Upon further review, our conclusion is the semi annual reports were intended to support the single report to the legislature required in December 2000 and once that was submitted, the requirement to provide CJTC semi annual reports was no longer necessary. We?ve decided not to send these reports to CJ TC which was your recommendation two years ago when we ?rst brought this anomaly to your attention. We will discontinue sending the reports effective immediately. FYI, the transportation committees asked us last fall for suggestions of mandated reports with outdated requirements that should be repealed. I am all the more comfortable with the decision to cease sending the data to CJTC since we only did send the one report to the Legislature for 2000 data. We are stating it is our understanding and interpretation of the Legislation this was only a one year requirement which we did indeed comply with in January 2001. Since then we have not generated a report in cooperation with CJTC and submit because the requirement expired. Nine years have passed with no questions or inquiries reference the issue or our understanding of the requirement; and, we do in fact, maintain the data if anyone should want to see it again. Regarding your other questions: Yes, there was only one report submitted jointly December 2000, it was actually submitted in January 2001 . The semi-annual report to CTJ was not submitted at all from January 2001 through 2007. It was from a GMR review old legislation that we discovered that perhaps we should be submitting it. We began the discussion with CJTC in late 2007 and started submitting this report to CJTC in January 2008. Since then have we simply been pulling the data and sending it to CJTC never to be heard from again? Although the RCW is somewhat ambiguous, the risk is very remote that we might get told in the future that WSP should have been submitting it. That might come in the aftermath of a Rodney King type incident, but again is remote. And if that occurs, we?ll simply indicate that was not our interpretation of the RCW that the report was a recurring requirement. We could then start submitting it to CJTC again as the report is relatively low effort to put together and can be done quickly. Unless you direct otherwise, we?ll plan on the following: 1. Jeff will remove the required report from his tracking system and annotate that our interpretation is it was a one time requirement. 2. BFS will discontinue sending the report to CJTC. 3.
