Because the case was not presented to our office as a formal request for prosecution, it was not logged into our file management system which would provide the exact date we received it. To be clear, the Prosecutor?s Office did not investigate the case. Our office has no criminal investigators on staff. We rely on our local police agencies to conduct investigations. We did not, and will not, express a hypothetical Opinion as to whether a prosecution would be undertaken if the suspect were surviving. And did your review of the case look at the possibility that any other UM employee (current, past, now deceased) might have somehow been involved criminally in any sort of-coverup? We did not reach that question. The general period of limitation for criminal prosecution in Michigan is six years from the date of the offense. There are a very few offenses that are subject to a period of limitation that extends beyond 6 years. There was no information in the report that implicated any offense with a limitation period of more than six years. Therefore, it was concluded that if there were other offenses the ability to prosecute them.would have been extinguished many years ago. Will your office reopen the case if any alleged victim presents new information? We will review any investigative report submitted to us by a police agency. And, finally, is it accurate that your office began reviewing the case in April 2019 and concluded this week? Late April or May is about right for when the case was sent to this office by UMPD. Anderson Dear Ms. Koslowski, This Washtenaw County Prosecuting Attorney?s Of?ce received a report of an investigation conducted by the University of Michigan Police Department containing allegations of criminal wrongdoing by Robert E. Anderson, MD. Although a formal request for criminal prosecution did not accompany the report, the supervisor of the office's charging function reviewed the report to determine if the possibility of criminal prosecution existed based upon the facts it detailed. Because Dr. Anderson is deceased, no criminal prosecution of him would be possible regardless of whether the facts set for the report supported such an action. Furthermore, the ability to prosecute any ancillary offenses that may have been committed by others would have been extinguished by the statute of limitations decades ago. Therefore, this office?s review of the report has concluded.
