City-officials have noted her attendance at after-hours events including the State of the County, San Bernardino Chamber of Commerce meeting, and various community meetings. As such, I asked Renee Brizuela, Executive Assistant to the Mayor (U) about Mima?s duties- Typically, the Executive Assistant to the Mayor (U) would oversee lower level of?ce support staff, thereby triggered me to initially reach out to Renee. I have copied all of your staff as I am unsure of the reporting structure in your of?ce. As the Director of Human Resources, concerns related to employees' duties and responsibilities and whether duties are within the scope of their position or not would have to be looked into as I have the obligation to prevent grievances or potential liabilities. Federal and state laws guide the employment relationship. Ms. Cisneros' job duties must be compliant within the classi?cation of the Senior Customer Service Representative (U) and follow the Fair Labor Standards Act (FLSA) standards. Attendance at meetings and events is not within the scope of duties and responsibilities nor appropriate for the Senior Customer Service Representative (U) classi?cation. Assigning her to these duties also violates the FLSA. To resolve the matter, please assign meetings and event duties to the following classi?cations in your office as these classi?cations' duties and responsibilities allow for attending events after business hours: 1. Mayor?s Chief of Staff 2. Executive Assistant to the Mayor 3. Assistant to the Mayor If or 4. Legislative Field Representative (U) Please let me know if you have any questions.
