Date of violation: April 5, 2020 Decision on violation: April 7, 2020 Decision: In the case of Waxelbaum v. United Voices for ASU (Senatorial Ticket comprising of Diane Solorio, Bridget Saidu, Yamilet Nunez Ibanez, Alexia Isais, Sebastian Miscenich, Daniel Lopez, and Nayelli (Luz) Granados Jarquin). The Elections Department has decided to sanction an infraction of three (3) points to the seven (7) candidates that comprise of the United Voices for ASU Ticket, as the defendant was deemed in violation or Arizona Board of Regents statute. Section 8-1 of the USG Elections Code states: “8-1-A. Complaints shall only allege violations of non-compliance of this Elections Code, including its references to the Student Code of Conduct and other related governing documents..” The Elections Department has reasonable evidence to believe that the United Voices for ASU Senatorial Ticket has raised reasonable concern for the risk or danger of the university community due to their tweets related to ASU President Michael Crow. As the ABOR Code of Conduct is considered a “related governing document” to the Student Code of Conduct, all USG candidates are expected to be in compliance of the governing documents of the Arizona Board of Regents. While we understand that all USG candidates retain their First Amendment rights to free speech and political expression as outlined in the United States Constitution, we do believe that there any expression specifically threatening the University President to be inappropriate and raise concern given the office they are seeking. While we value the opinions and passion of the United Voices for ASU, Undergraduate Student Government remains a nonpartisan organization as a governing body for undergraduate students. Given this ruling, The Elections Commission will rule in favor or Judah Waxelbaum for a Level One (1) infraction of three (3) elections points to Diane Solorio, Bridget Saidu, Yamilet Nunez Ibanez, Alexia Isais, Sebastian Miscenich, Daniel Lopez, and Nayelli (Luz) Granados Jarquin.
