ASASU Supreme Court Statement on the status of Jester V. Fees April 30th, 2020 Previously, the Supreme Court made a ruling on the case of Jester v. Fees, deciding to give the Max Fees Executive Ticket on the Tempe campus 15 infraction points, disqualifying them from the run-off election. After our decision was finalized and published, many potential Constitutional Right infringements came to the Court’s attention. The Court acknowledges that as we are composed of students, we are not properly trained nor capable of interpreting constitutional law, however, due to the very contentious and significant decisions made in Jester v. Fees, the Court has interest in pursuing these issues, studying them thoroughly, and seeking counsel with others who have more expertise i the 1st and 14th amendment. Therefore, the Court is taking action to pursue these issues and study them further. This action requires the postponement of the Inauguration of the winning Executive Ticket until a further date. As the Court is composed of students, these issues will be readdressed post finals week, with a decision to come in mid-to-late May. Once these issues have been addressed, Jester v. Fees will officially be closed indefinitely, with its decision being final. The Court understands that all decisions of the Supreme Court are final. We are not undermining our previous decision by reassessing issues, but rather ensuring that all student voices are heard and all decisions of the Supreme Court abide by Constitutional Rights. On May 1st, the Court will receive all final documents by both Jester and Fees. Once finals week has come to an end, the Court will reconvene to discuss and decide on these issues. A final decision will be made closely thereafter, with the inauguration of the Executive Ticket immediately afterwards. The Court is not overturning the decision in Jester v. Fees, but does not leave the possibility off the table. A final decision will come in the next few weeks. Thank you all for your patience in this trying and unprecedented time.
