MOTION FOR REVIEW REQUESTING MEDICAL HARDSHIP DUE TO THE
DEFENDANT HAS CANCER AND TAKING CHEMOTHERAPY WHILE IN JAIL
Comes now CECIL L. FIELDS, JR., Attorney for the Defendant, JAMES
HERROD, and shows to Honorable Court in the above style case as follows:

That the Defendant is the Dallas County Jail for a charge of Murder and
has a diffuse Large B-Cell Lymphoma Cancer.
That the Dallas County Sheriff has to transport him to Montgomery twice
or three times a week for Chemotherapy treatment.
That there will soon be a time when the Defendant will need to be
hospitalized for one week at a time and there will be three or four of such
stays in Montgomery. The Dallas County Sheriff”s Department would not
want to pay one or two Sheriff Deputies to stay one week 24/7 in a
hospital for such treatment.
That the Defendant needs to be home to have the support of his family
and spend quality with his family.
That the Defendant will return to Court for review within 5 or 6 months of
this release.

ORDER
This matter coming before the Court on the Motion of the Attorney for the
Defendant and upon consideration or the Defendant’s Motion, it is hereby ORDERED that
a medical furlough is GRANTED to the Defendant.
It is further ORDERED that Defendant shall be released immediately for the
purpose of having medical treatment.
It is further ORDERED the defendant shall return before the Court, no later than
months from the date of this order, to determine a return date to the custody of the Dallas
County Jail.
