NOTING that, in 2018, 835 anti-Semitic hate crimes were reported, most of which were acts of intimidation according to the FBI’s annual Report on Hate Crimes; NOTING that, in 2018, the Jewish community faced a mass shooting of 11 worshippers at a synagogue, marking the deadliest attack on Jews historically on US soil; NOTING that ASU students who are part of the Jewish community have expressed concerns over their own safety on-campus to the administration and police force in light of recent events, specifically Nazi propaoganda; RECOGNIZING that, in a statement sent out by President Michael Crow on November 19, 2019, he notes that ASU adopted the Chicago Statement of Freedom Expression in 2018, which reads that “the freedom to debate and discuss the merits of competing ideas does not, of course, mean that individuals may say whatever they wish, wherever they wish. The university may restrict expression that violates the law, that falsely defames a specific individual, that constitutes a genuine threat or harassment, (or) that unjustifiably invades substantial privacy or confidentiality interests…”; THEREFORE BE IT RESOLVED that the Undergraduate Student Government of Tempe supports all students in mutual civil dialogue and debate in an environment that is free from threat and intimidation; BE IT FURTHER RESOLVED that the Undergraduate Student Government of Tempe does not support any type of intimidation, hate speech, or threats directed towards anyone, does not support anti-Semitism, and stands by the Jewish community; BE IT EVEN FURTHER RESOLVED that a copy of this resolution be sent by President Hanna Salem to the Dean of Students and the Arizona State University Chief of Police on the Tempe campus by December 6, 2019. THE ASSOCIATED STUDENTS OF ARIZONA STATE UNIVERSITY UNDERGRADUATE STUDENT GOVERNMENT, TEMPE SENATE SEVENTEENTH LEGISLATURE SIXTH REGULAR SESSION TUESDAY OCTOBER 8 2019 SENATE RESOLUTION 11 INTRODUCED BY SENATOR MEGAN HALL BARRETT, THE HONORS COLLEGE ___________________________________________________________________________________ A Resolution to Approve Seizure Safe School Legislation. ___________________________________________________________________________________ WHEREAS Arizona State University is a public university in compliance with Title II of the Americans with Disabilities Act, and the Disability Resource Center was established for the purpose of helping ASU students, faculty, and staff with disability accommodations; WHEREAS House Bill 684 (Sam’s Law) and House Bill 147 (The Lyndsey Crunk Act) are examples of seizure safe school legislation that have been passed in four states (Illinois, Kentucky, Texas, and Indiana) and introduced in three states (Pennsylvania, Massachusetts, and New Jersey); WHEREAS epilepsy is a brain disorder characterized by recurrent and unprovoked seizures that can affect anyone, at any age, at any time; WHEREAS according to the National Epilepsy Association one in twenty-six people will develop epilepsy at some point in their life; THUS, statistically, 4,279 students at ASU out of 111,249 enrolled students as of 2018 have been diagnosed with epilepsy or will be diagnosed with it later in life; NOTING that, as of November 5th, 2019, 78 ASU students with epilepsy were registered with the Disability Resource Center; WHEREAS the CDC estimates between 66,400-87,500 people in Arizona are affected by epilepsy (with a CI of 95%); WHEREAS according to the UCL Institute of Neurology, people with epilepsy are 15-19 times more likely to drown; WHEREAS according to the University of Miami, 33% of people with epilepsy struggle with depression and anxiety in comparison to 7% of the general populace; BE IT RESOLVED that the Undergraduate Student Government of Tempe supports national legislation that is inclusive of students and employees with disabilities, and requests that seizure safe school legislation be passed in Arizona. BE IT FURTHER RESOLVED that a copy of this resolution be sent to Governor Doug Ducey and a representative of the Arizona Epilepsy Foundation. The Senate here assembled finds the following (1) The Circle K International Club submitted a request for funding on September 15,2019 in the amount of $641.95 (2) No updates were given on the status of the “Circle K International club” until September 29,2019 (3) The Circle K International Club was rejected for funding on the grounds of budgets for clubs are capped at $600 for the fall semester of 2019 (4) The Circle K International Club reached out to The Undergraduate Students Government to appeal the funding request on October 14,2019 (5) The Circle K International Club is willing to comply with any regulations enacted on their organization for the duration of the semester. Section 3: Budgetary Amendments Section 3A. (1) Funding-The Senate shall allocate $600.00 to The Circle K International Club for marking, food, apparel and other expenses. (2) Reduction- The Appropriations budget shall be reduced by $600.00 WHEREAS the Undergraduate Student Government Senate is charged with the responsible and ethical distribution of Student Program Fee funds annually; WHEREAS the Undergraduate Student Government Appropriations Committee Chair has recently reviewed the Circle K International Club budget presented by Jordan Marshall THEREFORE BE IT ENACTED by the Undergraduate Student Government, Tempe Senate to approve The Circle K International Club budget in the amount of $600.00 THE ASSOCIATED STUDENTS OF ARIZONA STATE UNIVERSITY UNDERGRADUATE STUDENT GOVERNMENT, TEMPE SENATE SEVENTEENTH LEGISLATURE FIFTH REGULAR SESSION TUESDAY, OCTOBER 22, 2019 SENATE RESOLUTION 9 INTRODUCED BY SENATOR VARUN SUSARLA SCHOOL FOR THE FUTURE OF INNOVATION IN SOCIETY ___________________________________________________________________________________ A Resolution to encourage accurate self-representation in the 2020 Census at Arizona State University ___________________________________________________________________________________ The Undergraduate Student Government, Tempe Senate, Section 1 Short Title: This resolution may be cited as the 2020 Census Resolution Section 2 Finding: WHEREAS, the Associated Students of Arizona State University recognizes the U.S. Census Bureau is required by Article I, Section 2 of the United States Constitution to conduct an accurate count of the population every ten years and; WHEREAS, the decennial Census is essential to our democracy; and will promote informed decision-making that directly affects all citizens of the United States and of the State of Arizona WHEREAS, the decennial Census provides the basis for reapportioning Congressional seats, redistricting, the distribution of $600 billion in federal funding, and resource allocation for education, healthcare, housing and transportation, Medicaid, the Supplemental Nutrition Assistance Program, Title I grants to local education agencies, and much more; WHEREAS, a 1994 study conducted by Project Euclid found an estimated undercount of 6.14% in central cities in the West among minority communities and 2.13% among non-minority communities in central cities in the West and 1.84% in non-central cities among non-minority and Indian communities; WHEREAS, a 2002 study conducted by the US Census Bureau found the undercount in black and Hispanic communities to be greater than non-black or Hispanic communities; NOTING that for the first time the US Census Bureau is also using online portals to conducted the census; NOTING that Institutions of Higher Education have been sections of the population leading to an undercount; BE IT RESOLVED that the Associated Students of Arizona State University shall take measures to spread awareness about the importance of the 2020 Census; BE IT FURTHER RESOLVED that the Associated Students of Arizona State University shall also take measures to encourage participation among students in the 2020 Census. This legislation can be cited as the “Voting Locations Act.” Section 2: Jurisdiction. WHEREAS the Undergraduate Student Government Tempe was formed to provide a forum for inter-university dialogue, to organize student involvement, and to advocate for and administer services, resources, and programs that benefit the students of Arizona State University; Section 3: Pertinence of Issue. WHEREAS the United States Constitution enumerates the right to vote in the 26th Amendment, specifically that “The right of citizens of the United States, who are eighteen years of age or older, to vote shall not be denied or abridged by the United States or by any State on account of age;” WHEREAS, as of 2018, 69.9% of Arizona State University students were registered to vote; WHEREAS, in the 2018 midterm election, only 41.5% of Arizona State University students voted; WHEREAS, making voting more accessible to Arizona State University students would likely increase voter turnout; WHEREAS 1500 students with Tempe zip codes and 1600 students from surrounding zip codes in a recent survey support having a ballot center on campus; WHEREAS a ballot center, as opposed to a polling location, is not limited by precinct, rather ballot centers are county wide; NOTING that not all Arizona State University students reside in the Tempe precinct; WHEREAS ballots can also be submitted by means of a ballot drop-box; WHEREAS a 2005 study found that “distance has a statistically significant impact on the voting decision;” THEREFORE BE IT RESOLVED: The Undergraduate Student Government, Tempe, Senate urges the University to ensure that there is a ballot center on campus for federal elections beginning with the 2020 Presidential Election; BE IT FURTHER RESOLVED: The Undergraduate Student Government, Tempe, Senate urges the University secure a permanent ballot box, to be maintained by the County Recorder, at a location on campus that is easily accessible to both students and the surrounding community; BE IT EVEN FURTHER RESOLVED: That a copy of this legislation be sent to the Maricopa County Recorder, Adrian Fontes, as well as the Arizona State University Director of Economic Development and Community and Municipal Relations, Robert Cox, by Vice President of Policy Trey Leveque before this Friday at 11:59 pm. WHEREAS the United States Constitution enumerates the right to vote in the 26th Amendment, specifically that “The right of citizens of the United States, who are eighteen years of age or older, to vote shall not be denied or abridged by the United States or by any State on account of age;” WHEREAS, under A.R.S. § 16-402, employers must grant employees paid time off work to vote if certain conditions apply. Specifically, the law protects employees when there are fewer than three consecutive hours between the time that polls open or close and the beginning or end of their regular work shifts; WHEREAS members of Undergraduate Student Government Tempe observed students missing class or choosing not to vote on the grounds that they had class at the most recent midterm election; WHEREAS, as of 2018, 69.9% of Arizona State University students were registered to vote; WHEREAS 58.7% of Arizona State University students voted in the 2016 Presidential Election; NOTING that this percentage can be increased by making voting more accessible; WHEREAS Election Day, the Presidential Preference Election, and the Primary Election occur on days of the week where it is possible for classes to be scheduled; RECOGNIZING that, in a recent petition, 1500 students with Tempe zip codes and 1600 additional students from surrounding zip codes supported having no class on Election Days; WHEREAS having no graded classroom activities on Election Days would remove potential barriers to voting; THEREFORE BE IT RESOLVED: The Undergraduate Student Government, Tempe, Senate urges the University to ensure that there be no exams schedule on any of the aforementioned election dates; NOTING that not all Arizona State University students are eligible to vote or registered to vote; RECOGNIZING that civic engagement goes beyond voting; THEREFORE BE IT FURTHER RESOLVED: The Undergraduate Student Government, Tempe, Senate urges the University to allow no punitive academic measures to students who, with(proof is not always possible and alientating, all students regardless) proof, miss classes for purposes of voting or volunteering for events specifically oriented towards voting on the aforementioned election dates; BE IT EVEN FURTHER RESOLVED: That a copy of this legislation be sent to the Arizona State University’s Faculty and Staff Senate, as well as to the Academic Deans of each College, by Vice President of Policy Trey Leveque before this Friday at 11:59 pm. The Senate here assembled finds the following: (1) The Sun Devil Book & Tea Club submitted their funding request on September 14th, 2019. (2) No updates were given on the status of the “Sun Devil Book & Tea Club” funding until September 30, 2019. (3) The Sun Devil Book & Tea Club funding was rejected for improperly filling out the “I agree statement” on September 30, 2019. (4) The Sun Devil Book & Tea Club reached out to the Undergraduate Student Government to appeal the funding request on October 1, 2019. (5) The Sun Devil book & Tea Club is willing to comply with any regulations enacted on their organization for the duration of the semester. Section 2B. The Senate here assembled finds the following: (1) The College Libertarians submitted their funding request on September 28th, 2019. (2) No updates were given on the status of the “College Libertarians” funding until September 30, 2019. (3) The College Libertarians funding was rejected for improperly filling out the “I agree statement” on September 30, 2019. (4) The College Libertarians reached out to the Undergraduate Student Government to appeal the funding request on October 7, 2019. (5) The College Libertarians are willing to comply with any regulations enacted on their organization for the duration of the semester. Section 2C. The Senate here assembled finds the following: (1) The Society of Water and Environmental Leaders (SWEL) submitted their funding request on September 15th, 2019. (2) No updates were given on the status of the “SWEL” funding until September 26, 2019. (3) The SWEL funding was rejected without explanation on September 26, 2019. (4) SWEL reached out to the Undergraduate Student Government to appeal the funding request on October 10, 2019. (5) SWEL is willing to comply with any regulations enacted on their organization for the duration of the semester. Section 2D. The Senate here assembled finds the following: (1) The Society of Asian Scientists and Engineers submitted their funding request on September 14th, 2019. (2) No updates were given on the status of the “Society of Asian Scientists and Engineers” funding until September 30, 2019. (3) The Society of Asian Scientists and Engineers funding was rejected for lacking description on September 30, 2019. (4) The Society of Asian Scientists and Engineers reached out to the Undergraduate Student Government to appeal the funding request on October 1, 2019. (5) The Society of Asian Scientists and Engineers is willing to comply with any regulations enacted on their organization for the duration of the semester. Section 2E. The Senate here assembled finds the following: (1) The Trading Card Game Club submitted their funding request on September 4th, 2019. (2) No updates were given on the status of the “Trading Card Game Club” funding until October 9, 2019. (3) The Trading Card Game Club funding was rejected for not following USG funding guidelines on October 9, 2019. (4) The Trading Card Game Club is “willing and able to brand their club's information with stickers on the trading cards in hopes of falling under the category of ‘giveaway items.’” (5) The Trading Card Game Club reached out to the Undergraduate Student Government to appeal the funding request on October 12, 2019. (6) The Trading Card Game Club is willing to comply with any regulations enacted on their organization for the duration of the semester. Section 3: Budgetary Amendment Section 3A. (1) Funding - The Senate shall allocate $600.00 for Sun Devil Book & Tea Club’s marketing, apparel, food, and other expenses. (2) Reduction - The Appropriations budget shall be reduced by $600.00. (3) Requirements - With the approval of this legislation the organization shall not be funded for any event for the duration of the semester. Section 3B. (1) Funding - The Senate shall allocate $600.00 for College Libertarian’s marketing, apparel, food, and marketing expenses. (2) Reduction - The Appropriations budget shall be reduced by $600.00. THE ASSOCIATED STUDENTS OF ARIZONA STATE UNIVERSITY UNDERGRADUATE STUDENT GOVERNMENT, TEMPE SENATE SEVENTEENTH LEGISLATURE FIRST REGULAR SESSION TUESDAY, SEPTEMBER 10TH, 2019 SENATE RESOLUTION I INTRODUCED BY: BENJAMIN COOPER COLLEGE OF LIBERAL ARTS & SCIENCES ___________________________________________________________________________________ A Resolution to Condemn the Deportation of ASU Students ___________________________________________________________________________________ WHEREAS, the Undergraduate Student Government Tempe was formed to provide a forum for inter-university dialogue, to organize student involvement, and to advocate for and administer services, resources, and programs that benefit the students of Arizona State University; WHEREAS, in August of 2019, nine ASU students from China were detained by Customs and Border Protection, and, after warrantless and suspicionless searches of their personal electronic devices, were deported to their country of origin despite the fact that all students “were in possession of all needed documentation to enter the U.S.,” according to ASU President Michael Crow; WHEREAS, President Crow has, in a letter to the US Secretary of State, called for “[a] summary of the number and circumstances for denials for entry into the U.S. at LAX over the past ninety days” and a “written explanation of the new ‘standard procedures’ for the screening of international students;” WHEREAS, Customs and Border Protection have not provided any explanation for their decision to deport ASU students, other than stating that the decision was based on unspecified information discovered as a result of their inspection of the students’ personal electronic devices; WHEREAS, the American Civil Liberties Union, a US legal organization, has filed a lawsuit against the Department of Homeland Security and Customs and Border Protection over the practice of warrantless and suspicionless searches of the personal electronic devices of citizens and lawful US residents; NOTING that a Palestinian student attending Harvard University was also deported under similar circumstances in August; RECOGNIZING that all students who attend ASU are just as much part of the University community as any other student, no matter their national origin or immigration status; BE IT RESOLVED that the Undergraduate Student Government of Tempe supports University President Michael Crow in his request for more information regarding the deportation of 9 ASU students, as well as all other requests he has made in his letter to the US Secretary of State; BE IT FURTHER RESOLVED that Undergraduate Student Government of Tempe condemns, not only the practice of warrantless and suspicionless searches of the personal electronic devices of US citizens and lawful permanent residents, but all such searches, especially in the case of international students; BE IT FURTHER RESOLVED that the Undergraduate Student Government condemns, specifically, the deportation of nine ASU students on the basis of warrantless and suspicionless searches.
