For your consideration, attached is a resolution which would rescind the resolution passed on May 6, 2020, encouraging establishments in rural Minnehaha County to limit the number of the public in their establishment in order to prevent the spread of COVID-19. Rescinding this resolution is based upon the negative trajectory in new active daily COVID-19 positive cases in Minnehaha County, and that COVID-19 related hospitalizations are able to be managed by the local health care systems. The proposed resolution encourages businesses, establishments, events, and public gatherings to follow the South Dakota Department of Health and the Center for Disease Control and Prevention guidelines and best practices for COVID-19. This resolution affects the areas of Minnehaha county outside of the exterior boundaries of an incorporated municipality. Please let me know of any questions you may have. MINNEHAHA COUNTY RESOLUTION MC20A RESOLUTION TO RESCIND RESOLUTION 20-29 REGARDING PUBLIC HEALTH AND TO DECLARE AN EMERGENCY WHEREAS, COVID-19 has been designated a pandemic and the U.S. Centers for Disease Control and Prevention (CDC) has declared a public health emergency; and WHEREAS, on April 10, 2020, the Secretary of the Department of Health for the State of South Dakota, with the consent and authorization of the Governor, declared a public health emergency to exist within Minnehaha County, South Dakota; and WHEREAS, on April 28, 2020, the Governor issued Executive Order 2020-20 implementing South Dakota’s “Back to Normal Plan”, local governments are encouraged to follow the guidelines which include, but are not limited to, the following criteria to initiate the plan: a downward trajectory of documented cases within a 14-day period in areas with sustained community spread, no evidence of clusters which pose a risk to the public, and evidence that hospitals are able to reserve 30 percent of their hospital beds to treat COVID-19 patients; and WHEREAS, as of May 18, 2020, there is a 14-day negative trajectory in new active daily COVID-19 positive cases in Minnehaha County; and WHEREAS, as of May 18, 2020, COVID-19 related hospitalizations are able to be managed by Avera and Sanford Health, the local health care systems; WHEREAS, Minnehaha County will continue monitor and assess community data; NOW, THEREFORE BE IT RESOLVED by the Minnehaha County Board of Commissioners that within Minnehaha County and outside of the exterior boundaries of an incorporated municipality: 1. Resolution 20-29, titled A Resolution to Address a Public Health Crisis Pertaining to Coronavirus (COVID19) and to Declare an Emergency is rescinded. 2. Minnehaha County encourages the public to be diligent in their behavior to slow the spread of the virus and to protect individuals who may be vulnerable to serious complications or death. 3. Businesses, establishments, events, and public gatherings should follow the South Dakota Department of Health and the Center for Disease Control and Prevention guidelines and best practices for COVID-19, to protect the health and safety of their employees and patrons. 4. This resolution is hereby deemed necessary for the immediate preservation of the public peace, health, and safety, and as an emergency measure this resolution shall become effective immediately upon approval. Centers for Disease Control and Prevention (CDC) has declared a public health emergency; and WHEREAS, on April 10, 2020, the Secretary of the Department of Health for the State of South Dakota, with the consent and authorization of the Governor, declared a public health emergency to exist within Minnehaha County, South Dakota; and WHEREAS, as of 12 noon on May 4, 2020, there have been 2,170 confirmed cases of within Minnehaha County, of which 657 are active; and WHEREAS, on April 28, 2020, the Governor issued Executive Order 2020-20 implementing South Dakota?s ?Back to Normal Plan?; and NOW, THEREFORE BE IT RESOLVED by the Minnehaha County Board of Commissioners that within Minnehaha County and outside of the exterior boundaries of an incorporated municipality the foilowing guideilnes should be met: I. Any establishment that serves food, alcohol or beverages shouid not exceed the greater of ten (10) patrons or the number of patrons for which the establishment can provide seating to all parties which is no less than six (6) feet apart from other parties. Minors are not included in the party limits. ll. Any establishment for events, and public gatherings, including entertainment and recreational venues, shouid not exceed the greater often (10) patrons or 50% of the occupant load as determined by the South Dakota Fire Marshall or the Minnehaha County Planning and Zoning Department. BE IT FURTHER RESOLVED that A RESOLUTION TO ADDRESS A HEALTH CRISIS BY MEASURES TO SLOW THE SPREAD OF CORONAVISUS (COVID- 19) AND TO DECLARE AN EMERGENCY, passed by the Board of commissioners on March 27, 2020, is rescinded and that A RESOLUTION TO ADDRESS A HEALTH PERTAINING TO AND TO DECLARE AN EMERGENCY is deemed necessary for the immediate preservation of the public peace, health, and safety, and as an emergency measure this resolution shall become immediately effective upon approval.
