We request that you reconsider for several reasons. First, Michaels is an Essential Business and Operation as defined under Sections 12 (l), (p), (q), and (v) of the Order and Amended Order because, among other functions, it (i) sells and supplies office supply products and other products needed for people to work from home and conduct homeschooling instruction, (ii) is in the business of mail, shipping, delivery, and pick-up services (including stores designated UPS access points), (iii) sells and supplies other Essential Businesses and Operations with materials necessary to operation, and (iv) is a distributor and supply chain related company supplying essential products and services used by other Essential Businesses and Operations. Employees at the stores are also essential to Michaels maintaining its Minimum Basic Operations, including but not limited to activities to facilitate employees of the business being able to continue to work remotely from their residences, as permitted pursuant to Section 13(b) of the Order and Amended Order. Furthermore, as you are aware the CDC is now recommending that individuals wear masks in public, and Michaels provides materials, tools and instructions for people to make their own masks to wear in public and to avoid continued shortage of masks for our medical professionals on the frontlines. Second, Michaels is limiting its operations and taking all necessary steps to ensure the health and safety of both its employees and the general public. Specifically, Michaels is continuing only its “buy online, pick-up in store,” “ship from store” and “curbside pick-up” operations in Ohio. Additionally, any employees working during this time will be instructed to strictly maintain all proper social distancing protocols (at least six feet between individuals). The stores are being thoroughly cleaned (including regular cleaning of high-touch surfaces), disinfectant products are present throughout the stores, and employees are instructed to wash their hands using soap and water for at least twenty seconds as frequently as possible and/or to use hand sanitizer. The fewest number of employees will be present at each Michaels store that remains open and Michaels will comply with all tenets of the Order and Amended Order, Executive Orders issued by Governor DeWine and guidelines from the Centers for Disease Control and other public health officials. Michaels provides pick-up options for products and services that may otherwise be unavailable to these individuals. In light of the above-mentioned essential services Michaels provides to the citizens of Ohio and its plan to continue serving customers through limited operations, we respectfully request that you reconsider the order to cease operations.
