Sarasota County January 9, 2020 Greg and Michelle Olson 3935 Shell Road Sarasota, FL 34242 Subject: Unauthorized construction seaward of the Gulf Beach Setback Line Location: Property fronting Big Pass at 3935 Shell Road, Sarasota Parcel Number: 007 8?03-0024 Case No.: CP-20-4 The Sarasota County Coastal Setback Code (Chapter 54, Article XXII of the Sarasota County Code of Ordinances) established the Gulf Beach Setback Line (GBSL) and Barrier Island Pass Twenty- Year Hazard Line (PI-IL) to protect the coastal regions of Sarasota County from activities that jeopardize their integrity and accelerate coastal erosion. Activities such as construction, excavation, and habitat alteration are regulated by the Coastal Setback Code, since these activities can impair natural features such as beaches, dunes, and coastal vegetation, and the stabilization services they provide. The Coastal Setback Code is intended to promote public health, safety, and welfare by preventing and controlling coastal erosion and ?ooding, guaranteeing lateral pedestrian access as provided by the Public Trust Doctrine and Florida Constitution, and ensuring that coastal development is consistent with the Environment Chapter of Sarasota County?s Comprehensive Plan. On December 23, 2019, Environmental Protection Division (EPD) staff received a public complaint with photographs showing the recent installation of a post and rope fence extending along the northern preperty boundary and located on the open beach waterward of the PHL. In addition, staff observed that rocks installed shore-parallel along the fenceline have no County permit history and may likely extend seaward of the PHL. During our review of records, it was evident from historic aerial images 2012 and 2013) that the shore-parallel rock was installed by a previous owner several years ago prior to your ownership of the property in 2017. During the review of historic aerial images, it also became clear that shore-perpendicular rock/concrete has been present at this location since at least 1974 in the vicinity of both your northern and southern property boundaries. We are seeking your cooperation to resolve this matter. By January 24, 2020, please perform the following corrective measures: 1. Remove the post and rope fence. 2. Apply for an A?er?the-Fact Water and Navigation Control Authority (WNCA) permit to reposition the shore-parallel revetment landward of the or 3. Seek an After-the-Fact Coastal Setback Variance to retain any of the shore?parallel rock seaward of the PHL.
