Respondent City of Seattle offers no objection to Allen Miller eventually withdrawing as

Petitioners’ counsel. See Dkt. # 27. But for the reasons stated in the City’s Motion to Modify the
Scheduling Order (Dkt. # 28), the City respectfully asks this Court to condition Mr. Miller’s
withdrawal on Petitioners first complying with this Court’s November 14 order to file and serve

an amended complaint naming the United States Department of the Army and the Seattle Public
18
Schools as respondents in this action. See Dkt. # 25. Mr. Miller should have complied with the
19
20

November 14 order promptly, especially because the scheduling order set a “Pleading
amendment/3rd Party action” deadline of November 22. See Dkt. # 6. Complying with the

21
November 14 poses no hardship and is necessary for the expeditious resolution of this dispute.
