U.S. Department of Homeland Security Washington, DC 20528 Homeland Security Privacy Office, Mail Stop 0655 March 30, 2018 SENT VIA E-MAIL TO: weiserw@brennan.law.nyu.edu Wendy R. Weiser Director, Democracy Program Brennan Center for Justice at NYU School of Law 120 Broadway, Suite 1750 New York, NY 10271 Re: 17-cv-06335-KBF Brennan Center v. DOJ, et al. Third Interim Release Dear Ms. Weiser: This is our third interim response to your Freedom of Information Act (FOIA) requests to the Department of Homeland Security (DHS), received on May 17, 2017, and July 26, 2017. DHS’s Production For this production DHS reviewed 429 pages of records. After review of those 429 pages, DHS has determined that 13 pages are released in full. Further, DHS determined that pursuant to FOIA exemption (b)(6), portions of 11 pages are withheld in part. Additionally, 405 pages were found to be duplicative or non-responsive, and will not be produced. As indicated in our first interim response, by letter dated January 31, 2018, we referred 40 pages to the appropriate agencies for consultation. After those offices have had an opportunity to review the records, we will either release those records to you or provide a basis for why they are being withheld. If you have any questions regarding this release, please contact Assistant U.S. Attorney Casey Lee, United States Attorney’s Office, Southern District of New York, at (212) 637-2714, or by email at Casey.Lee@usdoj.gov.
