COMES NOW Adam J Kenworthy, Assistant Story County Attorney, as
Prosecuting Attorney of Story County, State of Iowa, and in the name and by the
authority of the State of Iowa, accuses Scott Donald Griffen of the following crimes:
COUNT I
Ongoing Criminal Conduct, in that Scott Donald Griffen, on or about January 2016
through August 2018, in the County of Story and the State of Iowa, in violation of
Section(s) 706A.2(4), 706A.4, of the Iowa Criminal Code 2019, did commit two or more
indictable offenses for financial gain on a continuing basis. (Class B Felony)
COUNT II
Fraudulent Practice in the First Degree, in that Scott Donald Griffen, on or about
January 2016 through August 2018, in the County of Story and the State of Iowa, in
violation of Section(s) 714.8(10), 714.9, 423.40(5), of the Iowa Criminal Code, 2019, did
willfully makes a false or fraudulent tax deposit form or return, or willfully fails to pay at
least ninety percent of the tax or willfully fails to make, sign, or file the tax deposit form
or return, at the time required by law; the benefit involved having a value in excess of
$10,000. (Class C Felony)
COUNT III
Willful Evasion of Sales Tax, in that Scott Donald Griffen, on or about January 2016
through August 2018, in the County of Story and the State of Iowa, in violation of
Sections 423.31(4), 423.40(3), of the Iowa Criminal Code, 2019, did willfully attempt in
any manner to evade any tax imposed by this chapter or the payment of the tax or make
or cause to be made a false or fraudulent semimonthly or monthly tax deposit form or
return with intent to evade any tax imposed by subchapter II or III or the payment of the
tax. (Class D Felony)
COUNT IV
Transacting Business without a Sales Tax Permit, in that Scott Donald Griffen, on
or about January 2016 through August 2018, in the County of Story and the State of
Iowa, in violation of Sections 423.36 and 423.40(2)(a), of the Iowa Criminal Code 2019,
did knowingly engage in the furnishing of services enumerated in section 423.2, in this
state without procuring a permit to collect tax. (Serious Misdemeanor)
