Two Farm Labor Contractors, Grapernan Labor, Inc. and Rojim, Inc, were thinning grape clusters north of Avenue 408 and west of Road 56. The field workers experienced and one of the Farm Labor Contractors called the emergency services. All persons present during the incident were decontaminated by emergency services. I, Farm, Inc. had sprayed Onager Optek (EPA Reaper Clearform (CA) (EPA south . of ?eld workers location. I was able to determine that Peters Fruit Farm was in violation of Food Agriculture Code 12973, California Code of Regulation 6614, and CaliforniaCode of Regulations 6674. I also found both Farm Labor Contractors in violation of California Code of Regulations 6764, and California Code of Regulations 6766. Background 7 . On 648-2019, the Tulare County Agricultural Commissioner?s Office received an email from the Fresno County about a possible pesticide drift onto field workers on the northwest corner of Avenue 408 and Road 56. 1, Daniel Rios, Agricultural 85 Standards Inspector was assigned the investigation. Violations Food and Agricultural Code 12973 The use of any pesticide shall not con?ict with labeling registered pursuant to this chapter which is delivered with the pesticide or with any additional limitations applicable to the conditions of any permit issued by the director or commissioner. California Code of Regulations 6614: Protection of Persons, Animals, and Property. An applicator prior to and while applying a pesticide shall evaluate the equipment to be used, meteorological conditions, the preperty to be treated, and surrounding properties to determine the likelihood of harm or damage. Notwithstanding that substantial drift would be prevented, no pesticide application shall be made or continued when: (1) There is a reasonable possibility of contamination of the bodies or clothing of persons not involved in the application process; (2) There is a reasonable possibility of damage to nontarget crops, animals, or other public or private property; or (3) There is a reasonable possibility of contamination of nontarget public or private property, including the creation of a health hazard, preventing normal use of such property. In determining a health hazard, the amount and toxicity of the pesticide, the type and uses of the property and related factors shall be considered. The training shall include the following information: (1) Where and in what forms pesticides may be encountered, including treated surfaces in 7 chemigation equipment, irrigation water, and drift; Potential hazards that pesticides present to and their families including acute, chemo and delayed effects and effects; (3) Routes by which pesticides can enter the body; (4) Signs and of overexposure; (5) Routine decontamination procedures when working in a treated field and the employer's responsibility to provide decontamination supplies: (A) Wash hands before eating, drinking, using the toilet, chewing gum, or using tobacco; (B) Thoroughly wash or shower with soap and water; and (C) Change into clean clothes as soon as possible. Thepesticide application occurred south of Avenue 408 on a peach orchard. He added that there were approximately 5 6 people present. Lewis that we could interview the field workers at that point. 1 then received the names of the pesticides being used with their Environmental Protection Agency (EPA) registration numbers from the Tulare County Fire Department. Rangel conducted a Field Worker Safety Inapection on each of the farm labor contractors (attachment 3). On 624?2019, I sent the foliage samples collected to the California Department of Food and Agriculture Sacramento Residue Laboratory for analyses. On 6?25?201 9, I conducted a Pest Control Headquarters Inspection on Peters Fruit Farm (attachment 4). The headquarters inspection showed that Peters Fruit Farm had warning/danger pesticide products that were not stored with the proper Erpitmlf?uarn}. Inc. did have a Sign that stated ?Danger Chemical Storage?, but did not have the speci?c language required by California Code of Regulations 6674. Scott Peters asked why the ?eld workers were placed in the right of way near the field that J.?PEters had ?Sprayed. He had claimed to let the first responders know that they had set up near the treated ?eld, but they did not move. I also obtained a statement from Jason Peters, the applicator that sprayed site 15?102 of Peters Fruit Farm permit on 6-18-2019 (attachment 5). J. Peters stated the following: ?After ?nding out we had more time with the correct condition to spray. I was sent to the ?eld (Block ID: 15104?4) to continue miticide spray. There was a miscommunication and the fact that the crew was across the street was missed. I entered the ?eld and began spraying. Coming out of a row while looking for cars and as I was turning around I noticed a lady across the street just standing in place. I made the mistake of turning around quickly instead of immediately shutting off the PTO and I returned into the field and shortly after I left as I was notified of the incident. The individual who I saw made no noticeable attempt to get my attention and my focus at the time as is usual was to check for coming cross traffic in order to shut down.? I . Peters had shut down the air-blast sprayer he was using, but the PTO was not off. In essence, he had the fan of the aireblast on, but he was not releasing any pesticide when he was turning. He turned into the row and continued spraying. He was not aware that there were any field workers working north of him, until he was noti?ed when he arrived at Peters Fruit Farm, Inc?s Shop. I will be going back to work because I need to, but I still do not feel well. I felt as if the clinics, first responders, and Tulare Agricultural Commissioner's did not treat me properly. I want you to act and prevent future incidents. I went to the worker compensation clinic and they told me that I was not ill and I could go back to work. I did not agree with the clinic and went to Adventist Health in Selma and there they gave me medicine. I explained to that there are steps and evidence I need to collect in order to determine if there are any violations during an incident. I also mentioned she could speak to the Tulare County Pesticides Deputy, or California De miment of Pesticide Regulation if she felt I was not doing my job properly. I started working and later that morning I felt ill and could not see clearly. I drank water, soda, and juice, but I still did not feel well. I did not think it had to do with any pesticides, since I had worked in ?elds before and near pesticide applications and never felt anything. After approximately 8:00 am, I could not work anymore and told my forewoman I was not feeling well and the forewoman said I could go home. I then called my daughter to pick me up. Before my daughter arrived in the field, more people started feeling ill. The forewoman then said that anybody feeling sick- could go home, but the rest could keep working. The forewoman changed her mind when she saw another crew leaving the vineyard because of the pesticide application. Shortly after my daughter arrived, then the first responders arrived and they did not let her leave. I still feel dizziness when I do not look straight. lso stated the she had mentioned before. On, 8~l 5?2019, I received the Tulare Environmental Health?s report (attachment 9) . On, 8?23-2019, I received the Tulare County Fire Department?s report of the incident (attachment 10). Results County: Tulare Subject: Pesticide Drift Inspector: Daniel Rios?Rome Priority Date: 6484019 Page: 25 of30 medical records from Family Health Care Network Selma stated the on 6-20-2019 were likely not due to the pesticide exposure she had on 6-18? was referred to Adventist Health Selma and was evaluated, but no conclusion edical 1ecoids ?orn Kings facility stated she did not go to the clinic for an incident related to her pesticide exposme . lso went to Kings Indusuial Medical Center 1110., but he1 records were not available by 8- 30- 2019 fiorn the medical cente1 (attachment 10) In addition Marianna Santos Gentert Deputy Ag1icultuial Commissioner received an interpietation of some of the medical 1e001ds from Dr. Karen Haught the Tulare County Human Health Services County Health Officer. M. Gentert stated the following, ?Dr. Haught (HHS County Health Officer) reviewed the medical records on July 9, 2019 for In summary she stated: The patient was given three-doses of atropine by EMS. This medication is to be used as an organophosphate blocker. The pesticides applied were not an organophosphate so the medication was unnecessary. This medication was most likely the cause for the of tachycardia, hypertension, and anxiousness. The amount of doses were excessive.? Grapeman Labor, Inc. was in violation of California Code of Regulations 6764. Fieldworker Training (CCR 6764). CCR 6764 requires the training record to ?include the date; employee?s printed name and signature; the title(s) and source(s) of the training materials used; employer's name; and trainer?s name and of all employees that will work in treated fields. Both sites the ?eld workers worked on 6-18?2019 and 6~20~2019 had been sprayed with pesticides and met the definition of a treated field (attachment 12). The training records provided by Grapeinan Labor, Inc. had only one line for the employees to sign or print thei1 name. Consequently, the training records did not have both the signature on the form In addition, the training records did not include field workeis 2 hat was p1 esent during the ineldent on 6 18- 2019. The training record did not specify what materials were used during the training and it did not state the trainer?s quali?cation. I received the training certi?cate to meet the trainer qualification required by CCR 6767. The certi?cated stated tha received pesticide handler training, which does not certify people to provide pesticide training. Therefore, Grapeinan Labor Inc. was in violation of CCR 6764 (e ecame certified to County: Tulare Subject; Pesticide Drift InsPector: Daniel Rios-Rome Priority Date: 648?2019 Page: 26 of30 train on pesticide safety after attending a California Department of Pesticide Regulation train the trainer course on 7-31-2019 (attachment l3). Grapeman Labor, Inc. was in violation of California Code of Regulations 6766: Emergency Medical Care (CCR 6766). CCR 6766 states ?When there are reasonable grounds to suspect that an employee has a pesticide illness, or when an exposure to a pesticide has occurred that might reasonably be expected to lead to an employ '11 the employer shall ensure that the employee is taken to a physician immediately.? Rojim, Inc was in violation of California Code of Regulations 6764: Fieldworker Training (CCR 6764). CCR 6764 requires the training record to ?include the date; employee?s printed name and signature; the title(s) and source(s) of the training materials used; employer's name; and trainer?s name and quali?cations. . of all employees that will work in treated ?elds. Both sites the ?eld workers worked on 648-2019 and 6-20?2019 had been sprayed with pesticides and met the de?nition of a treated ?eld. The training records provided by Rojim, Inc. did not have the si nature In addition, the training records did not include _7 herefore, Rojim, Inc. was not Rojirn, Inc. was in violation of California Code of Regulations 6766: Emergency Medical Care (CCR 6766). CCR 6766 states ?When there are reasonable grounds to suspect that an employee has a pesticide illness, or when an exposure to a pesticide has occurred that might reasonably be expected to lead to an employee's illness, the employer shall ensure that the employee is taken to a physician immediately.? as ld could go home if she did not feelwell Rojirn, Inc.?s forewoman. The foliage samples were tested for abamectin, the active ingredient of Reaper Clearform (CA) (EPA and hexythiazox, the active ingredient of Onager Optek Mineral oil, the active ingredient of Narrow Range 415 Spray Oil was not tested for because the laboratory cannot analyze for mineral oil as per Valerie Wilson, Tulare County?s liaison from the California Department of Pesticide County: Tulare Subject: Pesticide Drift Inspector: Daniel Rios?Romo Priority Date: 6~18w2019 Page: 27 of 30 Regulation. The sample analysis results were negative for abametin and positive for hexythiazox. The half-life of abarnectin has been recorded to 8 hours when exposed to sunlight and 3.5 hours when exposed to sunlight and water. Reaper Clearforni (CA) EPA is 2 percent abarnectin; therefore due the percentage and its short half?life abamectin may have been at undetectable levels by the time samples were collected and analyzed. reported of previous mild exposures to abamectin are rash, urticaria, pruritus, edema, headache, dizziness, somnolence,mild irritation, asthenia, nausea, vomitingahdnminal pain) diarrhea, and nwild tachycardia. Some of field workers? were consistent with previously recorded Hexythiazox results showed a pattern with higher concentration in the samples collected closer to Peters Fruit Farm, Inc. site 15?102. The concentration pattern indicates that the hexythiazox found in the grape vineyard came from the direction of Peters Fruit Farm, Inc. 3 site (attachment 18).Hexythiazox has tolerances of 1 for both stone fruit and climbing vines. The concentrations of hexythiazox found in the vineyard where the field workers worked were under 1 ppm. The Tulare County Agricultural Commissioner?s of?ce received a risk assessment of hexythiazox from Dr. Michael O?Malley from the California Department of Pesticide regulation. Dr. O?Malley stated ?It's a inhibitor likely only to affect insects and aquatic invertebrates. It's not very irritating and has very low acute toxicity - see information from HSDB(National Library of Medicine Toxnet)? Toxnet states that hexythiazox is a slight irritant f1om animal studies which is consistent with of some of the field workeis? (attachment l9). Mineral oil exposure could cause nausea, vomiting, diarrhea, foreign body reaction, intestinal obstruction, colon injury, fecal leakage, and lung injury. The ?eld workers also experienced similar to those related to mineral oil exposure. Mineral oil is exempt from tolerance requirements (attachment 20). I conducted a pesticide use report query of the surrounding eight section for the active ingredients: Hexythiazox, abaniectin, and mineral oil. Peters Fruit Farm, Inc. was the only growe1 that used the three active ingredients within a mile of the incidents location. In addition, only three other growers applied a product with Hexythiazox. Two growers sprayed prior to the incident. One of the two growers Sprayed within a mile, but sprayed east of the vineyard where the field workers were thinning grape clusters. The third grower ?nished the application 11 days after the incident, and sprayed moie than 1 miles away. Peters Fruit Farm, Inc. also sprayed the same products within a mile of the incident?s location from 6-?1 5-2019 to 6-27?2019 to different orchards. Some field workers had mentioned that they saw, heard, and smelled a pesticide application early in the morning. Peters Fruit Farm, Inc. finished spraying the same pesticides near the incident?s location from 3:45 am. to 8:00 am; therefore, some field workers may have noticed one of the earlier application when they began their workday (attachment 21). The Hexythiazox sample analysis results also showed a concentration pattern that indicates the pesticide came from the south to towards the field workers. Many of the experienced by the ?eld workers were likely caused by the wexpgs the south and south-southeast from 8:"32019 which was towards the - dnectron of field workers at time they weie working Therefore Peters Fruit Patna, Inc used the pesticides in a manner that did not prevent drift onto peisons and pioperty not involved in the application The Onager Optek label, under the Direction For Use section, states: ?It is a Violation of Federal law to use this product in a manner inconsistent with its labeling. Follow all directions on the EPA approved label and any supplemental labelingDo not apply this product in a way that will contact workers or other persons, either directly or through drift. Only protected handlers may be in the area during application. For any requirements speci?c to your State or Tribe, consult the agency responsible for pesticide regulation.? The Reaper Clearform. (CA) (EPA label, under the Direction For Use section, states: ?Restricted Use Pesticide. It is a violation of Federal law to use this product in a manner inconsistent with its labeling. Do not apply this product in a way that will contact workers or other persons, either directly or through drift. Only protected handlers may be in the area during application. For any requirements specific to your State or Tribe, consult the agency responsible for pesticide regulation.? The Narrow Range 415 Spray Oil label, under the Direction For Use section, states: ?It is a violation of Federal law to use this product in a manner inconsistent with its labeling. Do not apply this product through any type of irrigation system. Do not apply this product in a way that will contact workers or other persons, either directly or through drift. Only protected handlers may be in the area during application. For any requirements speci?c to your State or Tribe, consult the agency responsible for pesticide regulations.? Peters Fruit arm, Inc. was in violation of Food and Agricultural Code 12973 (PAC 12973). PAC 12973 states that no pesticide can be used in con?ict with the label. Peters Fruit Farm drifted onto the vineyard and exposed ?eld workers who were not part of the pesticide County: Tulare Subject: Pesticide Drift Inspector: Daniel Rios-Rome Priority Date: 6?18?2019 ?age: 29 01?30 application. Therefore, the Peters Fruit Farm, Inc. used the pesticide products in conflict with their labels. Peters Fruit Farm was also in violation of Caiifornia Code of Regulations 6614: Protection of Persons, Animals, and Property (CCR 6614). CCR 6614 states the applicator must consider equipment to be used, metrological conditions, the property to be treated, and surrounding properties to determine if there is reasonable possibility of contaminating bodies, and clothing of persons not involved in the application. J. Peters did not know that there were field workers in the ?eld north of him; therefore, he did not check the surrounding properties to assess possible harm to people. The wind was blowing towards the ?eld workers at the time (attachment 22). Conclusion Grapeman Labor, Inc. and Rojim, Inc. were in violation of CCR 6764; since both farm labor contractors did not meet the requirements for maintaining training records for their employees. Furthermore, the farm labor contractors did not train some of the employees on pesticide safety before they worked in a treated field. Both farm labor contractors were also in violation of CCR 6766, since the farm labor contractors? forewomen told at least one of their employees they could go home if they felt ill instead of immediately taking her to a physician. In addition, Peters Fruit Farm, Inc. was in Violation of FAC 12973 and CCR 6614, since the property operator applied the pesticides in con?ict with their labels, and used them when there was a reasonable possibility of contaminating bodies not involved in the application.
