Main Street Orange, CA 92868 NOTICE OF SUMMARY SUSPENSION Dear Dr. Sanchez: Effective immediately, your Medical Staff membership and clinical privileges are summarily suspended. The suspension will remain in effect until terminated or modified in accordance with the Medical Staff Bylaws. This action is based on a determination that failure to immediately suspend your Medical Staff membership and clinical privileges ?may result in an imminent danger to the health of any individual,? including patients. (Bylaws, Section 13.8, California Business and Professions Code. Section 809.5.) That determination was based on reliable evidence that you: - attempted, during a pandemic, to instill fear and a lack of confidence in the public by indicating that hospital personnel at St. Joseph of Orange and Children?s Hospital of Orange County (the, ?Hospitals?) were knowingly bringing the coronavirus back to hospital patients, including NICU patients; 0 engaged in flagrant abuse, intimidation, and harassment of hospital personnel; 0 engaged in actions that may have affected the well-being of hospital personnel by creating undue stress and anxiety during this unprecedented pandemic; engaged in unprofessional conduct; and exposed the Hospitals and hospital employees to liability. In particular, on or about Friday March 27, 2020, a video taken by you was posted publically on Facebook wherein you are heard confronting a group of healthcare workers who were in line at a local restaurant to purchase a discounted lunch offered as a promotion for healthcare workers, and you stated, among other things, 1. "Where do you work at (response: UCI, CHOC and St. Joseph) . . . Why are they doing this promotion just for healthcare workers. . . Are you guys all healthcare workers. . . all of you standing right here next to each other, getting coronavirus, so you can bring it back to the hospital next week, where we have all these people that are coming in sick.? 2. ?Hope you don?t? work at CHOC where the babies are, hope you don?t work in the NICU, you guys ought to be ashamed of yourself, all of yousupposed to be ashamed of myself, am I standing in line just to get a five dollar bowl, just to get some free food.? 1100 West Stewart Drive 0 Orange, CA 92868 T: (714) 633?9111 A Ministry founded by the Sisters of St. Joseph ofOrange Ana Sanchez, M.D. March 31, 2020 Page 2 of 3 3. ?You guys are healthcare workers too, where do you work at (response: St. Josephs), don?t you know you are not supposed to be standing next to each other in line, . . .why are you standing next to each other in line, . . you are healthcare workers, don?t you care about the work that you do, . . . then why are you giving other people coronavirus or getting coronavirus, don?t you take it seriously, people?s lives are on the line, . . . if you are going to do this shameful behavior in public, I have every right to videotape it, . . . I?m a doctor; my name is Dr. Sanchez, . . . and you won?t see me selling out for ?ve lousy bucks, which is what all of you guys are doing, don?t care who you get sick as long as you get that ?ve bucks.? Despite previous warnings and cautionary statements regarding your behavior, and your October 29, 2019 agreement, your unprofessional disruptive behavior continues. You agreed, among other things to come to the Medical Staff leadership with any concerns that you believed could not be resolved when dealing directly with staff and to refrain from engaging in any behavior that is outside of protocol or that could be viewed as unprofessional. This current event violates your agreement and can reasonably be expected to affect patient care and create patient safety issues as both the filming and publication of your video placed unnecessary stress on hospital personnel who are all currently working under extremely stressful conditions and both the filming and publication of the video may lead patients to hesitate to seek treatment and/or delay treatment at the Hospitals, during this unprecedented pandemic which could result in a further spread of the coronavirus or even patient deaths. You may request, in writing, an interview with the Medical Executive Committee to review the summary suspension. The interview will occur as soon as reasonably possible under all the circumstances, not to exceed ten (10) days from your request. The interview shall be informal and shall not constitute a hearing, as that term is used in Article 14 of the Bylaws, and you may not be accompanied to the interview by legal counsel. Following the interview the Medical Executive Committee will determine whether to continue, modify, or terminate the terms of the summary suspension. This Notice of summary action constitutes a request to initiate a corrective action and the procedures set forth in Section 13.2 of the Bylaws shall be followed. If the summary suspension remains in effect for longer than fourteen (14) days from the date of this notice, it will be reported to the Medical Board of California as required by Business and Professions Code, Section 805. In that event, you will receive notice of your right to request a formal hearing before a hearing committee in accordance with Article 14 of the Bylaws. While the suspension is in effect you will be prohibited to be on Hospitals? premises except to meet with the Medical Executive Committee or pursuant to appointment. The care of any patients you may have in the Hospitals will be transferred to other members of the Department of Your hospital identification pass will be deactivated, and you will not have access to the electronic medical records system. You may make arrangements through the Medical Staff Office _to complete any medical records not currently completed. Additionally, you are prohibited from taking any action that could be viewed in any way as retaliatory against any individual who may have been present at the restaurant, who may have complained about your filming or posting of the video, who may have initiated or participated in the corrective action decision, or anyone who has at any time lodged a complaint regarding your professional conduct or competence. Retaliatory action may Ana Sanchez, M.D. March 31, 2020 Page 3 of 3 include but is not limited to calling or confronting or texting or messaging any employee or medical staff or affiliate member of St. Joseph Hospital of Orange, posting any complaints on social media, or filing any meritless complaints with any state or federal agency or regulatory body. Any contact with anyone at the Hospital is to be approved by me or Scott Rusk, M.D., CMO. In the event it is learned that you have engaged in any such prohibited conduct, that conduct will be considered by the Medical Executive Committee in reaching a determination regarding corrective action, up to and including termination of your Medical Staff membership and clinical privileges.
