Headley, Warden II St. Clair Correctional Facility Springville, AL 35120 Dear Mr. Headley: After having reviewed the recommendation of Warden Carter Davenport, your waiver of a due process disciplinary hearing and your overall work record, you are hereby suspended without pay for a period of three (3) days to be effective April 1, 2013 through April 3, 2013 inclusive. On July 26, 2012, a female employee under your direct supervision at St. Clair Correctional. Facility reported allegations of misconduct against you to the Warden The employee stated that because of your conduct, she did not feel comfortable working under you supervision or having direct contact with you. The Warden upon investigation of the allegations, obtained a written statement from you. Your written statement confirmed there had been conversations between you and the employee that were not work related. You had contacted the employee away from work, via telephone and text messages. You stated the conversations included comments such as is business? and from here is away from here.? You further stated the conversations were about getting together away from work and the work schedule of the employee?s spouse. You also stated that the conversations were mutual and took place several months ago. Your actions constitute a violation of the following standards under Administrative Regulation 208, Employees Standards of Conduct and Discipline: 1. Employees shall render full, ef?cient, and industrious service. (Section V, Paragraph A2) 2. Employees shall observe all laws, rules and regulations. (Section V, Paragraph A7) 3. Employees shall uphold, with integrity, the public?s trust involved in their position. (Section V, Paragraph A8) 4. Employees shall report all instances when the ability to supervise a subordinate employee is affected by a personal and/or nonworking relationship with that employee. Serious violations of rules, policies, procedures, regulations, laws, or reasonable conduct expectations. (Administrative Regulation 208, Annex H, Number 18) 2. Harassment or discrimination as de?ned in Administrative Regulation 206, Harassment and Discrimination Policy. (Administrative Regulation 208, Annex H, Number 31) A review of your overall work record reveals no active corrective actions. The intent of this action is to emphasize the necessity for you to follow rules and regulations. Any similar infractions after this incident may result in further corrective action.
