing policies that criminalize crossborder movements," and "will pursue alternatives to detention while these assessments are under way." The threat of criminal penalties, however, have proven to be a strong deterrent to illegal entry, and detention is often the only way to ensure appearance for removal. Limiting or eliminating these tools will simply encourage more illegal entry. Similarly, that paragraph would encourage illegal entry by alien minors, especially those who are gang members. Further, Paragraph 57 would have direct impacts on U.S. immigration law. It states that the U.N. "will pay particular attention to the application of minimum labor standards for migrant workers regardless of their status." This appears inconsistent with Section 274A of the Immigration and Nationality Act (INA), which makes the employment of unauthorized aliens illegal. Paragraph 58 of the declaration also appears to be inconsistent with the INA. It "encourage[s]" the return of "migrants who do not have permission to stay preferably on a voluntary basis, taking into account national legislation in line with international law." Under the INA, removal of unauthorized aliens is the rule, while voluntary departure is a discretionary privilege. The president made a strong argument for national sovereignty at the U.N. His administration must now defend that principle before the same body. FOIA Exemption (b)(5) protects from public disclosure intra-agency documents that contain the recommendations, opinions, and conclusions of agency employees, and portions of the responsive documents which qualify for protection under the deliberative process privilege, the attorney-client privilege, and the attorney work-product privilege. FOIA Exemption (b)(5) protects from disclosure those inter- or intra-agency documents that are normally privileged in the civil discovery context. The attorney work-product privilege protects documents and other memoranda prepared by an attorney in contemplation of litigation. The attorney-client privilege protects confidential communications between an attorney and his client relating to a legal matter for which the client has sought professional advice. It applies to facts divulged by a client to his attorney, and encompasses any opinions given by an attorney to his client based upon, and thus reflecting, those facts, as well as communications between attorneys that reflect client-supplied information. The attorney-client privilege is not limited to the context of litigation. Page 3 of3 FOIA Exemption 6 exempts from disclosure information in personnel or medical files and similar files the release of which would cause a clearly unwarranted invasion of personal privacy. This requires a balancing of the public's right to disclosure against the individual's right to privacy. The privacy interests of the individuals in the records you have requested outweigh any minimal public interest in disclosure of the information. Any private interest you may have in that information does not factor into the aforementioned balancing test. FOIA Exemption 7(C) protects records or information compiled for law enforcement purposes when production of such could reasonably be expected to constitute an unwarranted invasion of personal privacy. This exemption takes particular note of the strong interests of individuals, whether they are suspects, witnesses, or investigators, in not being unwarrantably associated with alleged criminal activity. That interest extends to persons who are not only the subjects of the investigation, but those who may have their privacy invaded by having their identities and information about them revealed in connection with an investigation. Based upon the traditional recognition of strong privacy interests in law enforcement records, categorical withholding of information that identifies third parties in law enforcement records is ordinarily appropriate. "Nearly 3 in 10 family units are cutting off their ankle bracelets at the beginning of the process when they've been released from our custody within days or weeks so they 're not even going to get to that point where they could get the final removal order," Matthew Albence, executive associate director for ICE, testified before the Senate Homeland Security and Governmen tal Affairs Committee. Albence said the Homeland Security Department's inability to get all illegal immigrants released from custody and told to appear for court hearings was in part due to people ditching their ankle bracelets and disappearing into the interior of the country. Tho se waiting to hear if their asylum cases are approved or denied were more likely to keep their monitors in tact and show up for court, but once their cases were denied, they were not likely to show up when a judge would then later order them depo rted. "They will comply up until the benefit of complying is not there," said Albence. The committee's ranking Democrat , Sen. Claire McCaskill of Missouri, asked Albence how it was monitoring illegal immigran ts whose asylum requests were denied and they were to be deported . "It reminds me of how we got people to court when they were charged with a crime. "We ought to figure out a way to make court appearances more likely ." Those whose asylum claims are denied may appeal the ruling within 30 days. McCaskill said "they could be monitored" for that time to ensure they are picked up for removal if the appeal fails .
