( b-'-' l( """' 6l .:.... ; _ Here's an update on some of the progress this week on a number of fron t s: • The ICE-HHSMOA on UAC/sponsors was sent by HHSto ICE last night. We' ve sent a near-final draft up to OGC for review. Simultaneously, we're cleaning up some minor language and plan to let HHStake a look next week before sending it through ExecSec.Barring any significant changes from OGC,we anticipate this moving very quickly up the chain. • I convened and directed a meeting on the redrafting of the ICE-DOLMOA on deconfliction in worksite enforcement. ICEanticipates having an outline of what we want to see in a new MOA within the first two weeks of January. I've gamed this out with Wetmore and the goal is to have DPCdirect ICEand DOL to come to an agreement on terms more favorable to ICE's mission. This would also be an opportunity for DPCto require DOL to mandate E-Verify use by any employer who is the subject of a labor dispute. • I ensured that our S.F. op for the end of January is not limited to only EROefforts, but also includes HSl's wor kplace equities. I spoke with one of our top EROofficia ls managing the op and he's pulling in employees from mult iple Areas of Responsibility (e.g., Los Angeles, San Diego). DHS-ICE-18-0478 and DHS-ICE-18-0777-A-000178 2019-ICLl-00043 178 The only cause for concern is whether the CR will have an impact on staff relocation, but we'll cross that bridge if we come to it. • The OHSE-Verify meeting (which I helped convene after seeing no action) is going to help advance the multiple proposals we presented to DPCmonths back. I raised a number of issues not on the list, including: USCIS'smonthly report on E-Verify non-confirmations, some of which are flagged but not routinely sent to ICEfor further investigation (the USCIScareer pledged to work with ICEto make it happen); the above proposal that OOL require E-Verify sign-up as part of any labor dispute settlements. OHSPolicy is writing up the next steps. • I should finalize (tonight) our VOICEOffice report on the effects of victimization of illegal immigration. It will include data on call volume and topics and include a number of anonymized case studies to highlight he positive impact the office is having. I'm happy to have DPCtake a look before we send it up the chain . The goal is to release it in January. • Working with an EROcolleague to iron out some issues with the ODOR; it appears that some of the entities which received a letter from the DOJare not entities with which ICEwould file a detainer request and that, for some, OOJis looking at cooperation, generally. Either way, I anticipate giving OOJa draft to look at within the next few weeks. • Tasked a field office to investigate the immigration history of a New York-based Pakistani-born USCrecently charged with supporting ISISvia Bitcoins . As per the previous e-mail, bett er coordination between OHSPrivacy and Comms is going to be critical if we're to shape the narrative. I will always take the initiative in locating potentially -helpful storylines, but I can't do Comms's and Privacy's jobs for them. • Other issues addressed this week included: Flagging fo r OPCan inquiry from the UN on the administration's implementation of the Executive Orders, TPS,and DACA; stopping a response to an Amnesty International inquiry on enfo rcement practices; helping WH speechwri t ers locate additional ICEofficers/operations worth highlighting in speeches; assisting a Fox News contributor as well as a friendly NGO on messaging on the leaked proposal on separating families (you should see some discussion on Fox and NBC either tonight or tomorrow); getting the WH's Education SME to take a look at an F-1 related issue that may be allowing schools to take advantage of STEM policies by simply reclassifying a non-STEM degree as STEM -- the Dept of Education is supposed to be on top of this, but it appears they may not be. • ICEalso helped edit/refine the BOP report on criminal aliens t o make it more consistent w ith our language. • Last week you wanted someone to take a look at statutes that can be used to hold illegal aliens accountable. You may be interested in my repo rt "The Myth ofthe 'Otherwise Law-Abiding' Illegal Alien" are a number of statutes that the average, working illegal alien is violating. After the intro and some background, you'll find a list of statutes and a brief explanation of each that includes the punishment options . Many are already routinely prosecuted. Others are difficult t o prove and time-consuming, hence the genera l preference fo r ICEto simp ly clean up the problem via deportation . DHS-ICE-18-0478 and DHS-ICE-18-0777-A-000179 2019-ICLl-00043 179 And that brings me to an update on the fines and penalties directive in the Executive Order on interior enforcement. I should have noted at the outset that the most impactful area in fulfilling this (as far as ICE is concerned) is in the worksite enforcement context . ICE is certainly helping to fulfill this as evidenced by the Asplundh Tree fine of $95 million a few months back, a record for an immigration case. Could another visa lottery winner be involved? The DOJpress release notes she set up a shell company in Pakistan and was stopped try ing to board an airplane to Pakistan. The DOJ doesn't explain that she was born there - a factoid that helps explain things. DOJneeds to routinely get this information into releases, to the extent they are not legally prohibited from doing so. The DOJ goes out of its way to refer to her as "a U.S. citizen" in the first paragraph and uses a headline that reads, " Long Island Woman Indicted ...". In the least, the DOJshould write "a naturalized U.S. citizen" where possible. Otherwise, the result is immigration-free headlines in the Washington Times and NPR referring to a "Long Island woman" . With so many terminat ions, it is clear that DACA standards are insufficient for the purpose of protecting legal residents of the United States. It may also be the case that USCISdoes not have the capacity to adequately vet illegal aliens fo r DACA purposes. DACA recipients include murderers, child molesters, individuals involved in fraud schemes, gang members, and many other types of criminals. After the Associated Press highlighted ICE'sarrest of 15 DACA recip ients with criminal arrests during an enforcement action in 2015, the news outlet admitted that because criminal aliens benefit from DACA, it "could undermine the integrity of the government's program." Quoted in the article was House Judiciary Committee Chairman Bob Goodlatte, who said: "With few fraud detection measures and effective background checks in place, it's no surprise that ICEarrested over a dozen DACA recipients last week, most of whom had already been convicted of a crime . I and other members of the House Judiciary Committee have expressed concern about this for years." 14 It is important to remember that DACA' s guidelines allow applicants to have up to two misdemeanors on the ir records and still qual ify. Below are some recent example s of DACA recipients involved in significant criminal activity. Some cases are ongoing and suspects are considered innocent until proven guilty . Massive Fraud: ICE's Homeland Security Investigations (HSI) San Francisco reported Rajubhai Patel plead guilty to one count of money laundering in U.S. Distr ict Court in the Southern Distr ict of Texas. Patel is a citizen of India and resided in the United States based on his grant of DACA status which has since been revoked. These charges relate to Patel's role in a massive call center scam operated by a Transnat ional Crim inal Organization (TCO). The TCO controlled call centers in India would extort individuals in the United States by impersonating U.S. government officials, typica lly Department of Homeland Security (DHS) or Internal Revenue Service officers, and demanding victims purchase deb it/gift cards and/or wire funds. Patel resided in Willowbrook, Illino is. He was responsible for liquidating tens of millions of dollars in victim funds using Green Dot debit cards and counterfeit identity documents. Attempted murder of law enforcement: Syed Owais Zafar, a citizen of Pakistan, entered the United States on October 12, 2003 as an imm ediate fam ily member of a foreign government official (A-2). On January 9, 2014, USCISgranted Zafar DACA status until January 8, 2016, and later extended it until November 11, 2017. On March 23, 2016, an immigration judge in Arlington, VA, administratively closed Zafar's removal proceedings because he was a DACA recipient. On June 26, 2017, the Smyth County, VA, Sheriff's Office arrested Zafar on three counts of Attempted Capital Murder of a law enforcement off icer, Disregard or Elude, Endanger; Reckless Driving, and Vehicle with Flashing Lights-Injury/Property. The same day, ICE lodged an imm igrat ion detainer and a warrant of arrest with Southwest Virgin ia Regional Jail in Abingdon, VA. On July 5, 2017, USCIS terminated Zafar's DACA due to the seriousness of his pending charges. The Joint Terrorism Task Force confirmed that while detained, Zafar made terroristic threats such as: "Death to America" and "I'm going to get some brothers down here to blow this place up." Zafar's criminal court date is scheduled for September 15, 2017 . Quadruple homicide. Emmanuel Jesus Rangel-Hernandez was charged with four counts of first-degree murder in February 2015 in connection with a three-day shooting spree that resulted in the death of "America's Next Top Model" contestant Mirjana Puhar, a Serbian refugee. 15 According to USCIS,Rangel had been arrested by ICE in 2012 after an arrest on drug charges. USCISapproved his DACA application in August 2013 "notwithstanding a TECSrecord indicating that he was a known gang member". Administrative removal proceed ings were closed in December 2013. Murder: Oliver Mauricio Funes-Machado, a citizen of Honduras, was arrested on March 3, 2005 by the United States Border Patrol (USBP) in Laredo, TX and served a Notice to Appear pursuant to section 212(a)(6)(A)(i) of the Immigration and Nationality Act (INA), as an alien present in United States without being admitted or paroled. Funes, a juvenile at the time, was travelling with his aunt, and they were both subsequently released by USBP.On December 6, 2005, an Immigrat ion Judge ordered Funes removed from the United States to Hondu ras, in absentia. On October 11, 2013, USCISapproved Funes's DACA application valid until June 24, 2015 and then extended it until October 21, 2017. On March 6, 2017, the Franklin County (North Carolina) Sheriff's Department arrested Funes outside of his home in Zebulon, NC for First-degree Murder of his mother. The follow ing day, ICE's Enforcement and Removal Operations (ERO) received an Immigration Alien Response (IAR) from the Law Enforcement Service Center (LESC)due to Funes' arrest for murder. Funes was identified as an alien present in the United States illega lly and subject to a fina l order of removal. Child abuse: On January 19, 2016, ICE's ERO in Phoenix encountered Francisco Javier Rios-Covarrubias, a citizen of Mexico, at the Maricopa County Sheriff's Office. Rios entered the United Stated without inspection on an unknown date. Arr ieta had been stopped by a police off icer in Texas who not iced a defective ta illight . After not icing that Arrieta appeared excessively nervous , t he officer asked whether there was contraband in the vehicle . Arrieta disclosed the presence of a firearm and ammunition, and a consent search of the veh icle produced a pisto l and over 7,200 rounds of ammunition . Arr ieta was then arrested. (b)(6); Subject: RE:Media Reque /h\ /7\rr,i ews Under the previous administration, Notably, in fiscal years 2013 and 2014, the majority of releases of serious criminal offenders we re made pursuant to federal court decisions or bond decisio ns by immigration judges -- not by ICEleadership . In a leading court case on immigration detention, Zadvydas v. Davis, the Supreme Court ruled that ICE generally could not detain an individual ordered removed more than six months , unless the individual would be repatriated in the reasonably foreseeable future. This detention limit can be triggered when a country simply ref uses to accept repatriation of its national, irrespective of the individual ' s criminal history. ICE'scustody decisions for individuals in removal proceedings are also often reviewed by immigration judges who may set a bond amount that can result in release from ICEcustody. Other individuals, typically those who have committed less serious offenses, may be released as a discretionary matter after evaluation of their case by a career ICElaw enforcement officer, often with conditions of release such as enrollment in the Alternatives to Detention program or after posting a bond amount. The decisio n to make a discretionary release, or to set bond, enables ICEto focus its resources on the detention and removal of other individuals whom ICE deems to pose a greater risk to public safety or national security. ICE is committed to making certain that both mandatory and discret io nary releases are executed in a way that promotes publ ic safety and protects commun it ies in accordance with exist ing law. DHS-ICE-18-0478 and DHS-ICE-18-0777-A-000369 2019-ICLl-00043 369 ICEhas made important reforms to the processes that govern such releases, and the agency is committed to continue to take every possible measure to ensure the public's safety and the removal of dangerous criminals.
