CONSERVING THE PEACE THROUGH VALUES DRIVEN SERVICE / SHERIFF PAT GARRETT Alejandro Maldonado-Hernandez was arrested on July 12, 2019, for several charges related to a fatal crash on SW Farmington Road. On July 16, 2019, Immigration and Customs Enforcement (ICE) agents filed an immigration detainer with the Washington County Jail. Since 2014, ICE has been aware that local Oregon jails cannot legally honor administrative immigration detainers issued by ICE agents, such as the one they provided on July 16. Mr. Maldonado-Hernandez bailed out of Jail on August 8, 2019, after spending just under a month in the Washington County Jail. Had ICE agents provided a valid warrant or order signed by a federal judge during that time, Mr. Maldonado-Hernandez would have remained in custody. Since ICE failed to do so, Mr. Maldonado-Hernandez was released from custody after he posted 10% of his $250,000 bail. Delaying the release of any individual is a constitutional violation on our behalf. The continuing refusal of ICE agents to provide necessary legal justification for holding people they believe are a danger to our community is the real problem, not the Sheriff’s Office insistence on following State law. Simply put, ICE detainers are not lawful or enforceable in the State of Oregon (MirandaOlivares v. Clackamas County (D. Or. April 11, 2014). Concerning the release of Mr. Maldonado-Hernandez, the Sheriff’s Office followed policy and state law. Case Update: Detectives learned Alejandro Maldonado-Hernandez fled to Mexico with the assistance of three people; Ernesto Garcia, 20, Alicia Scardina, 21, and Luis Maldonado-Hernandez, 28. All three were arrested by the Washington County Sheriff’s Office on August 28 for the crime of hindering prosecution in connection with this case. Earlier this month, Ernesto Garcia, Alicia Scardina, and Luis Maldonado-Hernandez were successfully prosecuted by the Washington County District Attorney’s Office.
