DEEMER DEPUTY MANAGING DIRECTOR April 9, 2020 OFFICE OF THE MAYOR CITY AND COUNTY OF HONOLULU EMERGENCY ORDER NO. 2020-05 (COVID-19 [Novel Coronavirus]) CURFEW By the authority vested in me as Mayor of the City and County of Honolulu (the ?City?) pursuant to Revised Charter of the City and County of Honolulu 1973 (2017 Edition), as amended; the Revised Ordinances of the City and County of Honolulu 1990, as amended; the Hawai?i Revised Statutes, as amended (?Haw. Rev. Stat?); the Constitution; and laws of the State of Hawai?i, I, KIRK W. CALDWELL, hereby issue this order (the ?Order?) to address the emergency declared in the Proclamation [Novel Coronavirus] that I issued on March 4, 2020, and Supplemental Proclamation of Emergency or Disaster [Novel Coronavirus]) that I issued on March 18, 2020. Pursuant to Haw. Rev. Stat. l27A-25 and the Rules of the Mayor City and County of Honolulu, dated March 20, 2020 (?Mayor?s Rules?) promulgated under that section, this Order shall have the force and effect of law. The Order is in accordance with and incorporates by reference the Proclamation [Novel Coronavirus] that I issued on March 4, 2020; the Supplemental Proclamation of Emergency or Disaster [Novel Coronavirus]) that I issued on March 18, 2020; the Emergency Order No. 2020-02 (Covid-l9 [Novel Coronavirus]) Stay At Home Work From Home Order that I issued on March 22, 2020 (?Stay at Home Order?); Hawai?i Governor David Y. Ige?s Proclamation dated March 4, 2020 (as supplemented); and the Order for Self-Quarantine dated March 21, 2020, issued by the Hawai?i Emergency Management Agency. This Order is effective at 11:00 pm. on Friday, April 10, 2020, and will continue through 5:00 am. on Monday, April 13, 2020, under the terms and conditions more particularly set forth below. Violation of the Order is punishable as a misdemeanor, with ?nes of up to $5,000, up to a year in jail, or both. Haw. Rev. Stat. l27A-29; Mayor?s Rules. I. ORDER Motor vehicles and other wheeled means of transportation travel shall be prohibited within the City and County of Honolulu during the following times: 0 From 11:00 pm. Friday, April 10, 2020 to 5:00 am. Saturday, April 11, 2020; and 0 From 11:00 pm. Saturday, April 11, 2020 to 5 :00 am. Sunday, April 12, 2020; and 0 From 11:00 pm. Sunday, April 12, 2020 to 5:00 am. Monday, April 13, 2020. Exceptions to the above Order are as follows: 0 Travel by deliveries/delivery services as provided in Section HF. 10 of the Stay at Home Order; 0 Travel by security companies for business purposes only as provided in Section II.F.26 of the Stay at Home Order; 0 Travel to/from work at an Essential Business, as provided in Section II.F of the Stay at Home Order, and home; Travel to drug stores and/or pharmacies for urgent medication; 0 Travel for medical emergencies; Public modes of transportation (TheBus and TheHandi-Van) and essential transportation workers such as Department of Transportation Services employees and O'ahu Transit Services operations and maintenance personnel 0 Public utility vehicles conducting maintenance and repairs; and 0 First Responder vehicles (Honolulu Police Department, Honolulu Fire Department, and Honolulu Emergency Services Department, Emergency Medical Services Division). De?nitions: ?Other wheeled means of transportation? includes, but is not limited to, mopeds, bicycles, tricycles, skateboards, roller skates, roller blades, unicycles, etc. II. GENERAL A. Sugerseding Order. This Order hereby supersedes the Of?ce of the Mayor City and County of Honolulu Emergency Order No. 2020-02 [Novel Coronavirus]) ?Stay At Home Work From Home Order? dated March 22, 2020 during the dates and times this Order is in effect, to the extent necessary to effectuate this Order. Order No. 2020-02 ?Stay At Home Work from Home Order? remains in full force and effect during the dates and times this Order is not in effect. B. Duration. This Order shall take effect at 11:00 pm. on Friday, April 10, 2020, and shall continue in full force and effect during the three (3) time periods speci?ed above until 5:00 am. on Monday, April 13, 2020, or until it is extended, rescinded, superseded, or amended by a subsequent order, or as otherwise provided under Haw. Rev. Stat. ch. 127A. Following the expiration of this Order at 5:00 am. on Monday, April 13, 2020, the Of?ce of the Mayor City and County of Honolulu Emergency Order No. 2020-02 (COVID-19 [Novel Coronavirus]) ?Stay At Home Work From Home Order? dated March 22, 2020, will continue in full force and effect at all times. C. Enforcement. All law enforcement of the State of Hawai?i and City shall ensure compliance with and enforce these Orders in accordance with Haw. Rev. Stat. 127A-25 and 127A-29 and Mayor?s Rules. Operators and persons using such wheeled means of transportation during the prohibited time period (and who do not fall under an exception) shall be issued a citation for violation of this Order. D. This Order shall be posted on the City website as soon as practicable in one or more appropriate places, and shall remain posted while in effect. E. Severability. If any provision of this Order or its application to any person or circumstance is held to be invalid, the remainder of the Order, including the application of such part or provision to other persons or circumstances, shall not be affected and shall continue in full force and effect.
