Cuomo Governor of New York State New York State Capitol Building Executive Chamber Albany, New York 12224 Dear Governor Cuomo, As you know, on June 17, 2019, the New York State Legislature passed the Green Light Law which would require the New York Department of Motor Vehicles (DMV) to issue driver?s licenses to people unlawfully in the United States. While [have serious concerns with the constitutionality of this misguided policy as outlined in a letter I sent to the Department of Justice on September 19, 2019 - I write today to address the grave consequences that will arise from blocking federal Law Enforcement of?cers from accessing the New York State DMV database. I am hearing from multiple Law Enforcement of?cers including from Customs and Border Protection (CBP) and Border Patrol Agents about how this reckless policy will prevent them from effectively executing their jobs, posing serious threats to their safety and our national security. I am especially concerned with the implications of blocking border patrol of?cers and border agents from being able to run license plates to check for active warrants and being able to con?rm if someone is an illegal immigrant with a deportation order or active warrant. If our border patrol agents cannot con?rm someone?s immigration status, how can we expect them to effectively patrol our borders and keep our citizens safe? Additionally, this decision will disallow US. citizens with an enhanced driver?s license from returning to the US. because CBP of?cers will be unable to con?rm if they have a valid license. It is unconscionable to think US. citizens could not be able to return home because the State took away our Law Enforcement?s critical ability to access DMV records. I am fearful of the consequences this decision will have on our immigration system and country as a whole and I strongly urge you to take into consideration the dire outcomes that are sure to ensue. I speak for many Law Enforcement of?cials when I ask you to immediately reverse this action and reinstate federal Law Enforcement?s access to State records. The safety of our nation depends on the work provided by our border patrol agents.
