The suspect was reportedly last seen driving a black SUV lic# northbound the I-5 freeway at the 91 freeway interchange. I drove northbound Beach to the I-5 freeway in the city of Buena Park. I was about to make a u?turn after passing the 1?5 freeway when I observed a Buena Park patrol officer detaining S-Noriega next to the gas pumps at the Chevron Gas located on the corner of Beach/ Auto Center Drive. I pulled into the north side of the gas station and saw a black GMC Yukon lic# parked on the north side of the gas station. Buena Park officers cleared the vehicle for occupants and advised me the person they were detaining was related to my call. I spoke to Buena Park Officer P. Montez. He advised me their dispatch received a 9-1-1 call from S-Noriega stating undercover police units were shooting at him. He stated he contacted S?Noriega at the pumps of the gas station and detained him (See Officer Montez report BP for further 11-43830). Special Agent from the US Department of Homeland Security responded to my location and was one of the agents who had been pursuing S?Noriega. At that same time, Agent Wiessner was able to accelerate out of his aisle, tum east and then south into the aisle occupied by the Yukon and vehicle. saw that Agent Wiessner had activated his forward?facing emergency lighting and was stopping off of the Yukon?s ?'ont left bumper at a 4S-degree angle. Upon seeing this, stopped his own vehicle and started getting out. As was focused on his own door and opening it, he heard a single gunshot come from in front of him. looked up and saw Agent Wiessner seated in his vehicle's driver's seat with his gun drawn and pointing at the Yukon. The last radio transmission heard was that the Yukon may have gotten onto the northbound I-5. and other agents traveled north on the 1-5, but were unable to locate the Yukon. After a few minutes, they learned that the Yukon and its driver were being detained at a Chevron gas station located at Auto Center Drive and Beach Blvd. in Buena Park. and the other agents went to the Chevron to regroup. told me that when the male and child got into the Yukon, he was unable to make a positive identi?cation on the male, so he was not certain if it actually was said he broadcast this information on the radio to the other agents. When the surveillance team followed the Yukon had just gotten off of the I-5 freeway at Euclid and was able to join the surveillance. followed the Yukon and the other agents on Crescent and then saw the Yukon turn south into the east parking lot of the Anaheim Plaza. followed the Yukon to the south end of the east parking lot and watched as a child got out of the Yukon. Once the child was out of the Yukon, someone made a decision to stop the Yukon and arrest the male subject they believed to be Alcala. As this decision was made, the Yukon traveled north through the east parking lot back toward Crescent. was going to follow the Yukon, but noticed that Wiessner were already with it so he decided to trail behind. traveled north in the parking aisle east of the one occupied by the Yukon and said he was forced to drive slowly due to heavy pedestrian traffic in the lot. Because of the pedestrian traffic and his knowledge that the other agents were in better position to follow the Yukon, was more worried about hitting someone than he was with following the Yukon. When refocused his attention on the Yukon, he noticed it was speeding away northbound and other agents were attempting to follow it. accelerated through the lot and followed the Yukon west through the lot along the south side of Crescent until the Yukon turned south along the west side of the plaza businesses and through the lot. I obtained identifying information from the subject, and he verbally identi?ed himself as Daniel Noriega. He also had a California driver?s license, and a date of birth of 4/29/83. He provided a cell phone number of . I asked him where he lives, and he stated he was currently living at in the city of Anaheim. I did not ask him any further questions. Of?cer Poffenberger transported him back to the Anaheim Police Department. Officer Poffenberger also told me that Buena Park PD Of?cer P. Montez had made contact with Noriega ?rst. Of?cer Montez told Officer Poffenberger that Noriega had told them that an Anaheim police of?cer was shooting at him. He said he was out there for approximately an hour and a half when he ?nally had some activity. He said a female and a child came out of the apartment and left. He said about 20 to 30 minutes after that, another female and another child also exited the apartment and left. said a few minutes after that, a male subject, whom they believed was possibly the fugitive, stepped out to smoke a cigarette. He said he went in and out of the apartment a couple times and eventually a small boy wearing a blue-and-white shirt and carrying a Spiderman backpack exited the apartment. stated he saw the male subject but he was not 100 percent sure that that was the fugitive they were looking for. He said the height and build were approximate to the fugitive that they were looking for. stated the child went down the stairs and went to the front of the apartment. He stated the male adult went to the back of the apartment. I asked where he was positioned, and he said he was on the ?rst street north of the apartment complex. He said he could see the apartment complex and the ?oat of the apartment in question. said that he lost sight of both the child and the adult. stated another agent called out the child, who had gone to a black Yukon that was parked on the ?rst north south street just west of the residence in question. stated another agent eventually called out that the male and the child had entered the Yukon and were now leaving the area. said the vehicle stated he did not leave his location and he decided to remain there in case this was not the subject and he would maintain surveillance of the residence until the subject was apprehended. did not follow the vehicle, nor did he have any contact with any of the agents during the remainder of this investigation. The ?rst academy was approximately eleven (11) weeks long and was a live- in academy. There, he learned criminal investigations, vehicle stops, personal contacts, vehicle pursuits, ?rearm training and control/apprehension techniques. The second portion of the academy was an eleven to twelve (12) week academy. WIESSNER said he had never been to this location, prior to today. WIESSNER said each agent had their own department issued under cover vehicles. His was a 2006 gold Chevrolet Impala. WIES SNER said his vehicle is equipped with a police radio, a siren and red and blue emergency lights. He said briefed them on the details regarding and provided a photograph of . After the brief they responded to the area of to begin the surveillance where he remained in the outer perimeter. During the course of the surveillance he heard via his police radio one of the agents advised that the suspect had walked out of his residence with a small male child and was head to his vehicle. WIESSNER picked up the suspect in the black SUV and followed it away from the area. WIESSNER said he was being assisted with the mobile surveillance by several members from his team. WIESSNER said the black SUV was occupied by who he believed to be and the child. Both subjects in the black SUV were later identi?ed as Daniel NORIEGA, For the purpose of this report, the child will be known as John DOE. WIESSNER followed the black SUV away from its location and subsequently followed it He saw the black SUV enter a driveway on the north side of a strip mall, off Crescent located toward the rear of the mall. This shopping area is known as the Anaheim Plaza. The black SUV continued south through the parking lot, paralleling Loara Street. WIESSNER continued eastbound Crescent, to southbound Loara Street, keeping a visual on the black SUV. As the black SUV continued south through the parking lot at a normal rate of speed, WIESSNER drove into the parking lot from the most northeasterly driveway off Loara Street into the rear parking lot of the Anaheim Plaza. WIESSNER continued watching the black SUV and saw when the black SUV reached the south portion of the parking lot. He heard via the radio one of the agents con?rm that DOE had exited the SUV. The black SUV then continued driving southbound, made a right turn along the parking stalls, and then cut across the marked parking stalls and continued north in the same parking lot he had entered (east parking lot). WIESSNER drove southbound as the black SUV was driving northbound and momentarily they crossed paths. He immediately recognized the driver as and noti?ed his team via the police radio that was the lone occupant of the black SUV they had followed into parking lot. In fear that the suspect was going to ram his SUV into him and the fact he wasn't wearing his seat belt, he "instinctively" ?red once through the windshield, at the suspect. WIESSNER said he shot at the suspect in hopes to keep him from ramming his vehicle into him, which would have caused him severe injury or even death. WIESSNER said he didn't shoot again because NORIEGA was out of his line of ?re. WIESSNER believed he had shot NORIEGA. A?er shooting at the suspect, the suspect "maneuvered" his vehicle away from him then sped away in the SUV northbound through the parking lot and out of sight. WIESSNER decided not to pursue the black SUV and to wait at the location for law enforcement contact. He immediately got on his cell phone and called his dispatch center, advising them that he had been involved in a shooting which agents were in pursuit of the suspect and requested that Anaheim Police Department respond to the scene. He recalled driving by and could see asking if he was alright. He recalled giving the "thumbs up" and mouthing, "go get him.? left in pursuit of the suspect. Agent WIESSNER said he was not sure if he used his police radio to notify the other agents on his team to advise them of the shooting and or that the suspect attempted to ram him with his vehicle. He said they were having problems with their regular radio channel so instead they used their ?tactical channel." He didn't know if their tactical channel radio transmissions are recorded. He said he was in shock and "the blast surprised me. How loud it was." WIESSNER believed that had he not shot at the suspect, the suspect would have rammed his vehicle into his, causing him bodily injury and/or death. Agent WIESSNER believed that his life was in danger and said he reacted in self-preservation and believed the driver of the black SUV was suspect Agent WIESSNER was unable to recall what type of grip he had when he shot at the suspect. He could not recall drawing his duty weapon from his holster located on his right waist/hip area. He believed he opened the driver's door to exit, but is not sure if he made it out. He believed he sat down and shot at the suspect. WIESSNER said he had range training the day before the shooting and shot his gun at the shooting range. He recalled not cleaning his duty weapon, but recalled putting a magazine in the gun well before going back to work. WIESSNER couldn't explain why the magazine in the ?rearm he used to shoot at NORIEGA was loaded with only three bullets. He said he has numerous loaded magazines throughout his duty vehicle and on his person. He perhaps took a magazine that was not fully loaded. During the interview with WIESSNER we provided him with two aerial photographs that were taken by our our Forensics personnel, via our Aero Bureau Unit just after the shooting. The maps were marked "Map 1" and Map WIESSNER used the maps and marked them with a blue ink pen to describe the approximate location and the events to the best of his recollection. WIESSNER is positive that NORIEGA saw his emergency lights activated. WIESSNER was unable to recall the other agents positions in the parking lot or if someone was directly behind the black SUV. He carries his duty weapon with twelve in the magazine and one in the chamber. I asked him about the angled placement of his vehicle he put on the map. His purpose was not to block the black SUV, he wanted to "crank" the front wheel to the left in case something happened. He believed he put his car in park by using the gear shift located in the steering column. The interview with Agent WIESSNER ended and he left the station without incident. During the course of this investigation, WIESSNER agreed allowed me to down load the information from his cell phone by signing the search consent form. See attached. At approxirnately 0845 hours, I heard that an of?cer-involved shooting had occurred in the area of Loara Street and Crescent Street in the city of Anaheim, county of Orange, California. Based on the above, members from my unit responded to the location to handle the investigation. Once at the location, we learned that US. Homeland Security ICE Agents had been on surveillance at in the City of Anaheim. We learned the suspect was followed away from his residence and into the rear (east) parking lot of the Anaheim Plaza, where the shooting occurred. Further investigation revealed that after the shooting, the suspect ?ed the location in a black SUV type vehicle and was subsequently contacted by the Buena Park Police Department. NORIEGA said he did not know why he was being shot at and thought he was being mistaken for err-boyfriend Hearing the gunshot, he "freaked out" and fearful that he was going to be killed if he stayed, he drove to his left to avoid the oncoming traffic ?'om his right side, and drove away northbound away from the police of?cer. I contacted the Anaheim Police Department Air Support Detail and requested that they take aerial photographs of the crime scene. Officer Cowhey took photographs and I downloaded the pictures into DIMS at APD. The photographs were scanned into the report. There were 4 cars within the crime scene. Special Agent Justin Wiessner's vehicle, a gold Chevy Impala (plate was inside of a parking stall facing eastbound. The front driver's side door was open and there was a single bullet hole through the front window of the vehicle. Forensic Specialist M. Sveinson processed the vehicle. Page 85 of 89] ANAHEIM POLICE DEPARTMENT GENERAL OCCURRENCE HARDCOPY SUBPOENA 2011-]79969 CLOSED - PROSECUTOR 245-0 FIREARMICIVIL REFUSAL Follow Up Report 27 Details: [At the above date and time I responded the east side parking lot at the above location where a Federal Immigration agent discharged his weapon while driving his vehicle towards a possible suspect. The location is a parking lot Loara Street and Rubios restaurant. The agent was reportedly traveling south in the lane closest to Loara and the suspect was driving north. The agent's weapon was discharged through his windshield. A search of the area for a bullet strike was performed with nothing found. The suspect then fled the area and the agent parked his car in the isle closest to Rubios. Photographs were taken of the scene and agent's vehicle showing locations and conditions. The agent vehicle is a gold Impala Ca. lic. . the vehicle had a hole in the windshield consistent to a projectile having perforated it. A .40 cal. spent cartridge case was lying on the driver's floor. The bullet strike was measured to be approx. 10 above the dash, 10 inches below the roof line, 23 from the back end of the hood and 17" in from the driver's side pillar. I measured the front of the driver seat to the brake pedal which was a distance of 18" and the headrest to the top of the steering wheel was 33". I received the agent's weapon from Det. Masilon. The weapon is a Sig Sauer model P229, ser.# there was one live cartridge in the chamber and one in the magazine. The cartridges had a head stamp of FEDERAL 40 The collected items were brought to the station, photographed and booked as evidence.
