This initiative helps state and local jurisdictions across the country inventory and test sexual assault forensic evidence (SAFE) kits, upload eligible offender DNA profiles into a national database, investigate and prosecute cases in which offender DNA profiles match, or “hit,” against existing records in the database, and develop procedural and evidence tracking capacity to prevent future backlogs. As of December 2018, the SAKI program has inventoried over 64,000 SAFE kits in 54 jurisdictions in 35 states. More than 47,000 SAFE kits have been tested resulting in over 7,000 database hits.1 As the scale of the issue became apparent, the Missouri Attorney General’s Office (AGO) began a preliminary review of the prevalence of untested SAFE kits across Missouri in November 2017. The AGO distributed a survey to organizations involved in the processing of SAFE kits and received responses from 266 law enforcement agencies, 5 crime labs, and 66 healthcare providers. This survey found 4,889 untested SAFE kits spread across law enforcement agencies and healthcare providers in Missouri.2 This troubling finding prompted the AGO to apply for and receive a three-year SAKI grant from BJA in late 2018. Major elements of the AGO’s SAKI grant include the: 1 2  Creation of a Multi-Disciplinary Working Group: The processing of a SAFE kit and the investigation and prosecution of the related sexual assault involves a multitude of stakeholders and practitioners. To ensure a holistic approach to Missouri’s SAFE Kit Initiative, the AGO has formed a multi-disciplinary working group (MDWG) made up of law enforcement, forensic laboratory staff, prosecutors, healthcare providers, and victim advocates. The MDWG first met in October 2018 and continues to provide invaluable guidance and perspective to the AGO as the initiative progresses.  Completion of a Statewide Inventory of SAFE Kits: The most pressing issue facing the SAFE Kits Initiative is the backlog of untested SAFE kits across Missouri. The first major step of the initiative has been conducting a detailed inventory of all organizations in Missouri that may possess SAFE kits. The inventory covers untested kits collected prior to April 30, 2018 as well as tested kits collected on or before December 31, 1997 (See “Inventory Scope” on page 5). This includes law enforcement agencies and healthcare providers as well as ancillary organizations such as prosecutors’ offices and prisons. This report describes inventory findings. (Bureau of Justice Assistance, 2019) (Missouri Attorney General's Office, 2018) Background 1 SAFE Kits Inventory Report 3  Testing of Inventoried SAFE Kits: Backlogged SAFE kits discovered by the inventory will be tested with the assistance of a contracted private DNA testing provider to prevent backlogged kits from overwhelming the Missouri State Highway Patrol (MSHP) crime lab’s processing of contemporary kits.  Upload of Eligible DNA Results to CODIS: As SAFE kits are tested, results that satisfy eligibility criteria will be uploaded to the Combined DNA Index System (CODIS). CODIS is a national database of DNA profiles from both known and unknown offenders and arrestees. As DNA profiles are uploaded, they are compared against existing records for matches, or “hits,” which are used to connect cases and identify perpetrators.3 As SAFE kits from the inventory are tested, eligible results will be uploaded to CODIS to further investigations.  Upload of Case Information to ViCAP: Eligible cases handled as part of the SAFE Kits Initiative will be entered into the Federal Bureau of Investigation’s (FBI’s) Violent Criminal Apprehension Program (ViCAP) database. ViCAP is a national repository for comprehensive case information for violent crimes such as homicides, sexual assaults, missing persons, and unidentified human remains. ViCAP aids law enforcement in connecting cases across jurisdictional boundaries through offender behavior or modus operandi (MO) and related details in cases rather than DNA.  Assistance of Investigations and Prosecutions of CODIS Hits: CODIS hits will be used to develop investigative leads that will be provided to the detectives of the local jurisdiction from which the SAFE kit originates. The AGO will provide investigatory and prosecutorial assistance to local jurisdictions as requested to ensure that offenders are brought to justice.  Development of a Statewide Evidence Tracking System: To prevent a backlog of SAFE kits from developing in the future, the AGO will develop an evidence tracking system (ETS) that will track SAFE kits from production through case adjudication as it moves between organizations during the process. The ETS will provide local jurisdictions a free tool for complete awareness of the status and location of relevant SAFE kits as well as allowing victims of sexual assault to monitor the status of their kit throughout the process. (Federal Bureau of Investigation, 2019) Background 2 SAFE Kit Handling in Missouri Missouri Attorney General Eric Schmitt SAFE Kit Handling in Missouri Modern SAFE kits in Missouri contain eight swabs used to collect DNA from various locations on the victim’s body, envelopes for fingernail and hair samples, a bag for the victim’s underwear, a report for the lab’s use, and a set of instructions for collecting evidence. In Missouri, the MSHP lab purchases and distributes SAFE kits to entities that might need them for evidence collection. Largely, these entities are hospitals or other healthcare providers where victims of sexual assault go to have evidence collected in a SAFE kit. Law enforcement agencies and prisons sometimes directly receive SAFE kits for use in emergencies. When a victim elects not to file a police report at the time of evidence collection, the kit is referred to as an unreported kit. While law enforcement may also collect unreported kits, common practice in Missouri is for unreported kits to remain at the collecting entity until the victim decides to file a police report or the kit is destroyed. The next step in the SAFE kit lifecycle is for law enforcement to submit the kit to a forensic lab for examination. While the Kansas City and St. Louis regions have dedicated labs, the majority of law enforcement agencies in the state use the MSHP crime lab for DNA testing. Labs typically return SAFE kits to the law enforcement agency that submitted the kit once testing is complete. Kits will often remain at the law enforcement agency until a criminal case is adjudicated or a judicial order of destruction for the kit is received. In some cases, however, the local prosecutor’s office will take possession of a kit in preparation for a trial. SAFE Kit Handling 3 SAFE Kit Inventow Process SAFE Kits Inventory Report SAFE Kits Inventory Process The AGO’s inventory of untested SAFE kits began with the hiring of the SAFE Kit Initiative Statewide Coordinator in February of 2019. Shortly thereafter, the AGO distributed a survey to ascertain the level of assistance individual organizations were likely to need based upon the number of SAFE kits at each location and the capacity of staff to complete the inventory alongside their normal duties. The results were combined with a comprehensive list of law enforcement agencies, healthcare providers, and ancillary organizations that might possess SAFE kits. The AGO divided the inventory into six geographic sections (A – F). See Figure 1 for a map of these regions. The AGO then hired seven federal grant-funded analysts distributed amongst the inventory regions to complete the inventory. Figure 1: Section map of the SAFE kits inventory SAFE Kits Inventory Process 4 Missouri Attorney General Eric Schmitt Inventory Scope In-Scope SAFE Kits  Part I: Untested SAFE kits with evidence collected before April 30, 2018, the submission date of the AGO’s grant application  Part II: SAFE kits collected on or before December 31, 1997, before DNA testing was used in Missouri, that have been previously tested by a lab  SAFE kits located outside of Missouri for crimes that occurred in Missouri  SAFE kits used to collect evidence for multiple crimes, at least one of which included a sexual component (e.g. kidnapping and sexual assault) Out-of-Scope SAFE Kits  SAFE kits located in Missouri, but used for out-of-state crimes  SAFE kits used to investigate events without a sexual component (e.g. murder, suicide, wellness checks, or overdose deaths)  SAFE kits for events inside of Missouri involving exclusively military personnel handled through military law  SAFE kits submitted to a forensic lab but awaiting testing  SAFE kits collected after April 30, 2018  Part II SAFE kits collected between January 1, 1998 and April 30, 2018  Part II SAFE kits retested with cold case grant funds or other funding to prevent duplication of testing services Once hired, AGO analysts were trained on the scope of the 2018 SAKI grant, communication options and skills for the inventory process, the collection and reporting of data, and inventory certification procedures. The scope of the inventory was determined by provisions of the AGO’s grant, jurisdiction of Missouri law, and efficiency of funding (e.g. avoiding duplication of services). Please see the “Inventory Scope” inset for more details. AGO analysts began the inventory by actively soliciting information from organizations that might possess SAFE kits. As analysts identified additional organizations that might possess SAFE kits, they were included in the inventory to ensure completeness. The nature of analysts’ assignments varied by geography and organization. One analyst was embedded with an urban law enforcement agency’s staff long-term. Others conducted daylong site visits to connect organization records with SAFE kits to complete the inventory. All analysts provided guidance and assistance to responding organizations through written communication, telephone conversations, and site visits. Many practical realities complicated data collection efforts. As an example, to preserve the chain of SAFE Kits Inventory Process 5 SAFE Kits Inventory Report custody and the evidence itself, kits could not be opened. Since the exterior of SAFE kits in Missouri provide almost no case information, this forced the inventory to locate and connect related documents such a police reports and hospital records. The records for these decades-old kits were sometimes lost, inaccessible, or destroyed over time. Realities such as this mean that the information available for each kit sometimes varies significantly, even from the same organization. As organizations began submitting inventory results to the AGO, staff reviewed the material for compliance and accuracy and coordinated with field analysts and organizations to resolve questions. When organizations were delayed in returning inventory information, the AGO conducted site visits to determine the level of support needed to complete their inventory. Once organizations’ inventories were complete, they provided signed certifications of the results to the AGO, including those organizations at which no kits were present. See appendix B for an example of an inventory certification. Once final inventory results were received, AGO analysts began verification site visits to organizations reporting SAFE kits in their possession. These site visits provided the opportunity to understand organizations’ property-handling procedures, discuss challenges and potential improvements to the inventory process, and place barcodes on inventoried kits.4 These barcodes will be vital in implementing the ETS that will be developed as part of the AGO’s grant. The hands-on nature of barcode placement was invaluable in assisting organizations in reconciling discrepancies between their records and the reality of their storage facilities. During the verification process, staff and analysts worked with organizations with no kits to report to ensure completeness. Law enforcement agencies were notified of their previously signed certifications and encouraged to conduct final internal audits and report any amendments to their inventories. Analysts made random site visits to organizations reporting zero kits to verify inventories and better understand examples of successful SAFE kit processing procedures. Throughout the inventory, AGO staff and analysts facilitated the transfer of reported SAFE kits from healthcare providers to appropriate law enforcement agencies and updated inventories accordingly. These coordinated transfers preserved the chain of custody and accuracy of the inventory while sometimes beginning the investigative process. 4 In Missouri, the MSHP lab distributes all SAFE kits to healthcare providers. Since January 2018, the MSHP lab has placed barcodes on SAFE kits distributed to hospitals in the state. The AGO coordinated with the MSHP lab to use barcodes compatible with the lab’s existing barcode system for the tagging of inventoried kits produced before barcodes became standard. As the St. Louis and Kansas City labs have an independent barcode system, the AGO did not place barcodes on kits in these labs’ possession. SAFE Kits Inventory Process 6 Missouri Attorney General Eric Schmitt Over the course of the inventory, AGO staff and analysts invested more than 4,290 work hours and travelled more than 17,150 miles. However, this inventory would not have been possible without the dedication shown by sexual assault nurse examiners (SANEs), hospital staff, advocates, evidence managers, law enforcement investigators, and crime lab personnel across the state of Missouri. The professionalism shown by these personnel reflects their dedication to the communities they serve and their desire to improve service to victims of sexual assault. The hours of preparation, organization, data entry, and cold case research far exceed the time expended by the AGO’s staff. Most organizations were required to take personnel away from other duties to fulfill inventory tasks. Many SANEs and law enforcement personnel worked weekends, holidays, and overtime to meet inventory requirements. Some organizations used the inventory as an opportunity to review and amend their SAFE kit processing procedures by sending kits for testing more rapidly, storing kits separately in evidence lockers, and auditing inventories to prevent cases from being forgotten or left unresolved. The AGO thanks these partners for ensuring a successful statewide inventory. Figure 2: Hours worked and miles driven by AGO staff during the SAFE kits inventory SAFE Kits Inventory Process 7 .- - Inventory Results SAFE Kits Inventory Report Inventory Results The SAFE kit inventory included 627 law enforcement agencies, 193 healthcare providers, and 4 ancillary organizations. In total, the inventory located 6,987 in-scope SAFE kits. Law enforcement agencies held 5,638 (80.7%) kits, healthcare providers held 1,089 (15.6%), and ancillary organizations held 260 (3.7%) kits. Jackson County had the highest rate of kits at 338.1 per 100,000 people from 2,368 kits. Beside the 27 counties without any inventoried kits, Moniteau County had the lowest rate of kits at 6.2 per 100,000 people from one kit. See Figure 5 for a breakdown of inventory results by county, reporting and testing status, and organization type. Police reports were located for 5,268 (75.4%) kits while reports were either never filed or inaccessible for 1,719 (24.6%). All previously tested kits were considered reported, leaving 4,438 untested reported kits. Healthcare providers were far more likely to hold unreported kits with 67% being unreported compared to 14.6% being unreported in law enforcement agencies. The distribution of kits by date of assault can be seen in Figure 3. The oldest kits in the inventory date back to 1980. The relative decline in kits in 1998 is due to the cutoff date for previously tested kits being 1997. Years that are more recent generally had higher numbers of kits. Please note that information on the date of assault was only available for 89.6% of kits. Over 67% of inventoried SAFE kits were collected from female victims with only 5.4% having male victims and the remaining 27.1% having an unknown sex. While female victims have a small spike at ages 3 and 4 as well as a large spike at 18 and 19, male victims only spike at ages 3 and 4, possibly indicating a reduced likelihood for reporting at older ages. To prevent backlogged kits from overwhelming the capacity of the MSHP crime lab and hindering the testing of contemporary kits, a private forensic laboratory selected through a competitive bidding process will test Missouri’s backlog. A third-party lab will verify the primary lab’s work and then the MSHP crime lab will review results for upload to CODIS. The AGO estimates that existing grant funds will allow 1,250 inventoried SAFE kits to be tested during this grant period. Once the testing and transport costs are known, the number of kits tested is expected to increase due to a favorable competitive bid for DNA testing services. The AGO will use a testing strategy that avoids statute of limitations issues5 and considers prosecutorial interests while ensuring geographic proportionality of testing funds. This will done by testing approximately 500 of the most recently collected kits found statewide then distributing the remaining 750 kits proportionally among the six inventory sections. The AGO believes that all reported SAFE kits should be tested to provide every opportunity to bring predators to justice and vindicate victims. Additional funds will be needed to test all reported kits; therefore, the AGO will continue to seek additional funding to ensure the elimination of Missouri’s SAFE kit backlog. In keeping with national best practices6 and the victim’s wishes, the AGO believes that unreported SAFE kits should not be tested. Victims’ safety and autonomy must remain a priority as Missouri works to address the SAFE kits backlog. CODIS Upload As kit testing is completed, resulting DNA profiles will be forwarded to the MSHP Crime Lab to determine CODIS eligibility. To be eligible for upload to CODIS, a DNA profile must accompany documentation that: 1) A crime has been committed, 2) The DNA sample was recovered from the crime scene and is attributed to the putative perpetrator, and 3) Elimination samples (e.g. for consensual partners) have been requested, if applicable.7 5 See Appendix C for a resource on statutes of limitation for sexual assaults in Missouri (Office on Violence Against Women, 2017) 7 (Federal Bureau of Investigation Laboratory, 2019) 6 Next Steps 11 SAFE Kits Inventory Report As DNA profiles are uploaded to CODIS, they will be compared against existing DNA profiles in the database to identify potential matches. Uploading DNA profiles to CODIS helps law enforcement connect cases and identify unknown offenders. While a criminal case may not hinge on the identity of an offender, for example when consent is the primary question, uploading DNA profiles from these SAFE kits is still vital. While uploading DNA profiles for unknown offenders may lead to the identification of a suspect, DNA profiles for known offenders may match previously uploaded profiles from unknown offenders, reigniting cold cases. Investigative and Prosecutorial Follow Up As CODIS hits to now-identified offenders are received, the AGO will work with its law enforcement partners to prepare investigative resources for forwarding to local jurisdictions. The AGO will follow investigations and prosecutions related to the SAFE Kits Initiative and stands ready to assist local law enforcement and prosecutors as requested. Evidence Tracking System Development The final element of the AGO’s grant is the development of an ETS. An ETS allows multiple stakeholders, including the victim, to track the progress and location of a SAFE kit throughout an investigation and prosecution. This ensures that kits are not lost or delayed in transit from one organization to another and empowers victims to follow the progress of their case. The ETS will assist jurisdictions in complying with statutory provisions related to SAFE kits and provide a statewide picture of the handling of SAFE kits in Missouri. The AGO’s system will be provided to stakeholders free of charge as a web-based system upon its completion. Next Steps 12 Recommendations Missouri Attorney General Eric Schmitt Recommendations In 2018, the Missouri General Assembly passed House Bill (HB) 1355, an omnibus criminal justice bill that included language on SAFE kit processing. HB 1355’s amendment of section 595.220, RSMo. was the first statutory language governing the processing of SAFE kits in Missouri and provided much needed standardization in testing timelines and retention schedules. After HB 1355, § 595.220, RSMo. requires that:      Healthcare providers electronically notify law enforcement of a reported or anonymous SAFE kit upon evidence collection, Law enforcement submit a reported or anonymous SAFE kit for DNA testing within 14 days of receipt from a healthcare provider, Law enforcement retain reported and anonymous SAFE kits for 30 years or until case adjudication, The AGO develop a statewide ETS that allows organizations and victims to track SAFE kits from evidence collection through case adjudication or destruction The Department of Public Safety (DPS) develop forms and procedures for gathering, transmitting, and storing SAFE kits throughout their lifecycle HB 1355 SAFE Kit Definitions Reported: The victim has agreed to participate in the criminal justice system by filing a police report to initiate a criminal investigation. Anonymous: A subcategory of a reported kit in which the victim has agreed to participate in the criminal justice system and has filed a police report, but wishes to remain as anonymous as possible. Unreported: The victim has not agreed to participate in the criminal justice system and has not filed a police report. It is a national best practice to not test unreported SAFE kits in keeping with victims’ wishes. Note: Effective after August 28, 2018 and not applicable to this inventory Recommendations HB 1355 also added a category of SAFE kit referred to as anonymous kits. See the inset for details. While HB 1355 greatly improved the statutory environment for SAFE kit processing in Missouri, this office has identified issues for clarification or improvement. These recommendations are informed by experience gained from the inventory process as well as ongoing communication from stakeholders. The AGO recommendations on these topics are described below. 13 SAFE Kits Inventory Report Required Participation in the ETS As discussed above, as part of both the 2018 SAKI grant and HB 1355, the AGO will develop a free ETS for use by all organizations handling SAFE kits. This system will allow sexual assault victims to remain aware of the status of their SAFE kit through testing and adjudication as well as allow organizations handling SAFE kits to maintain a reliable inventory and prevent future backlogs. However, § 595.220, RSMo. does not require that organizations handling SAFE kits participate in the ETS, leaving the door open to inconsistent use of the system that would negate any benefits of its use. The ETS cannot provide an accurate and complete inventory of SAFE kits in Missouri if entities handling SAFE kits do not use it to track their kits in a standardized way that can translate between healthcare providers, law enforcement, crime labs, and prosecutors’ offices. Required participation in an ETS is common among states implementing them. Of the 26 states that have or appear to be pursuing ETSs, 18 require participation in one form or another. Of the eight states that do not require participation, many do not have a statute driving the ETS effort and are instead state agency initiatives.8 Michigan is the only state that does not require ETS participation that has launched its system and acknowledges that participation is an issue degrading the system’s effectiveness. The AGO recommends that the State of Missouri consider requiring participation in the free statewide ETS that this office will develop for any entity that may have custody of a SAFE kit. Kit-Level Tracking in the ETS Section 595.220, RSMo. currently requires that the AGO track “evidentiary collection kits and their components, including individual specimen containers.” Tracking component specimens of a SAFE kit would prove extremely burdensome and potentially compromise the integrity of the kit for no additional tracking benefit. The excess burden could disincentivize the use of the ETS upon launch. This office was not able to identify any other state in which component specimens were tracked as part of an ETS. The AGO recommends that the State of Missouri only track SAFE kits as a whole. 8 (Joyful Heart Foundation, 2019) Recommendations 14 Missouri Attorney General Eric Schmitt Long-term Storage for Unreported Kits When a victim of sexual assault elects not to participate in the criminal justice system, the corresponding SAFE kit is considered unreported. Unreported kits are not and should not be tested for DNA in keeping with national best practices and the victims’ wishes. They are collected to allow victims to reconsider their participation later. However, this often leaves unreported kits in healthcare providers and some law enforcement agencies for extended periods, straining storage facilities. Currently, there is no standardized method for victims to reconsider their involvement in the criminal justice system nor consistent retention schedules for unreported kits. The AGO recommends that the State of Missouri consider alternative centralized storage for unreported SAFE kits in Missouri. Review Exterior Information of SAFE Kits In the course of the inventory, a consistent problem that arose was the inability to access information related to a SAFE kit without risking the integrity of the forensic evidence. This was caused by the fact that reports are stored inside of the SAFE kits and only the date of collection and a brief chain of custody are available on the exterior of a kit. If reports were available on the exterior of SAFE kits they would greatly improve access to case information and make management of kits easier. The AGO recommends that the State of Missouri review and revise the information located on the exterior of SAFE kits. Evidence Tracking System (ETS): A standardized electronic system that allows healthcare providers, law enforcement agencies, advocates, testing labs and victims to monitor the progress of the SAFE kit from collection to final disposition. Multi-Disciplinary Working Group (MDWG): A collection of volunteer community stakeholders and practitioners that assist in the implementation of the SAKI grant. Violent Criminal Apprehension Program (ViCAP): A unit of the United States Federal Bureau of Investigation responsible for the analysis of serial violent and sexual crimes, organizationally situated with the Critical Incident Reponse Group’s (CIRG) National Center for the Analysis of Violent Crime (NCVAC). Y-STR testing: An alternative to Short Tandem Repeat (STR) testing that is suitable for testing SAFE kits because it can detect low levels of male DNA present.
