JAMES AFFIDAVIT FOR PROBABLE CAUSE 1. The undersigned swears and af?rm, under the penalties for perjury, that he has good cause to believe that: On or about the 22?cl day of December, 2019 at approximately 10:37 pm in the County of Allen and in the State of Indiana said Defendant did knowingly commit the crime(s) of MURDER 35-42-1-1 2. The Defendant, SENACA V. JAMES, is described as being: Male Black DOB 08-01-2003 5?7? 1501b 3. The Af?ant, Donald L. Lewis 1718, is an of?cer of the Fort Wayne Police Department. The Af?ant believes and has good cause to believe that the said Defendant committed the aforesaid offense(s). The Affiant bases his belief on the fact that on 12/22/2019 at approximately 22:37 hours victim, Dominique Taylor, was seated in the front passenger seat of a white 2014 Chevy Sonic parked outside of REDACTED. While seated in this vehicle Dominique was shot twice and was pronounced deceased after being transported to Lutheran Hospital for treatment. 4. On 12/24/2019, an autopsy was performed by Dr. Wagner, a forensic pathologist, who determined that the victim?s cause of - death was homicide by gunshot wound. 5. On 12/22/2019, there was a ?ght between multiple female subjects, Witness 1, Witness 2, Witness 3 vs Witness 4a_nd Dominique Taylor at REDACTED. Witness 4 was being asked to move out of this home and the dispute was over the return of property and ?nances. After a short physical ?ght Witness 1 and the victim, Dominique Taylor, exchanged words on social media. 6. Witness 4 advised that she then received a message to go to the Villa Capri Apartments to meet a friend. Witness 4 drove her 2014 Chevy Sonic to REDACTED located in this apartment complex with Dominque as the ?'ont seat passenger. 7. Witness 4 was interviewed multiple times in connection with this case. Initially she said that she was in the parking lot at REDACTED when two (2) males began shooting at each other. Ultimately she said that after arrival at the apartment complex, she got out of the car and entered the apartment buildings common hallway at REDACTED. Once she had entered she advised that she heard yelling looked outside and observed Witness 1 trying to open the hunt passenger door of her car where Dominique Taylor was seated. She also observed two male subjects standing by the car, one at the front bumper and I one at that driver side front door. Witness 4 advised that she saw the male standing in front of her car ?re a hand gun through her windshield and into the front passenger seat where Dominique was still seated. After the initial gunshot Witness 4 lied on foot out the back door of this building. While she was ?eeing on foot she reported hearing multiple gunshots that 1 she believed were coming from at least two separate guns due to their timing and cadence. The Fort Wayne Police Department Crime Scene technicians later located multiple 380 caliber spent shell casings on the ground outside this vehicle. ?Szarita was shown a photo array containing six (6) individuals and she identi?ed rte-participant as one of the shooters. 8. 0n 1/ 14/2020, your Af?ant interviewed co?partieipant. He was advised of his rights with his mother, Witness 5, present and both signed a waiver of his rights and agreed to give a statement. Co-participant then advised that he had been part of a face to face conversation with two males that he identi?ed as Witness 6 and Senaca James. Co-participant advised that during this conversation these subjects admitted to him that they shot Dominique Taylor because of the ?ght that had happened at the REDACTED address a few hours prior. Co participant stated the these subject admitted to him that they shot and killed Dominque because she allegedly pointed a gun at the owner of 'Witness 3. Witness 3 1s Senaca James? 5 Aunt. Co-participant added that Senaca speci?cally,stated that he wished that he would have gotten (meaning shot) Witness 4 too. i -.-, 3 9. On 1/ 14/2020 a search warrant served on Co- participant?s home at REDACTED and of?cers located two (2) 380 caliber handguns. Co-participant advised that one of these guns belonged to other one that was found hidden 1n his basement was placed there shortly after Dominque? homicide by 6,1. 1?1 10. On 01/ 14/2020 Senaca James was located and transported to theL ,Fori .Wayne Police Bepartinent for the purpose of serving a DNA search warrant. Alter arrival, his mother, Witness 7, was contacted aiid alloiwe'd to have a meaningful consultation with him. Senaca and his mother did sign a waiver of his right and agreed to give a statement. During this statement Senaca admitted that he was aware of the ?ght that took place at the REDACTED address and that he had gone to this address after the ?ght was over. Seneca admitted seeing co-participant in the evening of 12/22/2019 and stated that co?participant was in possession of three (3) handguns When Senaca learned that I had obtained a search warrant for collection of his DNA he added that he had held, touched and manipulated all three (3) guns that he alleged were in the possession of co-participantl? on 12/22/2019. He con?rmed that he believed that his DNA would be on all of these guns. I 11. On 01/14/2020, Det B. Martin and Det B. MacDonald of the Fort Wayne Police Department Spoke to Witness 8. In this face to face conversation Witness 8 advised that Senaca James had con?ded in him a few days prior that he had shot and killed . Dominque Taylor. 12. On 1/16/2020, Senaca James contacted your Af?ant by telephone directly to my desk phone line. When he initiated this contact, he was incarcerated at the Allen County Juvenile Justice Center calling me on a phone from that facility. I reminded him that I could not ask him any questions, he had the right an attorney, but I would listen if he wanted to talk to me. Senaca then apologized for lying to me in his interview. He admitted that he was there when Dominque Taylor was shot on 12/22/2019. Senaca stated that Witness 4 was lured to the Villa Capri complex under the guise of buying marijuana edibles from her so they could ?ght her. When Witness 4 arrived Dominque Taylor was with her. Senaca advised that his only geal was to get Dominque out of the car so he could take her gun. However, Dominique Taylor refused to get out of the car. Senaca admitted to having a gun in his hands and shooting this gun in the air but Dominique still would not get out of the car. He argued that the crowd started'saying ?Shoot her Bro Shoot her" and then co-participant took the gun from him and shot Dominique Taylor with it. @Mgdiw 1718 Det. Donald L.
