On April 20, 2018, the DHS Privacy Office identified and referred five pages of records to U.S. Citizenship and Immigration Services (USCIS) for processing and direct response to you. After review of these records, we have determined to withhold these five pages in full pursuant to 5 U.S.C. § 552 (b)(5) of the FOIA. Exemption (b)(5) provides protection for inter-agency or intra-agency memoranda or letters, which would not be available by law to a party other than an agency in litigation with the agency. The types of documents and/or information we have withheld under this exemption consists of documents containing pre-decisional information, documents or other memoranda prepared in contemplation of litigation, and confidential communications between attorney and client.
