DURING THE COVID-19 PUBLIC HEALTH EMERGENCY A A A A AUTHORITY: Resolution and Proclamation of the City of Mobile adopted March 17, 2020; Ala. Code Sec. 31-9-10, 11-45-1, 11-47-131; Order of the State Health Of?cer suspending certain public gatherings due to risk of infection by COVID l9 (applicable statewide) as amended March 27, 2020; Emergency Proclamation of Governor Kay Ivy March 13, 2020 ORDER: It is hereby ordered that a Public Safety Curfew is imposed in the City of Mobile, effective at 10 pm. April 4, 2020 as follows: a. The Public Safety Curfew shall apply to all persons within the City of Mobile. During the curfew, all persons shall remain in their places of residence and shall not be or remain in public places, except as further provided in this ordinance. b. Subject to the exception further provided in subsections and of this Order, all travel, including, without limitation, travel on foot, bicycle, scooter, automobile, or public transit is prohibited transportation and interstate commerce is not governed by this Order. 0. For the hours of 10 PM through 5AM, the curfew shall not apply to: 1. Public safety workers, such as police, ?re, and emergency service providers, including but not limited to law enforcement, ?re and rescue, and dispatchers. 2. Public health workers, employees of hospitals, health care facilities, assisted living facilities, travel to and from mortuaries, and security services. 3. Employees of utilities, cable, telecommunications, intemet companies and their contractors engaged in activities necessary to maintain or restore services. Government employees or contractors necessary to maintain or restore infrastructure. Employees of an industry vital to the national economy, as de?ned herein. Persons seeking emergency medical treatment. Credentialed members of the media and necessary support staff. Persons traveling through the city from one location outside the city to another location outside the city, returning to their city residences from outside the city, or traveling to their city residences from inside the city. 9. Persons exempted from the 10PM through 5AM curfew. Employees engaged in crisis intervention, sanitation services, and delivery services, including deliveries of food, merchandise and mail. Persons engaged in essential activities, as de?ned herein. Employees and customers of essential businesses, as de?ned herein. Persons employed by the federal, state, county or city government or their agencies working within the course and scope of their public service employment who report to work at the direction of their employers, and persons engaging with those governments or agencies, but only to the extent authorized by the agency or department. Persons complying with the lawful order, of a court, police of?cer, or other governmental authority. Gatherings of less than 10 persons or work related gatherings that can maintain a consistent six-foot distance between persons. e. All activities conducted and businesses operated must comply with social distancing protocols, except when providing healthcare, emergency, and other similar services. DEFINITIONS: a. Essential activities: Tasks essential to maintain health and safety, including, but not limited to the following: 1. L11 Getting medicine or services from a doctor or veterinarian. Getting necessary services or supplies for themselves or their family or household members, such as groceries and supplies necessary for sheltering in place, including purchasing food or drink for take-out or delivery provided social distancing protocols are maintained by the restaurant or other provider. Engaging in outdoor activity, such as walking, hiking or running provided social distancing protocols, as de?ned herein, are maintained. Caring for a family member, person or pet in another household. Tasks necessary to care for elderly, minors, dependents, people with disabilities or other vulnerable persons. b. Essential businesses: Businesses that provide goods or services necessary to those sheltering in place, including but not limited to the following: 43274765 v1 99%? Health care providers, including home health services. Construction, manufacturing, and related companies that build or maintain homes, businesses, public works projects, utilities, and similar structures or projects. Mobility Assistance Program (MAP) operated by the WAVE Transit System. Grocery stores, farmers' markets, food banks, and convenience stores. Restaurants and other providers of take-out or delivery of food and drink. Shelter facilities and providers of necessities for disadvantaged or vulnerable individuals. 12. 13. 14. 15. 16. Pharmacies, health care supply stores and other similar businesses. Gas stations and auto repair facilities. Banks. . Garbage collection services. .Hardware stores, plumbers, electricians and other service providers necessary to maintain the safety, sanitation and essential operation of residences, essential businesses, and other structures as necessary. Educational institutions, for the purposes of facilitating distance learning. Laundromats, dry cleaners and laundry service providers. Businesses that ship or deliver groceries, food and goods directly to residences. Child care facilities providing services that enable essential employees to go to work. Providers of essential business services, including but not limited to security, payroll, professional organizations and services, including those providing dental, medical and surgical procedures permitted under paragraph 7 of the Order of the State Health Of?cer Suspending Certain Public Gatherings Due to Risk of Infection by COVID- 19, as amended March 27, 2020, and business gatherings that can maintain a consistent six-foot distance between persons and similar activities. c. Industry Vital to the National Economy: A business that provides goods or services necessary to the national defense, air transport, or public health and safety. d. Social Distancing and CDC Protocols: Maintaining a consistent distance of at least 6 feet between individuals, frequently washing hands with soap and water for at least twenty seconds or using hand sanitizer, covering coughs or sneezes (into the sleeve or elbow, not hands), regularly cleaning high-touch surfaces, and not shaking hands. For businesses, assuring to the maximum extent feasible that persons with of or exposure to COVID-19 do not report for or remain at work. Protocols include such other and different guidelines issued by the CDC and posted conspicuously on the City website. This Order shall remain in effect until April 30, 2020, unless it is determined that the emergency conditions no longer exist prior to that date, but may be extended if the emergency conditions continue beyond that date. r.
