The information submitted to the Wisconsin Economic Development Corporation (WEDC) in this amended application (and supplements the application dated September 15, 2017 ?led by Foxconn with the WEDC) is true and correct. The applicants are in compliance with laws, regulations, ordinances and orders applicable to it that could have an adverse material impact on the project. Adverse material impact includes lawsuits, criminal or civil actions, bankruptcy proceedings, regulatory action by a governmental entity or inadequate capital to complete the project. The applicants are not in default under the terms and conditions of any grant or loan agreements, leases or financing arrangements with their other creditors that could have an adverse material impact on the project. WEDC is authorized to obtain background checks including a credit check on the applicants and any individua1(s) with 20% or more ownership interest in the applicant companies. The applicants have disclosed, and will continue to disclose, any occurrence or event that could have an adverse material impact on the project. The applicants agree, to the best of their ability, to projected employment of 13,000 jobs of hourly and salaried personnel of Wisconsin payroll between 2018 and the end of 2022, however the employee headcount is subject to obtaining timely pre-construction permits and approvals of the fabrication facility, an orderly construction time table, and an orderly, ramp up of staf?ng levels as determined by business needs. The applicants agree, to the best of their ability, to projected capital investment of $10.0 billion for the construction of the fabrication facility and related projects in Wisconsin between 2013 and end of 2022, however, these investments are subject to obtaining timely pre-construction permits and approvals of the fabrication facility, an orderly construction timetable, an orderly ramp up of staffing levels as determined by business needs, and other conditions which may affect the business. As noted, the applicants have identified that the funding source is subject to change and may come from more than one investor and likewise the entity to which tax credits may be applied or paid is subject to change and may involve more than one entity. THE APPLICANTS UNDERSTAND: 1. This application and other materials submitted to WEDC may constitute public records subject to disclosure under Wisconsin's Public Records Law, ?19.31 et seq. The applicants may mark documents "confidential" if the documents contain sensitive information. 2. Submitting false or misleading information in connection with an application may result in the applicant being found ineligible for ?nancial assistance under the funding program, and the applicant or its representative may be subject to civil and/or criminal prosecution. 3. WEDC may access information the applicants have submitted to the Wisconsin Departments of Revenue and Workforce Development and use such information in assessing each applicant's performance under any eventual agreement.
