FINAL ORDER AND JUDGMENT

 

This matter came before the Court on judicial review of a December 23, 2014
Final Decision of the Public Service Commission of Wisconsin (?Commission?)
approving electric utility rates for Wisconsin Electric Power Company (?Wisconsin
Electric?) in docket (the ?Final Decision?).

The Court having considered the arguments of counsel and briefs submitted
in this matter, and for the reasons set forth on the record by the Court during the
hearings on August 31, 2015 and October 30, 2015, IT IS HEREBY ORDERED2

1. Pursuant to Wis. Stat. 227.57, the Court hereby sets aside and

vacates that portion of the Final Decision approving the ?Demand Charge?

component of Wisconsin Electric?s CGS-NP and tariffs, as identified on
Wisconsin Electric?s Final Form Electric Rates (PSC 226575), Sheets 201.5
and 201.7, respectively. In light of this ruling, the referenced ?Demand Charge?
component of and shall not take effect for customers on January
1, 2016, and shall not be collected from customers.

2. The Petition for Review is GRANTED to the extent described in
paragraph 1. In all other reSpects, the-Petition for Review is DENIED.

This is a final order and judgment within the meaning of Wis. Stat. 806.10

 

and 808.04.
