The Affiant, E.MacDonald 1837F, is an officer 0fthe Fort Wayne Police Depanment. has good cause to believe that the said Defendant committed the aforesaid offense(s). The Affiant believes and The Affiant bases his/her May 24, 2019 at approximately 14:01 hours, the F011 Wayne Police Department (FWPD) responded to REDACTED in reference t0 a shooting. Upon arrival the FWPD located Korta Queary who suffered from a gunshot wound to the head and was pronounced dead at the scene. belief on the fact that 0n Friday Det. Witness 1 stated that this male was carrying black Nike high tops. During another interview Witness 1 was given a photo array and asked if she could identify the male who had exited the apartment building and was inside the green Ford Explorer. Witness l positively identified Trayvon Rogan as that subject. The Affiant spoke stated that they to Witness 2 at the scene and she identified herself as Korta’s girlfriend of over 20 years and have children together. Witness 2 stated that she was the one that found Korta and called police. come to the police station t0 give a statement. During a recorded interview Witness 2 home t0 get her work badge that she had forgotten and she noticed that her door to her apartment had been kicked in and she could see a foot print on the door. The Affiant later looked at the door t0 the apartment and there were no signs of forced entry and n0 damage that is consistent with a door being kicked in. The Affiant also obtained video from the Indiana Bureau of Motor Vehicles (BMV) located at REDACTED that showed Witness 2 coming into the branch t0 complete a vehicle registration at approximately 11:58 hours. When Witness 2 entered the BMV it showed her wearing the same clothes she was wearing when located by the police after the homicide and clearly showed her wearing her work badge that she had previously told detectives that she went home t0 get when she found Korta dead. Witness 2 then agreed to stated that she returned During that same interview with Witness 2, Det. Martin collected her clothing she was wearing the day ofthe homicide as it appeared to have blood on it. Sgt. Jason Page with the Indiana State Police conducted a bloodstain pattern analysis on the clothing and shoes. Sgt. Page advised that the stains he located 0n the pants tested positive for blood and the blood spatter stains were consistent with airborne flight ofliquid blood. Sgt. Page also indicated in his report that blood stains found on Witness 2’s shoes are consistent with being blood spatter resulting from the airborne flight of liquid blood. Sgt. Page stated that these clothes had t0 be in close proximity of Korta the gun was when fired. Witness 2 stated in an interview that no males were at the apartment until police arrived. The Affiant received a phone call from Witness 3 who stated that she had information in regards to the murder 0f Korta Queary. Witness 3 stated that she was close t0 Witness 2 and that she had come t0 the crime scene right after it happened and waited for Witness 2 to be done talking with a detective. Witness 3 stated that she then left with Witness 2 and that Witness 3, her sister, and Witness 2 drove t0 get a drink at a gas station and then went t0 REDACTED. This is consistent with the events that occurred that day as when Witness 2 was contacted by Detective Martin t0 return to the scene, she stated that she had went to the gas station to get a drink and returned to the scene with one. Witness 3 stated that while over at REDACTED, Witness 2’s son, Witness 4, was over there and talking t0 Witness 2. Witness 3 stated that she was present during the conversation and that Witness 4 told Witness 2 that they took the gun and buried it. Witness 3 stated that Witness 2 had told her that when Trayvon left the scene that he was taken to REDACTED. The Witness 3 also stated that the gun used was an “AK-47 style”.” During the autopsy there was a single shell casing located tangled in Korta’s pants which was a 7.62 x 39 round, which is used in that style 0f gun. Based 0n this information from Witness 3 the Affiant requested and was granted a warrant for REDACTED. During the service 0fthat warrant a 7.62 x 39 rifle was located buried in the back yard. This residence had been lived in by Witness 5 a family member 0f both Witness 2and Trayvon Rogan. The rifle was found with a round in the chamber and rounds in the magazine. Michelle Fletcher ofthe Indiana State Police Laboratory indicated in her report that the shell casing found on Korta’s person during the autopsy was fired from th'e rifle located at REDACTED, buried in the back yard 0f Rogan property. Van completed a detailed cellular records analysis report for the Mobile Dialing Number REDACTED which was confirmed as Trayvon Rogan’s cellphone number by Witness 2. The records show that Det. Charles 09:37 hours and 09:40 hours, two calls communicated with the tower located at REDACTED. At 14:34 hours the phone communicated with a tower located at REDACTED. This is consistent with Trayvon being at the scene at ofthe crime in the morning and shows that he had lefi after the crime occurred. was with Witness 2 right after the crime occurred and was told by Witnws 2 that it was Korta, Trayvon, Witness 2, Witness 6, and Witness 7 at the apartment when the crime occurred. Witness 3 advised that Witness 2 stated that Trayvon and Korta got into an argument and that Trayvon pulled the AK-47 up and shot Korta in the head. Witness 3 also advised that Witness 2 told her that she was right next to Korta when Witness 3 it stated that she happened which is corroborated by the blood spatter analysis. from Witness 8 who stated that her sister lives with her and has a caregiver, Witness 9. Witness 3 stated that she was there when Witness 2 facetimed Witness 9 and was screaming. Witness 8 stated that Witness 2 was saying “Face” (Trayvou Regan) shot Kona in the back .of the head. Witness 8 stated that Witness 2 went on to say that she was not going t0 let Trayvon g0 tojail over this. Witness 8 stated The Affiant received a phone that Witness 2 said that call Trayvon got into a vehicle and took offand that she was going to tell police that she found Korta dead. approximately 09:36 hours, the Affiant interviewed Witness 10 at the Allen County Jail. Witness 10 stated that he is good friends with the Rogan family and had information on Korta’s murder. Witness 10 went on to say that after the murder took place, Trayvon was dropped off at Witness 10’s On Wednesday, January 22, 2020 at mother’s house where he was at. Witness 10 stated that when Trayvon walked in he started to cry and told Witness 10 that he hadjust shot Kona. Witness 10 stated that Trayvon told him that he had used the AK-47 style long gun and that when he pulled it up at Korta he did not realize he squeezed the trigger. Witness 10 stated that when Trayvon walked in he had bleach all over his arms. Witness 10 stated that he had seen the AK-47 style gun in Trayvon’s room before and had a saved photograph from Trayvon’s Snapchat account that showed the gun 0n his phone. The Affiant then went and located the picture in Witness 10’s phone that showed an AK—47 style gun from a Snapchat handle 0f Tgr Twan. The gun shown in the Snapchat picture looks identical t0 the one located buried the rear of REDACTED, which was determined t0 be the same gun that shot the shell casing found mixed in in Korta’ s clothes at the autopsy.
