That upon arrival, troopers established that one judicial marshal, later identified as Officer Martin Brown (DOB: 03/05/1959), suffered from severe head injuries and was transported in critical condition to Hartford Hospital by ASM ambulance. The remaining victim on?scene, also a judicial marshal, was. identified as Sgt. Michael West (DOB: 09/11/1963). West suffered from minor injuries to his face, left arm, left side, and right leg. He was subsequently transported to Hartford Hospital via ASM ambulance. It was observed that both Officer Brown and Sgt. West were in official uniform and were clearly recognizable as judicial marshals. The male first went into courtroom and then went over to the clerk's office. b) Sgt. West eventually escorted this Hispanic male to the Probation -office. Shortly after, the male walked out of the Probation office and asked Officer Diaz if he could go out and smoke. Officer Diaz heard Sgt. West say that the male could not leave and asked Officer Hollis to keep an on him. c) The Hispanic male then fled out of the building through the emergency doors and Sgt. West chased him. Officer Brown then had just come inside the building and Officer Diaz told him that Sgt. West was chasing the fleeing male. Officer Brown then turned around and ran out of the building. d) Officer Diaz could see Sgt. West running towards a white vehicle. This vehicle then drove forward_and ultimately struck Officer Brown, causing him to strike his head on the ground. Sgt. Michael West, one of the two victims in this incident, provided a statement to Trooper Haynes. In his statement, Sgt. West provided the following pertinent information: a) Sgt. West observed a Hispanic male walk out a courtroom and he was informed by Officer Hollis that the male needed to go to probation. Sgt. West stated that the Hispanic male was wearing a black sweater, a white shirt, and jeans. He was clean shaven and had dark hair. b) After leading the male to probation intake, Officer Hollis informed Sgt. West that he had an active Violation of Probation warrant. Sgt. West recalled the face sheet that was disseminated that morning and that the individual was Jose Lopez (DOB: 07/13/1977). G) Sgt. West went back to Lopez and told him that he sent him to the wrong office. He redirected him to another probation office. Sgt. West also confirmed Lopez's name and date of birth. d) At some point, Lopez walked out of the probation office and tried to leave the building. Sgt. West was able to catch up to Lepez as he got into the operator's seat of the car, a small white sedan, and told him that ?it was only VOP, don't make it worse.? Concurrently, he saw Officer Brown exit the front door and run towards him. g) Sgt. West stated that Lopez then suddenly accelerated, striking him with the side view mirror, which caused him fall to the ground. As he got up, Sgt. West saw Officer Brown laying on the ground and the vehicle continued to flee from the parking lot. h) Sgt. West immediately began to assess and treat Officer Brown. He noticed a significant amount of blood pouring from his right ear. Sgt. West stabilized Officer Brown's head and spine and requested additional services to the scene. 7. That Officer Corey Hollis, a judicial marshal, provided the following pertinent information to Detective Attmore: a} While assigned to courtroom B, Officer Hollis observed a Hispanic male with dark colored hair walk in and speak to the judge. The judge told the male that he needed to go to Probation. b} Officer Hollis was later posted at the metal detector station and he saw that same Hispanic male. Concurrently to this, Sgt. West informed Officer Hollis that the Hispanic male could not leave the building. c} A short time later, Officer Hollis heard the door alarm.for the emergency exit by the clerk's office. He then saw Sgt. West run towards this door. Concurrently, Officer Brown ran out through the main entrance. d) Officer Hollis looked out through the front door and witnessed ?a white possibly Toyota or Yaris sedan? pulling out a parking spot in the center aisle of the main parking lot. He observed that vehicle pull forward and drive around Sgt. West, possibly clipping him. He then observed the vehicle accelerate towards the front of the building and strike Officer Brown with its front driver side bumper. He observed Officer Brown fall backwards and strike his head on the pavement. The white vehicle then fled the scene. 8. From this view of Lopez, your Affiant is able to clearly recognize the resemblance to the DMV photo previously viewed. c)03/02/2020 at 11:30:55 From a camera capturing a rotating view of the parking lot, a small white sedan (which matches the description of the white Toyota Yaris) is seen fleeing the parking lot. Behind the vehicle, two individuals can be observed on the ground. One individual appears to be attempting to stand up, while the other is seen motionless on the ground. It should be noted that this camera was in a constant panning mode and the only recorded footage is that which the lens is facing at the time. Therefore, the exact moments when Lopez is running to/entering his vehicle or when the vehicle strikes Sgt. West and Officer Brown are not captured. The camera pans to the scene of the incident immediately after Officer Brown is struck. That the following initial information was develOped by troopers on?scene through both judicial marshals and civilian witnesses: a) The suspect driver was seen fleeing in a white, four door sedan with a spoiler. The vehicle was described as a Toyota with a possible partial plate of b) The suspect operator had been previously identified by judicial marshals as Jose A. Lopez (DOB: 07/13/1977), based on them being notified by Adult Probation that Lopez had an active arrest warrant for Violation of Probation. While on?scene, a face sheet with Lopez's information was disseminated by judicial marshals to both state troopers and Manchester PD officers. This face sheet was previously posted to the judicial marshals that same morning at roll call due to the fact that Lopez was wanted by Probation. That upon receiving information as to the identity of the suspect, TEC James Nolting #1022, assigned as the Troop desk trooper, ran Lopez's information in various law enforcement databases to obtain DMV and DOC records. It was learned that Lopez's Connecticut driver's license was suspended. It was also determined through DOC records that Lopez's mother possibly resided in (This is page 4 of a 3? page Af?davit.) That Springfield PD was requested to follow?up at the obtained address for information related to Jose Lopez. Springfield PD yielded negative results at that address. However, Springfield PD ran an in?house records check and determined that their agency had a record of Lopez as a passenger in a traffic stop of a white Toyota Yaris bearing Massachusetts registration 8YTF90. The Toyota Yaris was registered to the driver during that traffic stop, Nichole Carattini (DOB: 04/01/1985) of Wilbraham, MA. This historical vehicle information fit closely in both physical description and registration, as previously described, to make the initial determination that Lopez was likely driving this vehicle when he fled the courthouse and struck Marshal Brown and Marshal West. That collaborative investigative efforts between numerous surrounding law enforcement agencies yielded the following additional results and information: a) Holyoke (MA) PD provided a historical phone number for Nichole Carattini, the registered owner of the Toyota Yaris, as well as a possible employer. b) Wilbraham (MA) PD officers checked the address associated with Carattini's registration: 5 Benton Street, Wilbraham, MA, with negative results. That on 03/02/2020, at approximately 1557 hours, Carattini contacted Wilbraham PD after learning that the police were making attempts to locate her. Carattini subsequently drove to the police department in her Toyota Yaris, the suspect vehicle in this case. The details surrounding the return of that vehicle to her were detailed in a sworn statement, which she provided to Det. Attmore and Det. Soares, who met her at Wilbraham PD. The relevant information is as follows: a) Carattini has been dating Jose Lopez for approximately one year. b) Earlier in the morning on 03/02/2020, Lopez called Carratini and asked to use her Toyota Yaris to drive to Connecticut and resolve a driver's license issue. c) Carratini picked up Lopez they drove to the Jolie Academy for Hair, where she goes to school. Carratini went to school and Lopez took the vehicle, with the understanding that it had to be returned by 3:30pm. d} Around 2:35pm, she noticed a missed call from her employer. She stated that this was not abnormal for Lopez to do. f) Carratini eventually called Wilbraham PD and they inform her about a hit and run accident in Connecticut. She noticed that the driver's side of her vehicle had some black scuffs on it. Carratini then drove to the police department and subsequently gave consent for Massachusetts State Police and the Connecticut State Police to search and seize her vehicle. That the Toyota Yaris was secured inside a storage building at the Wilbraham Police Department for evidentiary purposes and anticipated inclement weather conditions. That on 03/02/2020, investigators confirmed Jose A. Lopez's (DOB: 07/13/1977} CT Violation of Probation arrest warrants were extradictable. That on 03/03/2020 at approximately 0545 hours, investigators confirmed that members of the Massachusetts State Police located and took custody of Jose A. Lopez (DOB: 07/13/1977) in Chicopee, MA. Lopez was charged in the Commonwealth of Massachusetts as a fugitive from justice and was transported by MSP for processing. That on 03/03/2020, Affiant Grabowski and Detective Attmore arrived at The Massachusetts State Police Office located within the Hampden County District Attorney's Office at 1500 Main Street, Springfield, MA and conducted an interview with Lopez. Prior to beginning the interview, Lopez was advised of his Miranda rights and provided a written waiver to them. The interview was conducted in a private room with audio and video recording. Lopez provided a sworn, written statement, which included the following pertinent information: a. Lopez borrowed his girlfriend Nichole's white Toyota Yaris on the morning of 03/02/2020 and told her that he needed to go to court. Lopez recalled that the offense he had to go to go court for was either a Larceny 5?1 or 6H1 charge from an incident at the Home Depot in Manchester. b. Lopez arrived at Manchester (CT) Superior Court and entered a courtroom to see a judge. He stated that the judge instructed him to go the clerk's office and the probation office. c. He convinced himself that this was not the right thing to do, but that he did not want to be arrested and have to deal with more people like him. e. Lopez saw an emergency exit about 30 feet to his left and he knew exactly where his car was parked in the lot. He stood up and fled the courthouse through that door and ran straight to his car. f. Lopez stated that, once he was inside the car (the white Toyota Yaris) in the driver's seat, a marshal had run up to his driver's side and was trying to convince him not to make anything worse for himself. g. Lopez stated that he began to back out of the parking spot and that marshal remained at his driver's side, while he believed three other marshals were standing in front of his car. He recalled that one marshal appeared to move out of the way but two others remained. h. Lopez stated they looked like they were not going to move, so he inched the car forward to show them that he was not playing around. When they still did not move, he said that he immediately accelerated and drove through the parking towards Center Street. Lopez stated that he did not look back. 18. That during the course of the interview, Lopez provided the Affiant with a hand drawing of his perception of the parking lot, where his vehicle was parked, and how he fled the lot. 19. That based upon the aforementioned information contained herein, the undersigned affiant believes probable cause does exist for the arrest of Jose A. Lopez (DOB: 07/13/1977) for the charges of: 53a~59 Assault 1?
