From: Murphy, Kevin Sent: Tuesday, August 21, 2018 8:27 PM To: Meier, David Subject: Fwd: meeting request David, I see that Christa is out of the of?ce. . .do you mind responding to my email below, please thank you Kevin Begin forwarded message: From: "Dr . Kevin Murphy" Subject: meeting request Date: August 18, 2018 at 1:38:06 PM PDT To: "Perkins, Christa" "Meier, David" "Ward, Laurie? Cc: "Weissburg, Daniel" "Michael J. Kinkelaar" Christa, I would ask that you cease any further contact with my research collaborators and clinical clients outside the University, until you have had the proper time to review and audit our inventory and complete an internal investigation effect of damaging my reputation and creating uncertainty with these groups, which I do not appreciate. . ..you are also asking them to be ?con?dential? which leaves them confused and creates more unnecessary drama. to face meeting with the three of us and my counsel, Mike Kinkelaar. On Monday, I was told by Christa and her group that they would be doing a ?much more thorough investigation than the Compliance dept". not sure what this means, and they were not clear. . .. But I appear to be under a full cavity search, and I would like to know why, when I?ve had the Dean?s full knowledge and support. . ..it?s incredulous to me that they are unable to locate my previous Category I paperwork, but they can ?nd researchers and collaborators cell phone numbers in Texas. I also believe the interrogating of these groups is inappropriate on several levels. Page 3 of 4 For your information Christa, I?ve copied my funding letter from my donor, denoting the money to be used as I deem appropriate (see attached). . . .Since your group likes to "dot the i?s and cross the t?s" as I was told, I would expect you to use the same standard when it comes to the University?s obligation to ful?ll the donor?s intent. . . .. At the time this donor's money was released to my index, the chief counsel for UCSD Health, Mike McDermott, and my own attorney, Mike Kinkelaar, felt we were in compliance to send machines out to other sites and researchers. After three compliance meetings, Dan Weissburg and we came to several agreements, one of was to make suite 102 a UCSD leased space (see attached lease) with all equipment being included in a separate leasehold improvement contract (see attachment). . .we even include that some of these items are offsite at two locations in Texas. . . ..I pay the lease plus an additional fee to the University of 3k a month to lease this space and everything in it.. All 19 machines with from the University, paid for out of my donor account, are accounted for inside suite 100 (UCSD Center for Neuromodulation) (12) and suite 102 (My private Mmdset clinic) (7), now leased back from the University, as a fully clinic. . .see all appendices in the lease attachment. In addition, I?ve added several machines, solely owned by me, to suite 102 in order to leave the other machines offsite. This my research and clinical contacts, then I am going to request a Dean?s meeting with all copied at the Dean?s earliest convenience. . . ..I believe you are coming into the game late here, and do not have all the facts. . ..I do not appreciate your tactics of contacting people outside the University prior to asking and completing all of the internal discovery, and I have a right to know what you are investigating.
