We understand the hesitation, since many of the beneficiaries of this amnesty have sympathetic stories, but as a matter of fidelity to our constitutional system and his campaign promises, Trump must end DACA. If we are going to amnesty an entire class of people, it should obviously be done through the democratic process and, in our view, happen only in exchange for reforms to the immigration system. DACA contravenes the elementary principle that the legislative branch ought to pass laws and the executive branch ought to enforce them. In 2012, after Congress rejected the DREAM Act, President Obama issued the policy by unilateral decree . Under DACA - Deferred Action for Childhood Arrivals illegal immigrants under the age of 37 can apply to U.S. Citizenship and Immigration Services for deferred status. And while the Obama administration pretended the policy would be implemented via "prosecutorial discretion," with each case considered individually, in practice, USCISofficials say, any illegal immigrant who appears eligible is granted deferred status - which comes with benefits such as a work permit, a Social Security number, and a driver's license. More than 750,000 illegal imm igrants currently enjoy this functional amnesty. Candidate Trump made ending DACA a priority, but since being elected, the president has not followed through. The politics is tricky. It is difficult to roll back this de facto amnesty after it has already been implemented. And some of the DREAMers did indeed come here at a young age and have effec t ively known no other country (this isn't true of all DACA beneficiaries - the Obama policy was so sweeping that it can apply to illegal immigrants who came here as teenagers). But the most important consideration is that DACA is flagrantly unconstitutional. Then, the nation's legislative body can consider legislation to deal with this population. A reasonable deal would be a carefully circumscribed version of the DREAM Act in exchange for a requirement for the nationwide use of E-Verify for new hires or some significant part of the RAISEAct, a bill recently proposed by Senators Tom Cotton (R., Ark.) and David Perdue (R., Ga.). EVerify would force businesses to confirm the legal status of their employees, preventing them from hiring illegal labor. The Cotton-Perdue plan would lower the level of legal immigration and put a greater emphasis on skills in legal immigration . Any such deal would advance the goal of a more rational immigration policy that properly takes account of the interests of American workers. But, as a practical matter, Republicans won't have any leverage unless President Trump acts on DACA. Maybe Democrats are so radicalized on immigration and so convinced that they can wait Trump out that they wouldn't deal on DACA. If so, that can't be helped. The president owes it to his voters and, much more important, to the constitutional system, to end DACA. Texas and several other states have threatened to sue to stop DACA if the White House doesn't end it by a September 5 court heari ng in a related case. Discontinuing this rogue program would not only be the fulfillment of a campaign promise, but is the necessary starting point for any negotiation of lawf ul amnesty for this sympathetic group of illegal aliens. Cessation of the program would likely take the form of ending renewals (the status and accompanying work permits last for two years), meaning that each day after the end of renewals, an average of around 1,000 of the nearly 800,000 DACAswou ld revert to being illegal aliens. This would serve to focus the mind of Democrats in Congress on negotiating a deal. And, in fact, McClatchy reported last week that the White House was exploring the possibility of upgrading the DACAsto a lawful, legislated amnesty in exchange for a package of immigration measures "that pays for a border wall and more detention facilities, curbs legal immigration and implements Everify." I've been arguing for such a deal for some time, but I think everyone - possibly including the White House - misunderstands the nature of the deal. It's not a patchwork, but an organic whole. The Democrats, of course, are sputte ring in outrage. You will not be surprised that one of t he silliest comments came from Nancy Pelosi: Nancy Pelosi @NancyPelosi "It is reprehensible to treat children as bargaining chips. I know the Democrats want to infantilize people, but that's taking things a little far. That said, Pelosi's reference to "bargaining chips" does capture the way many people see a possible agreement: pick an immigrat ion measure from Column A and another from Column B, and see if the Democrats will agree to support them in exchange for legalizing DACA. Actually, though, there's a logic to any bargain like this; it isn't just a matter of horse-trading. Upgrading the close to 800,000 illegal aliens with DACAwould be a formal amnesty. And there are two major problems w ith any illegal-alien amnesty : It serves as an incentive for future illega l immigration, and it has downstream legal-immigration consequences. Formalization of DACAwould be no different from any other amnesty in this regard . And addressing those two harmful consequences of amnesty is what dictates what should be in any package. This isn't haggling in the bazaar; it's damage control. As to the first problem: because amnestying past illegal aliens always, necessarily, affec t s the decisionmaking of prospective future illegal aliens, any DACA amnesty must be accompanied by enforcement measures. A deal must reduce the likelihood of future DACAs by making it harder for young illegal aliens to come in the future and remain long enough to grow up here. Of course, limi t ing the magnet ic effect of amnesty was the point of the grand bargain in 1986, wh ich sought to close the loophole that let employers of illegals off scot-free . But the enforcement part of t hat bargain was vaporware, an airy promise that disappeared the moment t he amnesty was completed. But E-Verify already exists; last year, around half of new hires were screened through it . Rolling it out fo r the other half is something that would happen at the same time as the amnesty. It's true that a future administration under, say, President Maxine Waters could fail to ensure compliance, but that's a risk with any legislat ion in any area. Getting universal E-Verify on the books is worth the risk. Legal immigration cuts are also integral to any meaningful deal. Once the DACAsget green cards (as they surely will, since a non-citizenship amnesty is pol itica lly unsustainable), they can petition for relat ives, and once they naturalize, they can sponsor even more relatives, leading to ever-more fami ly-chain migration . The RAISEAct's elimination of the unlimited legal immigration category for parents of citizens is key here : If we're going to amnesty young people in part because they did not make the decision to come here illegally, then those who did make that decision should not be permitted to benefit from the amnesty. This is why my feared outcome of the White House trading DACA merely for some wall funding would be such a disaster . It's not only that it wou ld be throwing away the only immigration leverage there is against Democrats; it would be a failure on its own terms. Useful though a wall would be, it isn't even in the top three most important enforcement policies we need . And failing to include legal immigration cuts would simply create new anchors in the U.S. for even more immigrants in the future. A DACA deal would not be a 1,200-page monstrosity that seeks to do everything at once, like the Gang of Eight bill. Rather, it would seek to do just two things - lawfully amnesty illegal aliens who grew up here as Americans while limiting the harmful side-effects. Both parts are necessary to a coherent policy . Officials told Secrets that the number has surged 30 percent this year. The U.S. Citizenship and Imm igration Services said that 622 had their deferred action status pulled this year due to criminal activity. In a recent case, Imm igrations and Customs Enforcement arrested three DACA immigrants in a nationwide sweep of gangs. The numbers are small by comparison to the larger DACA population but experts said it shows that not a lot is known about the activities of the youths, mostly young adults. "It confirms that the DACA screening process was woefully inadequate. The eligibility bar was set very low, explicitly allowing people with multiple misdemeanor and certain felony convictions to be approved. Only a handful of the applicants were ever interviewed, and only rarely was the information on the application ever verified," said Jessica M. Vaughan, director of policy studies at the Washingtonbased Center for Immigrat io n Studies. She told Secrets, "t his statistic undercuts the image of DACA t hat has been spread by the pro-illegal alien groups and the news media, that the DACA recipients are mostly college kids. Sens. Charles E. Grassley and Mike Lee said the loophole has likely been used "dozens, if not hundreds" of times to help illegal immigrants cut at least 10 years out of their citizenship quest . The trick is known as "advance parole," and it allows illegal immigrants in the U.S. under special protected status - such as Dreamers here under the 2012 DACA deportation amnesty program - to get permission to leave t he U.S. for work or school. But one of the perks is that when they are paroled back into the U.S., they can quickly apply for a green card, signaling lawful permanent residence, wh ich is the key step on the way to citizenship . The loophole is known among immigration activists, and public colleges in California were urged to use it to help their illegal immigrant students here under the DACA program to gain legal status . The California -Mexico Studies Center actually advertises just such a program, charging thousands of dollars to give Dreamers a chance to trave l south to Mexico to qualify for advance parole. Given its direct relationship to economic and population growth, immigration policy is the most fundamental way that "nations let their people control thei r destiny." Ironically, however, exactly one year before that speech, the U.N. began a process to undermine U.S. sovereignty over immigration and contradict U.S. law. On Sept. 19, 2016, the U.N. General Assembly adopted the New York Declaration for Refugees and Migrants, in which it "decided to develop a global compact for safe, orderly and regular migration," to be adopted in 2018. That "global compac t would set out a range of principles, comm itments and underst andings among Member States regarding international migration in all its dimensions [and] deal with all aspects of international migration, including the humanitarian, developmenta l, human rightsrelated and other aspects of migration ." Many dealings between nations should be subject to international norms, including com merce, trade and diplomacy . Immigration , however, is not one of them. Migration patterns are not uniform, and certain count ries receive more migrants, both legal and illegal, than others . As a judge, I heard cases involving aliens from around the world. Obama administration policies encouraged these aliens to venture to the Southwest border from Africa, Asia and Latin America to enter the United States illegally. As a result, between 2014 and 2016, illegal immigration was largely unchecked. In response, the American people elected a president who prom ised to bring immigration under control. The proposed U.N. "global compact" threatens to undermine those efforts, however . Applying the same principles to entry into the United States as to, for example, Bangladesh or Mali, would create an unworkable enforcement regime along the U.S. border. That appears to be the goal of the proposed global compact, however. As Paragraph 49 of the declaration states, the U.N. "commit[s] to strengthening global governance of migration." For example, Paragraph 33 states that the U.N. "will consider reviewing policies that criminalize crossborder movements," and "will pursue alternatives to detention while these assessments are under way." The threat of criminal penalties, however, have proven to be a strong deterrent to illegal entry, and detention is often the only way to ensure appearance for removal. Limiting or eliminating these tools will simply encourage more illegal entry. Similarly, that paragraph would encourage illegal entry by alien minors, especially those who are gang members. Further, Paragraph 57 would have direct impacts on U.S. immigration law. It states that the U.N. "will pay particular attention to the application of minimum labor standards for migrant workers regardless of their status." This appears inconsistent with Section 274A of the Immigration and Nationality Act (INA), which makes the employment of unauthorized aliens illegal. Paragraph 58 of the declaration also appears to be inconsistent with the INA. It "encourage[s]" the return of "migrants who do not have permission to stay preferably on a voluntary basis, taking into account national legislation in line with international law." Under the INA, removal of unauthorized aliens is the rule, while voluntary departure is a discretionary privilege. The president made a strong argument for national sovereignty at the U.N. His administration must now defend that principle before the same body.
