I will certainly reach out to the faculty to make sure they know that your transition is voluntary. was already planning on highlighting you and your accomplishments in the upcoming faculty newsletter. This move to a MSP contract has been recommended by both you and Andy Ries, in an effort to reduce any potential con?icts in interest or commitment with my outside businesses, PeakLogic and Mindset. We started this process last Fall, and the contract was then put on hold by Dan Weissburg. Since the start of the ?Inquisition? by the now former Compliance Director, Dan Weissburg, in October of 2017, $840,000 has been consumed from my research gift fund. I?m spending (wasting) 40,000/month of donor?s funding on leases and salary while this audit process originally directed the 10M gift funding to the University in 2015, and we still have not honored the donor?s intent of performing clinical research. I have a fully outfitted 6000/sq./ft research center with of equipment, sitting vacant, until the audit is complete. Over a two year period, I have literally hundreds of emails from the UCSD Health System ?now former? Chief Counsel, Mike McDermott, from his UCSD email/signature line, Page 1 of 3 outlining his knowledge and direct involvement in creating, naming, ?ling, and setting up my current private practice, contracting vendor relationships, leases, intellectual property, etC. Would you like to see any of these emails, so you can fully understand the degree of time, effort, content and advice I received from the Health Systems highest legal representative? As a UCSD employee faculty member, was I not supposed to follow his advice and direction? have a similar train of emails and events over a period of 18 months with Dan Weissburg, where heagain set up and codi?ed my University relationship in an effort to remove all compliance was told I had a clean bill of health, per Dan Weissburg, and University leases were approved and signed. Thus, a second, high?ranking UCSD of?cial had given me direction and guidance on how to conduct an outside business while still remaining in compliance with University policies. I was told these were the right people to work with. Dean Brenner 84 The UCSD Foundation were also involved. - On December 17, 2018, you were on the phone call with Dan Weissburg where he threatened my employment, and repeatedly questioned me on whether or not I was a UCSD whistleblower? Is that okay for a Compliance of?cer to in addition, as you know, I?ve had my last 3 clinical productivity bonuses withheld, with nojusti?cation.' Can someone point me to the University policy where withholding clinical productivity bonuses is authorized while a research audit is As you suggested last year, one of the potential issues at hand is the need to reduce any con?ict of interest or commitment I might have in conducting clinical trials using a software that developed outside the University. There are certainly mechanisms to solve this problem, which i am happy to explore, but i am going to need assistance from someone at the University to remove the existing roadblocks and actually communicate a strategy. Are you willing to help with this, It?s a shame that being successful in raising research dollars, has led to this. The University should be ashamed in having treated a faculty member this way. As i mentioned - yesterday, I would give the 10M back to the donor ifl had known it would have led to a never?ending audit, and my reputation being damaged by being under constant ?investigation?. Al, in addition, It would be a decent gesture on your part, to send an email to the faculty describing this move as voluntary, since there is now a rumor amongst our colleagues that I am being forced out of my University position. Again, it?s not true, and I don?t deserve this characterization. i am more than happy to supply you with a list of accomplishments and facts that outline my contributions over the last 16 years, including, recruiting you in 2005.
