This is our fourth interim response to your Freedom of Information Act (FOIA) requests to the
Department of Homeland Security (DHS), received on May 17, 2017, and July 26, 2017.
As stated in previous correspondence, we referred 40 pages of responsive records to other
agencies. On May 30, 2018, with regard to records referred to USCIS, DHS provided you with a
final response indicating that USCIS was withholding 5 pages in full pursuant to FOIA
Exemption 5, 5 U.S.C. 552a(b)(5). We are still awaiting the completion of processing of the
remaining 35 pages.
Also, we would like to point you to DHS’s FOIA reading room on records pertaining to the
Presidential Advisory Commission on Election Integrity. These records are available here:

This is in response to your Freedom of Information Act (FOIA) requests received at the Department of
Homeland Security’s Privacy Office on May 17, 2017, and July 26, 2017, for records relating to the
Presidential Commission on Election Integrity. These FOIA requests were submitted to DHS’s Privacy
Office and assigned FOIA tracking numbers 2017-HQFO-01111 and 2017-HQFO-00794. These FOIA
requests are also subject of the following case, Brennan Center v. U.S. Dep’t of Justice, et al., Civil
Action No. 1:17-cv-6335 (KBF) (S.D.N.Y.).
On April 20, 2018, the DHS Privacy Office identified and referred five pages of records to U.S.
Citizenship and Immigration Services (USCIS) for processing and direct response to you. After review of
these records, we have determined to withhold these five pages in full pursuant to 5 U.S.C. § 552 (b)(5) of
the FOIA.
Exemption (b)(5) provides protection for inter-agency or intra-agency memoranda or letters, which would
not be available by law to a party other than an agency in litigation with the agency. The types of
documents and/or information we have withheld under this exemption consists of documents containing
pre-decisional information, documents or other memoranda prepared in contemplation of litigation, and
confidential communications between attorney and client.
