That the Connecticut State Police, Collision Analysis and Reconstruction Squad (C.A.R.S.) was requested to respond to the scene to assist with the investigation of the fatal motor vehicle collision. TFC Comstock #775, was assigned to conduct said investigation. The scope of TFC Comstock's investigation includes the reconstruction of the collision sequence and determining causative and contributing factor(s). The collision sequence was documented with the use of photographs and forensically mapped employing a laser scanner. TFC Comstock's on-scene investigation consisted of an examination, analysis, and documentation of the relevant physical evidence, roadway configuration, and body of the deceased Goncalves. During said examination, several motor vehicle parts were found on scene with identifying numbers and letters on them. An internet search by C.A.R.S. member TFC Mark DiCocco #308 for the part number found on one green fiberglass part revealed that it belonged to a 1997-2001 Jeep Cherokee. That this information was put out in a statewide broadcast in an attempt to locate the evading motor vehicle. 4. That the vehicle parts at the scene of the collision Were collected and later submitted to evidence at Troop I, so that the parts would be available for comparison and identification of the involved vehicle. 5. That on November 4, 2018, at 2300 hours, an individual, later identified by his Connecticut driver's license as Michael Rodriguez (DOB 02/09/1994), arrived at Troop to provide information on the motor stated thaLhe thesameareaihe?ped e?strianwas? I struck at 0030 hours on November, 4, 2018, and wanted to his name. Rodriguez stated that he had been coming from T. H. C. The Hops Company, the self-described "premier beer destination in Connecticut" located at 77 Sodom Lane in Derby, CT. Rodriguez also stated that he did not stop at the scene or report the accident to police because he was operating his green 1999 Jeep Cherokee Classic (VIN: 1J4FF6889XL644407) which was not registered or insured and had misused Connecticut passenger plates on it. 6. That a check of files showed that Connecticut passenger plate was a valid Connecticut passenger plate that belonged on a red 1996 Jeep Cherokee SE (VIN: 1J4FT2882TL105347). The registered owner was Michael Rodriguez (DOB 02/09/1994). A check of ?les for the 1999 Jeep Cherokee Classic 1J4FF68S9XL644407 showed that the registration had been revoked due to a transfer by the former owner on 09/15/2018. it was determined, by Rodriguez's own admission, that the green 1999 Jeep Cherokee Classic did not have insurance. 7. That, on November 4, 2018, at 2330 hours, TFC Horjatschun #921 and Prospect Police Officer Vegliante #lC25 went to Michael Rodriguez's residence, 8 Birchwood Terrace, Prospect, CT and located the 1999 Jeep Cherokee Classic 1J4FF68S9XL644407), color dark metallic green. TFC Horjatschun obtained verbal consent from Michael Rodriguez to search the vehicle. TFC Hortjatschun concluded this damage was consistent with-the debris found at the scene of the motor vehicle accident. TFC Horjatschun also observed two black ?bers, which he suspected to be human hair on the right front fender ofthe Jeep. TFC Horjatschun seized the 1999 Jeep Cherokee Classic (VIN: 1J4FF6889XL644407), color dark metallic green and the two black fibers and placed them into evidence at Troop TFC Horjatschun then asked Michael Rodriguez if he would provide a sworn written statement at which time Michael Rodriguez stated that he would be obtaining an attorney. 8. That on Monday, November 5, 2018 at approximately 0930 hours, The Af?ant and TFC Comstock attended the post-mortem examination of the deceased Tony Goncalves. During the post-mortem examination, Goncalves was found to have a right femur fracture 24%. inches above his heel, as well as various contusions, abrasions, lacerations, and internal injuries that were consistent with a pedestrian being struck by a motor vehicle. Associate Medical Examiner Gregory Vincent, M.D. determined Goncalves' cause of death to be Blunt Injuries of Head, Torso, and Right Lower Extremity. The manner of death was determined to be Accident. 9. That a cursory external examination of the seized 1999 Jeep Cherokee Classic showed that it was equipped with a rectangular tubular steel front bumper that was 24-29 inches above the ground, consistent with the height of Goncalves' right femur fracture. 10. That, on Wednesday, November 7, 2018 at approximately 1415 hours, the Af?ant and TFC - Comstock presented a search warrant to the Honorable Judge Markle at New Haven Superior Court for the 1999 Jeep Cherokee Classic The Honorable Judge Markle reviewed and authorized the warrant. 11. That, on Thursday, November 8, 2018, the Jeep Cherokee Classic was processed on the search warrant at the Troop garage in Bethany, CT from approximately 0915 hours until 1530 hours. Multiple exhibits of evidence (#100-#113) were seized during the processing of the Jeep Cherokee Classic. 12. That, swabbings for potential DNA sources for comparative purposes were taken from the following areas on the front passenger's side of the vehicle' In an effort to locate DNA from the victim. Swabbings for potential DNA sources were taken from the dents on the front right hood area (exhibit #101) (exhibit #103). That, on Wednesday, January 9, 2019, the Affiant received the DNA report from Analyst Jillian Echard of the State of Connecticut Department of Emergency Services and Public Protection Division of Scienti?c Services in regards to the submission of evidence exhibits #101, #102, and #103. The results were consistent with the DNA profile from exhibit #101 being at least 10 billion times more likely to occur if it originated from Goncalves and one unknown individual than if it originated from two unknown individuals. The results were consistent with the DNA pro?le from exhibit #102 being at least 100 billion times more likely to occur if it originated from Goncalves than if it originated from an unknown individual. And the results were consistent with the DNA pro?le from exhibit #103 being at least 19,000 times more likely to occur if it originated from Goncalves and three unknown individuals than if it originated from four unknown individuals. 15. That in conclusion, through DNA evidence, it can be stated that the 1999 Jeep Cherokee Classic (VIN: 1J4FF68S9XL644407) came in contact with Goncalves in a manner consistent with a motor vehicle striking a pedestrian. 16. That, based on the aforementioned facts and circumstances and Rodriguez's own statements, he knowingly struck an object while operating his 1999 Jeep Cherokee Classic and did not stop or report the accident to police. Rodriguez was also knowingly operating his 1999 Jeep Cherokee Classic while it was unregistered and uninsured with an improper registration plate attached to it.
