However, defendant has remained on bond throughout the pendency of his criminal prosecution and appeal. He has not yet served any portion of his custodial sentence. (3) On January 13, 2020, the United States Supreme Court denied defendant?s petition for a writ of certiorari. Defendant?s convictions are now final. There is no basis for defendant to continue to remain on bond. Accordingly, the Court grants the government?s application and orders that defendant surrender to the custody of the BOP by noon on or before the let day following the issuance of the mandate by the Ninth Circuit Court of Appeals.
