(Division) alleging violations of Florida's election laws. Staff of the Commission conducted an investigation to determine whether the facts alleged in the complaint constituted probable cause to believe that Respondent violated the Florida Election Code. On March 27, 2019, staff recommended to the Commission that there was probable cause to believe that the Florida Election Code was violated. On May 31, 2019, the Commission entered an Order of Probable Cause finding that there was'probable cause to c~arge Respondent with the · following violation(s): Commt 1: On or about March 7, 2018, Respondent violated Section 106.07(2)(b)l., Florida Statutes, when Respondent failed to file an addendum to the campaign's 2017 M2 report correcting the errors identified by the Division within seven days of receiving notice from the filing officer that the report was incomplete. At the informal hearing, the Commission adopted the undisputed facts set forth in the Staff's Recommendation as its findings of fact. FINDINGS OF FACT 1. On January 26, 2017, Respondent was sent a letter by the Division advising Respondent that the Division's publications and reporting forms are available on its website, and directing Respondent to print a copy of Chapter 106, Florida Statutes, the Candidate and Campaign Treasurer Handbook, and the Calendar of Reporting Dates. In the letter, the Division warned Respondent that it was his responsibility to read, understand, and follow the-requirements of Florida's election laws. 3. The following campaign treasurer reports were filed incomplete: 2017 M2, 2017 M3, and 2017 M5. 4. The Division sent Respondent three written notifications informing him that the following campaigntreasurer reports were incomplete, and that Respondent was required to amend the reports to correct the_ noted errors within seven days of receiving the notifications: 2017 M2, -2017 M3, and 2017 M5. The final notification was confirmed delivered on February 28, 2018. 5. On January 31, 2019, Respondent filed addenda to the 2017 M2 and 2017 M3 _reports correcting all the errors identified by the Division. 6. As of February A, 2019, Respondent had not filed an addendum to the 2017 MS· report correcting all the errors identified by the Division. CONCLUSIONS OF LAW 7. . The Commission has jurisdiction over the parties to and subject matter of this cause, pursuant to Section 106.26, Florida Statutes. 8. Respondent committed 3 counts of violating Section 106.07(2)(b)l., Florida .. Statutes, when he failed-to file an addendum to the following campaign treasurer reports correcting the errors identified by the Division within seven. days of receiving notice from the filing officer . . that tlJ_e reports were incomplete: 2017 M2, 2017 M3, and 2017 MS. Respondent committed the acts while knowing that, or showing reckless disregard for whether, the acts were prohibited, or failed to perform the acts while knowing that, or showing reckless disregard for whether, the acts were required. 10. In determining the amount of the civil penalty, the Commission considered the mitigating and aggravating circumstances set forth in Section 106.265, Florida Statutes. ' ORlDlER The Commission: finds that Respondent violated Section 106.07(2)(b)l.,·Florida Statutes, · on three occa~jons. Respondent is fined $500 for the first two counts relative to the 2017 M2 and 2017 M3 reports, and Respondent is fined $1,000 for the third count relative to the 2017 M5 report, for a total of $2,000. Therefore, it is ORIDJERED that Respondent shall remit a civil penalty in the amount of $2,000, inclusive of fees and costs. Based upon a thorough review of the Report of Investigation submitted on February 11, 2019, the following facts and law support this staff recommendation: 1. On August 3, 2018, the Florida Elections Commission ("Commission") received a referral from the Division of Elections ("Division") alleging Al Jacquet ("Respondent") violated Chapter 106, Florida Statutes. 2. Respondent was a 2018 candidate for re-election to the office of State Representative, District 88. An Appointment· of Campaign Treasurer and Designation of Campaign Depository for Candidates form ("DS-DE 9") appointing Respondent as his own treasurer was filed with the Division on January 25, 2017. (ROI Exhibit 1) 1 3. By letter dated December 18, 2018, the Executive Director notified Respondent that Commission staff would investigate the following statutory provision: Section 106.07(2)(b)l., Florida Statutes: Respondent, a 2018 candidate for State Representative, District 88, acting as his own treasurer, failed to timely make necessary amendments to the following campaign treasurer reports, as alleged in the complaint: 2017 M2, 2017M3, and 2017 M5. 4. By letter dated January 26, 2017, Kristi Reid Bronson, Division of Elections, Chief, Bureau of Election Records, notified Respondent that his DS-DE 9 was filed with the Division on January 25, 201 ?- The letter also contained a security envelope containing Respondent's confidential PIN number to access the Division's electronic filing system. (ROI Exhibit 2) 5. Ms. Bronson's January 26, 2017, letter also informed Respondent that all of the Division's publications and reporting forms were available on the Division's website, including Chapters 104 and 106, Florida Statutes, the Candidate and Campaign Treasurer Handbook, ~d The Report of Investigation shall be referred to herein as "ROI." The letter notified Respondent that it was his responsibility to read, understand, and follow the requirements of Florida's election laws. (Id) 6. On January 25, 2017, Respondent filed a Statement of Candidate with the Division in which he acknowledged that he had been provided access to read and understand the requirements of Chapter 106, Florida Statutes. (ROI Exhibit 7) 7. In an affidavit dated February 1, 2019, Respondent attested that he possessed a copy of and had read Chapter 106, Florida Statutes, and the Candidate and Campaign Treasurer Handbook. Respondent asserted, "I have taken time to Review Ch. 106 FL Stat ... I have also read and re-read our Candidate and Campaign Treasurer Handbook." (ROI Exhibit 5) 8. On January 12, 2018, and February 7, 2018, the Division sent Respondent a letter notifying him that the following campaign treasurer reports were incomplete, and that Respondent had seven days to correct the errors or provide the missing information noted in the attached error reports: 2017 M2, 2017 M3, and 2017 M5. The letter dated January 12, 2018, also stated that if the information was reported accurately, Respondent should provide a written explanation to the Division addressing the issues noted in the error report attached to the notification letter. (ROI Exhibit 3) 9. On February 23, 2018, the Division sent Respondent a letter marked Final Notice notifying Respondent that the following campaign treasurer reports were incomplete, and that Respondent had seven days to correct the errors or provide the missing information noted in the attached error report: 2017 M2, 2017 M3, and 2017 M5. The letter also stated that if the information was reported accurately, Respondent should provide a written explanation to the Division addressing the issues noted in the error report attached to the notification letter. The February 23, 2018, letter was confirmed delivered on February 28, 2018. (Attachment A) .10. The Division confirmed via email dated February 4, 2019, that the 2017 M2 and 2017 M3 reports were corrected on January 31, 2019, but the 2017 M5 report was still not correct. (ROI Exhibit 6) 11. In an affidavit dated February 1, 2019, Respondent attested that the three reports at issue were not timely amended due to, "Absolute miscommunication on my part. I received a letter in Feb. 2018, after briefly believing the letter indicated an "Error" in my Report. [illegible] admitted, I reviewed the reports and noticed No Errors showing. I erroneously dismissed the letters that followed (on the same subject) as Not Accurate. I Finally see to what the letters were pointing and Have Resolved it." Respondent added that, "This will not happen again, as I will call immediately upon receiving ANY communication from our Div. of Elections." (ROI Exhibit 5) 12. Section 106.07(2)(b)l., Flori~a Statutes, requires that, within seven days of receipt of notification from the filing officer that a report is incomplete and requires amendment, a treasurer must file an addendum to the report providing all information necessary to complete the report. 13. Based upon the information above, it appears that Respondent failed to file amended reports for the following campaign treasurer reports correcting all the errors identified Staff Recommendation FEC 18-196 '2 by the Division within seven days of receiving notice from the filing officer that the reports were incomplete: 2017 M2, 2017 M3, and 2017 MS. 14. "Probable Cause" is defined as a reasonable grounds of suspicion supported by circumstances sufficiently strong to warrant a cautious person in the belief that the person has committed the offense charged. Schmitt v. State, 590 So.2d 404,409 (Fla. 1991). Probable cause exists where the facts and circumstances, of which an [investigator] has reasonably trustworthy information, are sufficient in themselves for a reasonable man to reach the conclusion that an offense has been committed. Department of Highway Safety and Motor Vehicles v. Favino, 667 So.2d 305, 309 (Fla. 1st DCA 1995). 15. · The above facts show that Respondent was a 2018 candidate for the office of State Representative, District 88, and was acting as his own treasurer. The following campaign treasurer reports were filed incomplete: 2017 M2, 2017 M3, and 2017 MS. The Division sent letters to Respondent on January 12, 2018, February 7, 2018, and February 23, 2018, notifying him that the reports were incomplete, and that Respondent had seven days from receipt of the letters to correct the errors noted in the attached error reports and file amended reports'. 16. The facts further show that Respondent acknowledged receipt of at least one letter in February 2018, and the delivery confirmation showed that the Final Notice was delivered on February 28, 2018. The Division confirmed that Respondent did not correctly amend the 2017 M2 and 2017 M3 reports until January 31, 2019, which is approximately 11 months after receipt of notice from the filing officer that the reports were incomplete and required amendment; Further, the Division confirmed that as of February 4, 2019, the 2017 MS report had not been satisfactorily amended. Respondent's articulated reason for failing to timely amend the reports does not justify that failure. Jacquet, now a state House representative, received the ticket April 5, 2016, around 3:45 p.m., according to documents. His black Volkswagen Jetta was parked in an expired metered spot in the 1000 block of East Atlantic Avenue, just east of the bridge. Volunteer Maj. Martin Tencer told the Ethics Commission Jacquet called him and said he forgot to display his commissioner parking pass - which does not exist - while he attended to "official business" and wanted his parking ticket voided. Parking Enforcement Specialist Michael Wasserman, who issued the ticket, said Jacquet asked, "Do you know who I am?" Read: EXCLUSIVE: Winning candidates helped voters fill out their ballots Jacquet told The Palm Beach Post late Thursday afternoon he could not comment on those alleged quotes, and will have to review what the allegations are. "Today was just a preliminary hearing," Jacquet said. "No facts were presented. Not one scintilla of evidence was presented. We don't believe any of that is true from what's being alleged. It's not fair for me to make any statements about things that are about to go to a hearing where I think it will be very clear at that time." However, according to documents, the State Attorney's Office already decided against pursuing a case. Mack Bernard, now a county commissioner, from 2009 to 2012, was elected to the Delray City· Commission in 2012, and re-elected in 2014. The state representative has had parking tickets voided before, according to the documents. Tickets issued Sept. 27, 2015, and Nov. 2, 2012, were voided. He partially paid for a June 18, 2012, ticket, and fully paid for one issued Jan. 28, 2014. It is not clear why the tickets were voided. This latest voided ticket was brought to the Ethics Commission by an ancmymous caller. Tencer referredJacquet's request to void the ticket to supervisor Lt. David Weatherspoon, who said it was OK to void the ticket. Tencer later found out the "parking pass" didn't exist. He said he asked for an email documenting the approval to void the ticket, but Weatherspoon said a verbal approval is sufficient. Jacquet went to the police department with his ticket and gave it to Barbara Brennen at the front window with his name and phone number on the back. He told her to give it to Tencer. to have it voided, documents say. The ticket was voided and the fee waived. Palm Beach Post stories published in March revealed that Commissioner Bernard and Jacquet, both Democrats, won their seats after entering homes and helping people fill out vote-by-mail ballots. Although their behavior drew condemnation from experts who believe it's an improper campaign tactic, Florida's laws did not make it illegal. The Post's investigation revealed that Flo.rida's lax election laws allowed Bernard and Jacquet to score heavy vote-by-mail turnout to help them win their Aug. 30 primary races. The Post found signatures on vote-by-mail ballots that didn't match ones on file, but the votes still counted. One voter said Bernard filled out his ballot. Others said they received ballots in the mail but didn't remember requesting them. Voters agreed that city commissioners should have the ability to appoint an auditor to review city business. They also approved a request to repeal the city's civil service code, which deals with how employees are promoted, transferred and laid off.
