Ms. Sarah Ledbetter is a bartender at the Corner Pub and served Of?cer Mueller two vodka and tonic doubles. Ms. Ledbetter did not see Of?cer Mueller consume those alcoholic beverages. Once Ms. Ledbetter was made aware of the incident and she determined Of?cer Mueller?s identity, she tented her manager with the inforrnationthat an off duty police of?cer, named Andrew Mueller, displayed his ?rearm in a holster and badge to a female patron in the bar. - Angie Schuler, Bar Manager According to the Montgomery Police report, Ms. Schuler contacted a retired police of?cer from Montgomery Police Department, Greg Schill. Mr. Schill informed Ms. Schuler he was no longer employed with the Montgomery Police Department. Mr. Schill directed Ms. Schuler to speak with Sergeant Davenport of the Montgomery Police Department. On June 26, 2019, after consulting with Hamilton County Prosecutor, Mr. Richard Gibson, the Montgomery Police Department decided not to pursue criminal charges on Of?cer Mueller. On June 27, 2019, Sergeant Davenport sent Captain Thompson a copy of the completed and closed investigation. Of?cer Mueller indicated that he did purchase and consume: two vo a and tonic doubles while at the Corner Pub. According to Of?cer Mueller, during a casual conversation, Ms; Morgan showed him a pepper ball gun in a holster which resembled a real ?rearm. He proceeded to offer her some advice, safety tips, and possible negatives with the pepper ball gun. She asked him if he was an undercover cop. He then proceeded to stand up and show her his UC badge and UC issued ?rearm by lifting up his shirt. He stated he used poor judgment but the reason for showing her his badge and ?rearm was to validate the previous advice he had given her. Of?cer Rob Doherty, on patrol and attentive to his radio, arrived quickly on scene and lost no time deploying and applying AED assistance, and switching out resuscitation with Officer Long. PO Alan Van Pelt arrived and joined his fellow officers in both chest compressions and resuscitation. These officers, and their unwavering assistance and teamwork saved a man?s life. In addition to providing the facilities and logistics necesszuy to conduct the games and cheer showcase, one of the primary goals of the event was to provide a safe and welcoming environment for UCPD police officers, community members and youth to have positive interactions getting to know the best of one another. Within the past two years, police community relations, both nationally and particularly locally, have been strained to the point that deliberate efforts are necessary to restore trust between the police and the communities that they serve. During the course of the three day event, two of?cers distinguished themselves by being positive influences interacting with youth and adult participants. Officer Andrew Mueller and Of?cer Carra Sparks showed great initiative making deliberate intentional efforts to extend themselves in positive conversations and activities. Mr. Mueller told me that he received two warnings from the Xavier University Police Department. The first occurred in 2013, and was for being a half?hour late and having the odor of alcohol on his breath. He explained that he was not scheduled to work that day, but was unexpectedly called to come in. Because of the short notice, he had dif?culty making it on time, and although he had consumed alcohol earlier that day, he was no longer under the in?uence. The other warning occurred in August of last year, and was the result of being in a building unauthorized during his duty hours. He denied having any other disciplinary actions against him in the workplace, and said that he has not received an unsatisfactory performance review. Mr. Mueller told me that he has never been named in a complaint by an individual or group, and that there have been no formal or informal allegations of sexual harassment or hostile work environment made against him. Offense History: Mr. Mueller told me that he has not had a traf?c citation within the past three years, and that he has never been charged with or convicted of a criminal offense. He stated that he has not been in any physical altercations outside the line of duty, and has not engaged in the theft of anything of value. He told me that he has never had a restraining order filed against him. Financial Background: Mr. Mueller said that he has not had credit problems due to spending more than. he could afford, and that he has not vnitten bad checks. He stated that he has never had a credit account turned over to a collection agency, and has not had a purchase repossessed. Substance Use: Mr. Mueller told me that he drinks alcohol one to two times per week, and that his typical consumption ranges from three to five beers. Mr. Mueller told me that he ensures that there is at least a twelve hour time span between drinking alcohol and beginning his police duties. On the occasion when he was given a warning by the Xavier University Police Department, the span of time was four hours, but he was unexpectedly called in early. He denied having any alcohol related offenses. Mr. Mueller stated that he has not used alcohol to cope with stress or assist with sleeping. He indicated that he has never called in sick to work due to a hangover, and has not gone to work in this condition. He said that four years ago, he was stopped by an officer and required to take a field sobriety test, but passed it. Mr. Mueller stated that he smoked marijuana approximately 15 times, and that the last occurrence was in 2011. He assured me that this was the extent of his involvement with illegal drugs. Mental Health: Mr. Mueller stated that he has never been under treatment, and has not been prescribed medication for depression, anxiety or other emotional problems. He experienced a critical incident as a park ranger, and was required to attend one debrie?ng session with a He asserted that he has never been in treatment for a problem with drugs or alcohol. He denied ever attempting suicide. Mr. Mueller said that the most upsetting event in his life was the death of his uncle earlier this year. He assured me that there is nothing troubling him signi?cantly at the present time. He said that he has not felt significantly depressed for extended periods of time. He told me that he has not experienced anxiety, fear or panic that he had dif?culty controlling, and that he does not suffer from any phobias. OBSERVATEONS: . . Mr. Mueller was in an upbeat mood and rapport was easily established. He presented a professional appearance, wearing a dress shirt and tie. Mr. Mueller typically gave thorough answers and thought his responses through carefully. He came across as sincere and straightforward. Mr. Mueller maintained his poise well and took a serious attitude toward the evaluation. There were no indications of significant depression, excessive anxiety or a high level of distress. INTERVIEW FOR JOB RELATED KNOWLEDGE, SKILLS AND ABEITIES: Mr. Mueller said that he was attracted to police work because it offers the opportunity to be helpful to others, and he described himself as a, ?service oriented? person. He said that the least appealing aspects of police work are that the dangers and the stress that comes from dealing with violence. When we talked about use of force, Mr. Mueller said that there are different levels of force appropriate for different situations, and that an of?cer must be accurate determining level that is necessary, striving not to use excessive force. He told me that he responds to disrespect?il citizens by communicating and that he has strong communication skills. He added that disrespect is a citizen?s prerogative, and he focuses on handling this situation as required and using ?verbal judo.? He said that he would take supervisory criticism and learn from it, using it as a tool for improvement. He told me that he copes with stress by spending time with family and friends, and confides in those whom he trusts. Mr. Mueller demonstrated the ability to use discretion appropriately when dealing with minor traffic violations. He was aware of the criteria to be considered, and tended to be understanding and realistic in his assessments.
