Hogan, the Governor of the State of Maryland on March 5, 2020, and renewed on March 17, 2020, to control and prevent the spread of COVID-19 within the state, and the state of emergency and catastrophic health emergency still exists; WHEREAS, on March 13, 2020, County Executive Steuart Pittman issued Executive Order No. 16 proclaiming a civil emergency in Anne Arundel County due to the rapid onset of the pandemic, which Executive Order was extended by the County Council on March 20, 2020, to continue for the duration of the Governor?s state of emergency proclamation; and WHEREAS, the effects of require that local officials be vigilant in advising the residents of measures they can take to protect health, safety, and welfare; WHEREAS, the Centers for Disease Control (CDC) advises that social distancing is the most effective way of slowing the spread of WHEREAS, continues to pose serious health risk for the citizens of Anne Arundel County, particularly elderly residents and those who are immuncsuppressed or otherwise have high?risk medical conditions; WHEREAS, on March 30, 2020, the Governor issued Executive Order 20-03?30?01 which ordered all nonessential employees in the State to stay at home for an undetermined period of time in an effort to arrest the increase in the number of residents contracting the virus; WHEREAS, on May 13, 2020 the Governor issued Executive Order which gave Maryland counties the discretion to review local data and make independent decisions about when it is appropriate to relax certain restrictions; WHEREAS, at that time Anne Arundel County had met some, but not all, of the criteria that the Governor outlined in his four building blocks to reopen, and with the recommendation of 1} Amended and Restated Executive Order No. 21 Page 2 won-ma .n-anvqp- n. .. .. u? . the County Health Of?cer, on May 15, 2020, County Executive Steuart Pittman issued Executive Order No. 21, reopening certain businesses to customers with certain restrictions; WHEREAS, the County?s Local Health Of?cer has identi?ed certain criteria for determining when the restrictions imposed by the Governor?s Executive Order 20-03 ~30-01 may be lifted, including ensuring adequate hospital capacity to provide care for positive patients; decreasing community spread and deaths due to suf?cient testing capacity to test all and high-risk individuals; suf?cient supplies of personal protective equipment adequate contact tracing capacity to suppress disease spread; and providing supplemental resources to at?risk populations; WHEREAS, the County Executive and the County Health Of?cer have determined that the criteria identi?ed by the Health Of?cer have been partially met in Anne Arundel County, and that the restrictions imposed by County Executive Order No. 21 may be further relaxed but with restrictions that are necessary and reasonable to save lives and prevent exposure to and WHEREAS, to save lives and prevent further exposure to the virus in Anne Arundel County, it is necessary and reasonable to issue a local Executive Order that is more Restrictive than the Governor?s Executive Order 20-05?13-01, while at the same time providing relief to the many retail businesses affected by the pandemic;. NOW, THEREFORE, I, Steuart Pittman, County Executive, by virtue of the authority vested in me by the Charter and laws of Anne Arundel County, Maryland, and 1-6?101 et. seq. of the Anne Arundel County Code, and pursuant to the authority granted in Governor Hogan?s Executive Order 20-05-13?01, and to save lives and prevent further exposure to the COVIDAI9 virus Within Anne Arundel County and the State of Maryland, do hereby proclaim and order on this 28th day of May, 2020: 1. Executive Order No. 21, dated May 15, 2020, and entitled ?Reopening of Certain Businesses,? is hereby amended and restated in its entirety as forth herein. 2. Amended and Restated Executive Order No. 21 is a Local Order as described in, contemplated by, and authorized by Governor Hogan?s Executive Order 20-05?13-01, to modify certain provisions of Section of Governor Hogan?s Executive Order 20-05-13-01. 3. All retail establishments, organizations, and facilities in Anne Arundel County that principally sell goods may open to customers provided the cumulative number of customers and staff inside any such establishment be limited at any one time to no more than one customer or staff per 150 square feet of public area, but not to exceed 50% of maximum occupancy as de?ned in the Governor?s Executive Order 20-05-27-01. Automatic car washes and pet grooming businesses and facilities may open to customers under the same restrictions, provided that pet grooming shall be by appointment only. l} Amended and Restated Executive Order 21 Page 3 W'??tm?munm?n'e? 4. Manufacturing businesses and facilities in Anne Arundel County may open. 5. Churches, synagogues, mosques, temples, and other similar religious facilities may open to the general public, provided that gatherings at any religious facility may not exceed ten people. 6. The following personal service establishments may open, but subject to the conditions noted: A. Beauty salons, to ?provide hair services? and provide ?hair services-blow drying,? as de?ned in 5~101 of the Business Occupations Pro?ssz'ons Article of the State Code, but speci?cally excluding services that involve ?blow drying the hair? under B. Barber shops, but speci?cally excluding services that involve ?blow drying the hair? under Bus. Occup. Prof Art. of the State Code. C. Services shall be provided by appointment only and the cumulative number of customers and staff inside any such establishment shall be limited to no more than one customer or staff per 100 square feet of public area at any one time, but not to exceed 50% of maximum occupancy as de?ned in the Governor?s Executive Order 20-05-27-01 D. Face coverings shall be required for all staff and all customers over the age of two while in areas open to the general public and in areas where interaction with other staff is likely, except to the extent a face covering on a customer would make it impossible for services to be performed. F. After providing services to each customer, all areas in which services were performed shall be cleaned and disinfected in accordance with applicable guidance from Centers for Disease Control and the Maryland Department of Health. 7. The following outdoor recreation uses may continue to be open: A. golf courses and driving ranges; outdoor archery and shooting ranges; C. marinas and watercraft rental businesses; campgrounds; and E. horse boarding and riding facilities. 8. All businesses, organizations, establishments and facilities that are permitted to be open under this Executive Order shall comply with: A. All local Executive Orders (as amended) and all Orders and guidance from the County Health Of?cer, including the ?Order for Public Safety? issued by County Health Of?cer {00299713.nocx; 1} Amended and Restated Executive Order No. 21 Page 4 tum-am?. Nilesh Kalyanaraman on April 14, 2020, to the extent such Orders are not inconsistent with this Executive Order; B. All State Executive Orders (as amended) as modi?ed by this Local Order; C. Any applicable directives from the State Secretary of Health; D. applicable social distancing guidance published by the Centers for Disease Control and the Maryland Department of Health; and B. All applicable Federal, State and local laws. 9. This Executive Order does not constitute an extension or renewal of the Governor?s ?Stay at Home Order? contained in 11 of Executive Order No. 20?05-06?01; however, to minimize the spread of the virus, all residents are strongly encouraged to avoid unnecessary travel and social contact. 10. Except for and as modi?ed herein, all provisions of Governor Hogan?s Executive Order No. 20-05-13-01 dated May 13, 2020, are unaffected by this Executive Order and shall apply in Anne Arundel County. ll. This Executive Order shall take effect as of 5:00 pm. on May 29, 2020, and shall continue until the local proclamation of emergency expires or is terminated. 12. The Public Information Of?cer shall immediately disseminate notice of this Executive Order to the appropriate news media and to the general public. This Executive Order shall be archived at the Of?ce of Law and remain in existence until altered or terminated by a subsequent Executive Order. STEUART PITTMAN County Executive County ttorney 1}
