FINDINGS OF FACT Based on the stipulation of the parties and its own review of the record in this case, the Court makes the following Findings of Fact pursuant to CR 54(b): l. The Court has entered the following ?dispositive orders? in this case: 1) Order on Cross-Motions for Summary Judgment (dated February 12, 2020); 2) Order on Motions for Reconsideration Regarding Article 1, Section 12 Issues (dated March 12, 2020); and 3) Order Denying Plaintiffs? Motion for Reconsideration (dated March 12, 2020). 2. With the exception of Plaintiff City of Burien, these dispositive orders resolve all issues between all parties related to Plaintiffs? constitutional challenge to Initiative 976 976?). 3. The only issue not fully resolved by these dispositive orders is the article 1, section 23 claim raised by the City of Burien for impairment of the City of Burien?s specific bond contracts. The Court has reserved ?nal judgment on this claim only in order to allow further discovery pursuant to CR 56(f). 4. There is no direct relationship between the reserved City of Burien claim and the constitutional claims that this court has resolved in the dispositive orders. Appellate review of the issues addressed in the dispositive orders will not be impacted, in any way, by this Court?s STIPULATION, FINDINGS OF FACT AND ORDER CERTIFYING IMMEDIATE APPEAL UNDER CR AND STAYING CASE 2 ultimate disposition of the City of Burien claim. As such, there is no possibility that further proceedings in the trial court will moot any issues raised on appeal, nor will an immediate appeal of the dispositive orders delay further trial court proceedings on the City of Burien claim. On the other hand, the result of the appeal may moot the City of Burien claim. 6. In light of the above, there is no just reason for delaying entry of judgment regarding to the issues resolved in the dispositive orders. 7. The parties further agree that it would serve the interests of justice to stay any additional proceedings regarding disposition of the City of Burien claim pending appeal of the other claims in this case.
