Upon arrival contact was made with Jim Vinzant, who is a "Rigger" with Local #31 of the Teamsters, who stated he is responsible for the "rigging" of the cables for shows at Kansas City, Missouri, owned facilities. He stated that they are under contract with the city. He stated that on 5?23?1999, during the day hours, that he and James Williams were on the "catwalk" assembling the rigging for the World Wrestling Federation show. He stated that Bobby Tolbert and the victim were also present when the rigging was assembled. He stated that he and James Williams assembled the "span sets and bridals" in the ceiling, however had no affiliation with the actual harness that the victim was wearing. He stated that the harness was a product of the World Wrestling Federation. - He stated that during the actual show Bobby Tolbert hooked up the victim and that he (Jim Vinzant) shined the flashlight on the victim so Bobby Tolbert could hook up the victim. He stated that Bobby Tolbert "almost lifted Owen up checking to make sure it was secure" while the victim, Bobby Tolbert, James Williams, and himself were on the catwalk. He stated that the victim put his mask and cape?pn. He stated that the victim had difficulty climbing over the railing. He stated that he (Jim Vinzant) raised the victims cape up so the victim could step over the railing. He stated that the victim was continually adjusting the rubber band that was holding his cape around his hand. He stated that the rope that was to be used to lower the victim to the floor was laid out alongthe catwalk. He stated that he was watching the rope to make sure it did not snag on the catwalk. He stated that he looked away from the victim, then looked back at the victim as he was falling and "spirally clockwise". He stated that the victim fell "back first". He stated that he saw the victim land on someone in the wrestling ring, then he hit the deck inside of the ring. Jim Vinzant stated that he did not think that the victim seemed very experienced with the stunt and that he (Jim Vinzant) would not have had the victim perform the stunt with the harness system that was used because it has minimal safety. He stated that he left the Arena at 1500 hours, and returned at 1700 hours. He stated that he was aware that the stunt was initially tested with sandbags, and then by Matt Allmen, who assisted Bobby Tolbert. He stated that he was unaware if the victim had practiced the stunt. Upon arrival contact was made with James Williams, who is a "Rigger" with Local #31 of the Teamsters. He stated that he is responsible for assembling the "riggings" associated with shows on property owned by the City of Kansas City, Missouri. James Williams stated that he and Jim Vizant were working "Fire Patrol" on the catwalk, which meant he was watching for problems associated with the victims act. He stated that the victim and Bobby'Tolbert walked up to the catwalk and the victim was in coveralls. He stated that the victim took the overalls off and Bobby Tolbert put the harness on the victim. He stated that this occurred 10 minutes before the victim fell from the catwalk. He stated that the victim was hooked up with a "Lanyard" system which allowed a safety mechanism for the victim to pull to release the rope connections. He stated that the victim walked out from the catwalk onto a crossover bar and Bobby Tolbert had the victim kneel over to check the tension. He stated that the victim fell and he saw the victims shoulder strike a strut with his shoulder. Hestated that the catwalk was close to the victim when he fell. He stated that when this occurred Bobby Tolbert was controlling the rope the victim was attached to. James Williams stated that there was a quick release on the harness system. He stated that Bobby Tolbert "triple checked" the connections on the harness. He stated that the harness system that was used was more designed for art than for safety. He stated that the quick release is more of a stunt item then a safety item. James Williams stated that he did not know why the connections did not work, but that he believed the victim hit the strut or catwalk, or that there was a mechanical failure. On 5?24?1 999 at 0130 hours the reporting Detective contacted Bruce Hart, brother of the victim, regarding notifying him of his brothers death. Information was received from Sgt. McEntee of the Detention Unit that Bruce Hart wanted to talk with a Detective regarding the above incident. Bruce Hart gave the reporting Detective the personal information of the victim. He also stated that the victims parents are Stew and Helen Hart, of Calgary Canada, at 403-249-2143. Bruce Hart stated that he had received information, from Vince McMahan of the World Wrestling Federation, that the victim had died and that Vince McMahan had designed the harness system that the victim was using. Upon arrival contact was made with Matt Allmen, who stated that he is a contract "rigger" with the World Wrestling Federation. He stated that on 5-20-1999 Bobby Tolbert contacted him and asked him to come to Kansas City to help him assemble the "riggings" associated with the show. He stated that his position was to be on the floor of the arena when the victim came down the rope, and to take the harness off the victim. Matt Allmen stated that during the day hours he and Bobby Tolbert worked on the harness system the victim was to use. He stated that they first tried the system with sand bags, then he- personally tried the system. He stated that later on the victim tried one practice run with the system. Matt Allmen stated that the victim took a bag to the catwalk with him. He stated that he was standing outside the perimeter wall around the ring and he noticed something coming from the ceiling, however he did not think that the item was the victim. He stated that he saw the victim hit the ropes, around the ring, and land on his back on the floor. He stated that he then thought that he saw the victim move his arms and legs. Matt Allmen stated that the system they used was called a rack, where a series of bars restricted the movement of the rope as the victim descended to the floor. He stated that the end of the rope is marked with tape to show the end of the rope for the person who holds the end of the rope and controls the decent. He stated that the system had a quick release (snap shackle). He stated that the quick release was designed to have a 6,000 lb. breaking strength and a 2,200 lb. working load. He stated that breaking strength is the maximum strength of the release and the working load is the amount the release should hold with repeated use. Matt Allmen stated the victim had done similar stunts in the past and the stunt had been done by other wrestlers in the past. He stated he was presently on the phone with a party who was at the wrestling match at Kemper Arena on 5/23/99. A party who identified himself as Eric Araujo was subsequently interviewed. lVlr. Araujo stated at the time of Mr. Hart?s fall, he was in a conversation with one of his friends and observed an object falling from the ceiling to the ground. He stated he first thought the object that he observed falling was a speaker, however when he looked closer, he observed it to be the body of a man. He stated he did not see where in the rafters the man fell from, because he did not observe him until he descended about half the distance to the floor. He stated after Observing the man fall, he looked to the rafters above the area where the man had landed and observed a white male running along the rafters. He stated he watched this party descend from the rafters and run through the crowd to the lobby area. He stated about 30 to 45 minutes later, he Observed a party walking in the rafters. He stated this party walked over to the area, in which he saw the white male run from and pick up a black bag and carry it away. He described this party as being a white male, in his mid to late 20?s, tall, 150 to 170 lbs, with shoulder length black hair, wearing a short sleeve black shirt and dark pants. He stated he could not say for certainty, but he thought there was a 70% possibility that the first white male he saw rdnning along the rafters and the party he observed carry away the black bag were one in the same. Eric Dillenkoffer responded to the Jackson County Medical Examiner? 5 Office regarding the above captioned case. Upon arrival the victim was observed laying supine on a metal gurney on top of a white plastic shroud. The victim was observed to be nude and was observed to be a white male with blonde hair. Lividity appeared to present on the back of the neck and along the back, buttocks, and the back of the calves. A small laceration and contusion was observed on the left outside bicep area and the upper arm was observed to be disfigured and appeared to be broken. A large laceration was observed on the left lower arm below the elbow. The reporting detective also observed the rigging apparatus which consisted of the harness, black ropes, and cable. The reporting detective also observed the victims clothing which consisted of a blue costume and blue and white leather type boots. During the interview the reporting detective along with Detective David Ptomey of the Legal Advisor?s Office responded to the Legal Advisor?s Office (fifth floor). Upon entering the Legal Adviser?s Office the reporting detective observed three brown paper bags. All three paper bags were observed to be marked with the listed CRN number and sealed with orange evidence tape. The three paper bags were then hand carried by the reporting detective and Det. Ptomey back to the sixth floor board room. The three paper bags were then opened individually by the reporting detective. The following items were observed as opened by the reporting detective: Bag #2 of 4, item #4 contained an "Amspec" harness vest. Bag #3 of 4, item #5 contained the repelling rig with miscellaneous snap shackles, screw pin shackles, rescue rack, "Liftall" span?set line and black repelling rope. Talbert was asked to describe how the SNAP SHACKLE release cord was set up on the victim?s harness. He stated once after the victim put on the harness and the SNAP SHACKLE was attached, the release cord was stretched from where it attached on the backside of the harness to the front side of the harness. He stated there was a small amount of slack in the cord, but he could not specify how much slack. He stated the cord was then taped near the ring to the harness, away from the victim?s neck towards the outside of the victim's shoulder, but it still ran over the main part of the shoulder. 7, Talbert was asked when they were testing the system if the victim?s harness was used with his crew member and he stated He stated a different harness was used, which he described as a basic safety harness that consisted of straps. He stated the repelling line with the SNAP SHACKLE was attached as well as there was an additional attachment to the harnesses webbing. He stated during the testing of the system with the victim earlier in the day, the victim wore the same harness that was used during his fall. During this telephone interview Talbert stated hejust recently discovered the blue coveralls in his equipment bag that the victim was wearing 'this night to cover his costume. He stated the victim wore the coveralls up to the location where the stunt was to be performed to conceal his costume and then removed the coveralls upon reaching the stunt location. She stated she was at the wrestling match on Sunday evening when the victim fell. She stated she and her son were sitting in section #221, row J, seat 7 and 8. She stated there was a white female sitting in seat 5 in the same section that was using binoculars the entire evening and was watching the activity on the catwalk. She stated she did not know who this female was, but described her as a white female, brown curly hair, 140 pounds, between 20 to 30 years old, and mentioned something about working in an emergency room and was in the company of a young white male who she believes was her son. Kennedy stated after the victim fell to the mat this white female stated "he did not fall accidently, someone pushed him". Kennedy stated this female stated this twice, but does not know if she was directing the comments to her, or was just talking in general. She stated during the evening prior to the Victim falling this female was talking about the people up on the catwalk and she believes that she knew the victim was up there and described the costume he was wearing. The reporting detective advised Mr. Riss that camera crews from the World Wrestling Federation had filmed the victim immediately after the fall and a portion of the medical treatment in which the victim received. Mr. Riss was further advised that the incident was taped on a "Beta" brand tape and it was requested that the tape be reproduced on a brand tape. Mr. Riss advised the reporting detective that he had the equipment to reproduce the tape on a brand tape. One copy of the tape was then reproduced on a brand tape and taken into possession by the reporting detective, along with the "Beta" brand tape. Chad Harbert was reported to be the coordinator of the University Of Missouri?Kansas City Basketball teams Mascots. During interview it was revealedthat Chad Harbert had previously been employed by U.M.K.C. to coordinate events with mascots. He stated that the events were developed and Ed Grom, the Athletic Director, coordinated with the local Union of Riggers, who are under contract with the city of Kansas City Missouri. He stated that the specific mascot that would be used would then be referred to the local Riggers for the Riggers and mascot to coordinate the event. He stated that one mascot that he recalled Using was the Denver Nuggets mascot "Rocky". Chad Harbert stated that "Rocky" was used on February the 6th, 1999, and that was the only time during the 1998 and 1999 basketball season the event was performed. He stated that the event was performed approximately 6 times a year during the 1996/1997 basketball season and 6 times during the 1997/1998 basketball season I Chad Harbert stated that the maS-?c-bt would be lowered from the ceiling of Municipal Auditorium, which is where all the events were conducted. On 6-15?1999, at 1420 hours the reporting detective contacted Sonny Sheer by telephone, a representative for AMSPEC INC., which is reportedly the company where most of the items used for the stunt involving this case were purchased. Sheer was reluctant at first to talk with the reporting detective since he could not verify my identity. Sheer was told of the nature of the telephone call was to obtain documents-and information regarding the items purchased regarding this case. Sheer stated that he wanted to verify my identity first and consult with his attorney before making any statements or releasing any documents. He stated the three stuntmen did not wish to become involved in this case and referred me to contact the SCREEN ACTORS GUILD, who has many qualified specialists in the field of stunt work and rigging, who may be able to assist in further examinations and opinions. The stuntmen did tell Gerbino that riggers have different techniques in setting up stunts and there are no set guidelines or regulations they must follow, which means the set up can be left up to each individual riggers preference on the equipment and how the stunt is performed. He stated the safety aspect is normally foremost in the rigger's mind and most times there are some type of fail safe or secondary line. On 6?44 999, at hours the reporting detective paged Bobby Talbert and within a few minutes he called the reporting detective back. This was to interview Talbert further regarding his first contacts with representatives of WWF and what he was hired to do as a contract employee for the WWF . Talbert stated he was originally contacted by Steve Taylor, who is the Vice?President of Event Operations for the WWF. He stated that his partner/associate for the WCW, Barry Brazell apparently was contacted by Steve Taylor and Taylor was referred to him (Talbert). Talbert stated he was given Taylor?s telephone number and asked to contact him and upon doing so a meeting was set up in Orlando, Florida to discuss him working for WWF and setting up some different stunts. He stated this meeting was held in Orlando during the time the WWF was in Orlando putting on a wrestling show, which was about one (1) month before the victim?s death. He stated when he met with Taylor they discussed the type of stunts that the WWF was interested in having performed, which were "drop-ins" from the ceilings and "pull?outs" where a person is raised from the floor area to the ceiling. Taylor had told him their company had other stunt people that performed these stunts in the past, but they were not good enough for the camera shots because they performed the stunts too slow. He and Taylor discussed the type of stunts the WWF was interested in having performed and Talbert told him that he had performed the same stunts with the wrestler, STING from the WCW. Talbert told Taylor that he would prepare a menu of stunts and fees and submit him a bid for the stunts. He stated the week of the event in Kansas City he was contacted by Steve Taylor by telephone and told that the WWF wanted to set up the stunts in Kansas City. Talbert stated originally the stunt was to be that a midget MAX-MINI would be attached to the victim, however, they later decided against performing that stunt and were only going to lower the victim into the ring. Talbert stated that he had done a similar stunt for the WCW, where two (2) wrestlers were attached together and lowered into the ring. Talbert stated he is the person that decides on what equipment is needed to perform the stunts. He stated all of the equipment was brand new and was purchased from AMSPEC except for the repelling rope, which was also new, but came off of a six hundred foot roll of rope. Supervisor. Talbert was asked if he received any instructions on how the stunts were to be set up or performed. He stated usually as in this case the people from the WWF told him what they were wanting done, such as the victim to be lowered from the rafters into the ring and he decides what equipment is to be used and how it is to be set up. Talbert was asked once he arrived in Kansas City, who from the WWF was his contact person and if any additional requests or instructions were given to him regarding the stunts. He stated that Steve Taylor was the only contact person he had from the WWF and no additional requests were made. Talbert stated they were to conduct a rehearsal with the victim at 2 o?clock the day of the performance and the victim did not show up until about 3:30. He stated the victim did not think that he needed to do the rehearsal and both he and Steve Taylor told the victim that he was going to do the rehearsal. He stated the victim told them that he had done this stunt before and did not think that he needed to rehearse it. Talbert then told the victim that he had not worked with him before and wanted him to do the rehearsal. Talbert at that time asked the victim if he had ever used a QUICK RELEASE and the victim told him He stated once they performed the stunt there were no problems, but once the victim reached the floor he forgot to pull the release cord to disconnect the rope from his harness and was walking around with the rope still attached to him. At the conclusion of the first rehearsal he asked the victim if he wanted to do a second rehearsal and the victim told him that he was comfortable with doing the stunt. Talbert was asked if the victim at anytime teld him that he was afraid of doing the stunt, or that he did not want to do it or was being forced in someway to perform the stunt and he stated No". Talbert stated on 5?23?1999, he began setting up the equipment for the repelling stunt the victim was to use during this evenings show. He stated all of the equipment used for this stunt besides the nylon repelling rope was brand new and after the set up was completed he tested the repelling equipment by use of a 250 pound sand bag. He stated there were no problems during this testing and then the equipment was then tested with one of his assistant riggers, Matt Allomen, who had no problems with the repelling equipment when he was lowered. Talbert stated later in the afternoon about 3:30 P.M., the Victim arrived at the arena and they completed a test run of the equipment with the victim being lowered down to the ring mat with no problems incurred. Talbert did state on the first trial run with the victim that once he landed on the ring mat he forgot to pull the release cord to disengage the repelling line from his harness. He stated that the victim also had some difficulty adjusting his cape during the first testing by trying to keep it out of the way of his arms. Talbert stated later that evening between 7:10 PM and 7:15 P.M., he and the victim went to the repelling site on the catwalk scaffolding-'iabove the center of the arena. Once they arrived the victim was placed into the repelling harness and he (Talbert) attached the SNAP SHACKLE to the metal ring on the back side of the harness and discussed the manner in which the stunt was to be preformed. Talbert stated once the equipment was attached he pulled on the SNAP SHACKLE 2 or 3 times to ensure that the device was properly secured to the harness. Next he put the victim?s bright blue colored cape on'him and the victim attached the sides of the cape to his hands by use of string. Talbert then moved the release cord ring from the SNAP SHACKLE to the front side of the victim and allowed him to choose the location on the harness where the cord would be attached. Talbert stated he then lifted up the victim?s cape from the back side to ensure that it was not or would not later interfere with the harness or repelling equipment and also that it did not tighten up the String around his neck that was holding the cape in place. Talbert stated he heard the music cue, which meant they were getting close to the time when the stunt was to be preformed and told the victim it was time for him move around to the outside of the scaffolding. He stated once the victim stepped over the railing he was facing away from him, but once he was completely over the railing he turned around and was now facing him. He stated the ViCtim then put his weight into the harness and he lowered him just a short distance to make sure there was proper tension on the equipment. He stated this brought the victim?s position to where his head was about in line with his (Talbert?s) knees and they prepared for the decent. He stated as the victim was lowered this short distance the victim removed his hand-s from the scaffolding railing and drew them back in an apparent attempt to grab the repelling harness. He stated at the same time he saw the victim move his arms outward as if he was trying to adjust his cape, at which time he heard the distinct sound that the SNAP SHACKLE makes when'it is released and saw the victim begin to free fall towards the ring mat. Talbert stated he believes that the victim must have accidentally activated the release cord that was attached to the harness, which disengaged the SNAP SHACKLE from the harness. He stated he saw the victim impact into the southwest corner of the ring mat and believes part of his body may have also struck the ring ropes. He stated he immediately ran down to ring side to check on the victim and see if he could help in anyway and there were alread?y?medical personnel and police officers doing CPR on the victim. Talbert stated only other people on the catwalk scaffolding at the time this incident occurred were two (2) city employee riggers. Talbert stated this was the first time he had worked with the victim, but the victim had told him that he had done this particular stunt-several times before. Talbert stated he has done this same stunt several times before with another wrestler?from the WOW by the name of Sting. Rob Rickett responded to 1800 Gennesse, Kemper Area regarding a dead body. Upon arrival Sgt. Jacobs was contacted and stated that he was working off?duty at Kemper Area regarding the World Wrestling Federation event. He stated that the victim was to be lowered by rope from a catwalk above the ring and apparently fell impacting into the ring. I observed Kemper Arena to be a large enclosed arena with stadium seating on all sides and a raised wrestling ring near the center of the arena. There were numerous rows of blue colored chairs positioned on the floor level around all sides of the center ring. I observed the ring to be raised off the ground about three (3) feet and had ring ropes circling the entire area of the ring. When the ring was inspected there two (2) stained areas of the mat that tested positive for blood and samples were taken. In an adjacent area to these stains was a larger stain that did not test positive for blood. This was explained as fake blood used in the wrestling performances. Nothing else of evidentiary? value was noted. I was then directed to the upper area of the arena where the fall occurred,? which was only accessible by the ceiling catwalk scaffolding that led to an area near the center of the ceiling by the scoreboard. Once at this location I observed the rigging for the repelling stunt ran north to south and was above and south of where the scoreboard was positioned and was secured to the metal ceiling trusses, which ran east to west. A sliver colored SMC RESCUE RACK device, which controls a repellers decent was observed secured to the rigging by a large metal carabineer. The RESCUE RACK was observed to have black nylon repelling rope running through four (4) of the six (6) adjustable racks. Observed attached to the black nylon repelling rope was a locking carabineer that was also wrapped with black tape and connected to a SNAP SHACKLE device. This device was observed to be in the open position. This device was reportedly attached to the victim's harness vest on the back side, near the to?p?to a metal ring. The SNAP SHACKLE also has a release cord attached to it that is about 24 ?inches long and has a metal ring at the end which is wrapped in black tape that is used to open the SNAP SHACKLE once a person reaches the ground after a decent to free the rope. Attached to the release cord near the metal ring was a piece of black tape apparently used to" secure the cord to the harness vest. The remaining nylon repelling rope was observed stretchedbut on the length of the catwalk scaffolding. The main part of the repelling equipment was observed to be on the north side of the equipment attached to the tgses. There were no obvious signs of any damage to any of the equipment used in this stunt and all items used in the repelling were recovered. The victim was transported to Truman Medical Center where he was later pronounced dead. At the time this incident occurred the arena was reportedly at a sold out capacity, which is about 18,000. The distance from the bottom of the catwalk scaffolding to the top of the wrestling mat was about 78 feet. The cape and mask the victim was reportedly wearing during the time this stunt was occurring were not located. The reporting detective viewed a video tape?provided by the WWF of the wrestling mat area after the victim had fallen. When viewing this tape it showed that someone who was possible a referee picked up both the cape and mask, but it is unknown what he did with these items. I C.S.T. JOHNSON and C.S.T. Dewier was briefed on the background Of the people involved in this stunt and the facts surrounding how the stunt was intended to be performed. Dewier examined the photographs Of the scene and the equipment, as well as the actual equipment used, which was brought for this meeting. Dewier stated the rigging equipment that was secured tO the ceiling trusses of the arena appeared to be more than adequate to support this stunt and that it had a secondary backup cable, which was good, but appeared the arrangement was ?sloppy.? He stated the nylon rope and the rescue rack that were used were standard repelling equipment and would be adequate for this stunt. He stated the AMSPEC jerk vest used is primarily designed tO be used for diagonal jerks or drag stunts. He stated he has seen this vest used before in falls and lowering stunts, however, he has found that the vest used in this manner puts the main amount Of the body weight and force on the torso and chest area of the person wearing the vest and that it is uncomfortable. He stated this vest could be used for this type of stunt, but would not be his personal choice. He stated he has seen in the past where this type of harness was used and when the person was suspended or free hanging for a period Of time, the force to the chest area began to affect the persons breathing, to the point of blacking out. He stated that a fall or repelling harness would have been his choice, which supports a persons weight very well and would allow the person to stay suspended for a longer period Of time without any complications, since the weight and force are directed to the seat area of the harness. Dewier stated that in his personal opinion the use Of the jerk vest was a poor choice and that a different harness would have been more suitable for this stunt. Supervisor: irate] File Page wmjexm Form 107 CONTINUATION CASE #99~055430 DATE July 7, 1999 PAGE 2 Dewier stated he has seen the SNAP SHACKLE used in stunts before and referred to the device as a He stated that he was aware of this device being used in the stunt industry and that it was sold by AMSPEC, which is a supplier of stunt equipment. He stated he would not have used this device as the sole means of suspending a person more than 10 to 12 feet off the ground, but has used it and seen it used for lowering, or fall releases at short distances. He stated there is another PELICAN RELEASE that is activated by a ?squib load,? which is a small explosive charge used to activate the release. He stated he has seen that device used in the short falls and is controlled and activated generally by the person in charge of the stunt. Dewier stated the use of the SNAP device was a poor choice for this specific stunt, due to there being no back up devices and the height involved in this stunt. He stated his first choice for this stunt would have been to ?Hard Wire? the person being lowered to the equipment, with for instance a locking carabineer attached to the harness. He stated that the person could be disengaged from the rope just as quick by someone already down on the ground, which he believes would have been the safest way and would have provided the same" effect. He stated when dealing with actors involving stunts, he does not allow the actors to do anything or have any control over the stunt, because they are not focusing on the stunt and in doing it correctly, they are worrying about their acting. He stated one of the main ?weak links? involving any stunt is the person or actor performing the stunt if all of the proper equipment is used, so he tries to not allow them any control. He stated there was no back up for the way this stunt was set up and in? hisi?opinion it could have been designed better, with the use of different equipment. He stated that thisdoes not necessarily mean that the rigger was wrong in the set up, since riggers use the equipment they believe is best for the job, but was a poor choice in this instance. He stated that not everyone who rigs equipment for stunts will use the exact same equipment or set the items up in a similar manner. It is basii'tially left up to each individual riggers preference and what the person is accustomed to or familiar With rising. He stated if he had to allow the actor or'person involved in the stunt to activate the release, he would have used a release. He ?Stated-this device is similar to the releases used in parachutes and the cord that must be pulled can be adjusted so it would take an obvious and distinct long movement to activate the device and it could not be acc?id??htally tripped. The THREE RING release also would have a better shock value for the amount of force and pressure that it can withstand. File Page Form CONTINUATION CASE #99?055430 DATE July 7, 1999 PAGE 3 Dewier stated if he had no other choice and had to use the SNAP SHACKLE, he would have ?backed up the device, by doubling them up,? meaning he would have used two different shackles at two different ?pick points? or anchor points on the harness, with one release line on the left and one on the right. He stated that he would have also looped the release cord to ensure there was more than enough slack, to try and reduce the event of an accidental trip. Dewier came to the conclusion after reviewing the items that safety did appear to be an issue when the rigger was setting up this stunt, shown by the taping of items after they had been checked to ensure they were locked into place. The use of a plastic tie on the pin that secured the ring on the back side of the jerk vest was another example of safety on the rigging. He stated in his opinion the rigger did not focus on the two (2) weakest links of this stunt, which was the release and the actor/wrestler. He stated all of the other equipment used was more than adequate for the use in the described stunt. Dewier did add that many of the items, and equipment stuntrnen use in stunts, may be designed for a completely different application, but if it works and fits their needs they will use it. Dewier stated that it is easy now for someone to say that the SNAP SHACKLE was a poor choice and should not have been used, knowing what the final outcome of the stunt was. On 7?8?1999, the reporting detective met in Valencia, California with Tom Dewier and his associate Perry Barndt, who is also a Stuntman Special Effects person. This was to perform tests on the equipment involved in this case and possibly re?create how the stunt was performed and what went wrong with it. A suspension was set up in the garage of Perry?s home, using a black span strap similar to the one used in this case and was hung from the ceiling. A similar black AMSPEC jerk harness was used and the actual SNAP SHACKLE was used for this testing, which was attached to a large locking carabineer, that was attached to a load strap and then to the span strap. After several hours of testing, it was discovered that the cape the victim was wearing may have played a significant roll in what went wrong with the stunt. It is believed that once the victim was placed in the equipment, his cape was put on him over the equipment. The cape was then secured around his neck with a large red string that was attached to the collar of the cape. During the testing, a towel was substituted in place of the cape, which revealed that while there was no tension on the rope or harness equipment there was no tension on the towel. But once the person began to free hang the towel immediately tightened up around the person?s neck, causing the restriction of breathing. The design of the collar of the cape may have also played a roll in how the release may have been activated. During the testing it was discovered that once the towel became tight around the back side of the harness it also became tight in the area of the SNAP SHACKLE release cord that attaches to the release pin. There was also black gaff tape on the release cord near where it connected to the release pin, giving a larger surface to make contact with. If the collar area of the cape was manipulated in a manner as to release the tension around the neck or in someway moved or adjusted, that could possibly activate the release prematurely. The release only needed to be moved about 1/16 of an inch to have the release open. During the testing this would not occur every time, but is the most plausible scenario'on how the release may have been accidentally activated. Also if the body inside the harness was moving around trying to make adjustments during the same time as the adjustments of the collar of the cape, this too could increase?2e ass/fl? of the release being activated. The SNAP SHACKLE was able to be accidentally tripped a couple of times during the testing by body and arm movements in the harness trying to adjust the towel and harness and relieve the tension around the neck. Dewier did state that when he would do some type of similar stunt that he would never bind up the device or cover it up, and possibly allow something to interfere with its operation. Dewier stated that the SNAP SHACKLE and jerk vest were poor choices to be used in this stunt, knowing now what the end result was, however, this does not necessarily make the use of these items wrong. The reporting detective took several 35mm photographs of the harness that Dewier would have used for this stunt and of the THREE RING release device. He stated that during a World Wrestling Federation wrestling exhibition, at Kemper Arena, the victim was to perform a stunt whereby he repelled from the catwalk, near the ceiling, into the wrestling ring. During the stunt the victim reportedly became unattached from his rigging and fell to the ring. The victim was transported via MAST to Truman Medical Center Emergency Room where he was pronounced dead. Processing of the scene was requested. My investigation revealed the scene to be within Kemper Arena, an exhibition hall located at 1800 Genessee. The interior scene consisted of the main center area of the arena. Stadium style seating was located on the north, south, east and west sides. Chairs were also observed set up on the floor of the arena around a raised'wrestling ring in the center of the arena. The wrestling ring measured 20'2" S) 20'4" The top of the ?oor of the ring was 3'6? up from the ?oor of the arena. The ring was located almost directly below the main scoreboard in the ceiling. The ring was encompassed on all four sides by three horizontal red colored ropes and vertical turnbuckles in the four corners. The bottom rope measured 1'6? up from the mat, the center rope measured 2'10'/2" up from the mat and the top rope measured 4'3 up from the mat. The top of the turnbuckles measured 8'0" up ?om the ?oor of the arena. The ?oor of the ring appeared to be an CIT-white colored canvas mat. A metal set of stairs was observed at the southeast corner of the ring allowng access up to the ring. Areas of orange discoloration were observed in several locations on the canvas. This was explained to be fake blood that was commonly used in the exhibitions. This substance did not test positive for the presence of blood with the use of a Hemastix. Two brown discolored areas, one approximately 6" 2? and one approximately 2" were observed along the west edge of the ring. These areas did test positive for the presence of blood with the use of a Hemastix. Three separate blood samples, taken with a sterilized swab, were recovered ??om the two aforementioned areas as Item My attention was directed to the area where the repelling rigging had been set up. The rigging area was located on a south to north metal catwalk approximately 10'0" just south of the main center scoreboard. The ?oor of the catwalk was approximately 8'10" from the roof of the ceiling. Three horizontal metal handrails were observed on both sides of the catwalk The top handrail measured 3 from the ?oor of the catwalk Large pieces of black cloth were observed attached to the ?oor of the catwalk, the west and east handrails and two metal beams outside the handrails to the west of the catwalk These pieces of cloth appeared to conceal the area, where the stunt was taking place, from the spectators. The main repelling rigging was observed at the north end. The rigging (Item consisted of the following elements: Two - 6?0" black "Liftall" span/set line One- 3'0" black "Liftall" span/set line Five- screw/pin shackles Three- carabiners One - silver colored metal cable One - silver colored rescue rack (with six racks) One - black nylon repelling rope One - snap shackle with a quick release mechanism See attached diagram of the rigging for how the above listed elements were attached to each other. Also see attached Polaroid photos of the north side of the rigging. It should be noted that the "Li?all" span/set line used in the center of the rigging was labeled 6' 0" however measured The "Li?all" span/set line used at the north end of the rigging was labeled 3' 0" but measured 3'2" A manufacturer label was not observed on the "Liftall" span/ set line used at the north end however it measured 6' Upon my arrival, it did not appear that any of the rigging elements were damaged or altered. The black nylon rope was coiled on the ?oor of the catwalk, guided through four of the six racks on the rescue rack then attached to the carabiner that was attached to the snap shackle. The black nylon rope was attached to the carabiner by a double ?gure of eight loop. The loose end of the this knot was secured to the rope by black tape. The carabiner itself was also covered with black tape. The nylon rope measured 174?0" to the top of the aforementioned knot. The following measurements were taken while the rigging was still in place: The center of the bottom breaker bar on the rescue rack to the top of the knot - The center of the bottom breaker bar on-the rescue rack to the bottom loop of the knot The quick release mechanism consisted of a 2' cord attached to a pin mechanism in the snap shackle at one end and a metal pull ring at the other end The pull ring was covered with black tape as well as the end of the cord attached to the pin mechanism. No apparent damage was observed to these elements. Martin #1022 from the family of Owen]. Hart 5u7?65. My investigation revealed the items to be received in a large card board box. From the box, three black luggage items were removed. Assorted clothing, paperwork, toiletries, jewelry, and the costume cape and mask were removed from the box. These items were photographed and left with Det. Martin. Photographs were taken with a Minolta 35mm camera, with the ?lm forwarded to the Kansas City, Missouri Police Crime Laboratory for development. One coil of black rope cordage that measured approximately 7/16" of static kernmantle 16 carrier braided construction with an overhand knot in one end that was taped together with black 2" tape forming a loop. 2. Attached through the loop was an oval quick link that also had the 2? wide black tape on it. 3. One ?Lewmar? swivel quick release with lanyard and ring with 2" wide black tape on it. 4. Five 3 5/8" clevises (4 China, 1 Crosby) 5. One SMC brake bar rack with 5 aluminum flip over bars 6. Three black polyester slings (two Tuflex Liftall TA2 Type: BSZ-30X6 ser#041296 and Econoflex ser# 021946)( one unmarked) 7. Two 5" locking carbiners (one SMC. one Omega). 8. The top criss cross 4" down from the top has a 5/16" WLL CHINA clevis in it. This is where the quick release was attached. CONCLUSIONS The test pull on the ?Lewmar? snap release catch or sear of the plunger was applied in line with movement of the release to produce the 8 1/2 pounds pressure required to release the catch. This snap release is not designed as fall protection equiptment. .If the cord to the release is pulled to the side at an angle the pressure required to release the catch increases. To keep the directional pull on the release cord in line with the release catch plunger the quick release ring and cord were passed through the ?oval quick link". This allows the release to open when pulled with the quick release attached to the small clevis on the back of the vest as the wearer is suspended. The approximately eighteen tablets labeled were coded to contain Calcium Carbonate. an uncontrolled substance. The sixteen blue tablets labeled "Valtrex 500 mg? were coded to contain Valacyclovir: an uncontrolled substance. The thirty-one white tablets labeled -and "Aspirin" were coded to contain Aspirin, an uncontrolled Substance. The twelve yellow and orange capsules labeled ?Mylan 101" were coded to contain Tetracycline, an uncontrolled substance. The three and a half white tablets labeled "Xanax" and were coded to contain Alprazolam, a Schedule IV Controlled Substance. The ten blue tablets labeled ?63721" were coded to contain Alprazolam, a Schedule IV Controlled Substance. The two blue tablets labeled ?Mylan, were coded to contain Alprazolam, a Schedule IV Controlled Substance. The four blue tablets labeled 10? contained Diazepam, a Schedule IV Controlled Substance.
