CITY OF SEATTLE, Defendant. 16 17 This matter comes before the Court on Plaintiffs Black Lives Matter Seattle-King 18 County, Abie Ekenezar, Sharon Sakamoto, Muraco Kyashna-tochá, Alexander Woldeab, 19 20 Nathalie Graham, and Alexander Chen’s (“Plaintiffs”) motion for temporary restraining order. TRO Mot., ECF No. 6 (June 9, 2020). The Court, having thoroughly considered Plaintiffs’ 21 motion and the declarations and exhibits filed in support of the motion, Defendant City of 22 23 Seattle’s opposition, the applicable law, the relevant portions of the record, and the arguments of counsel, GRANTS Plaintiffs’ motion for a temporary restraining order. 24 25 26 [PROPOSED] ORDER GRANTING MOTION FOR TEMPORARY RESTRAINING ORDER (No. 2:20-CV-00887 RAJ) –1 148516877.1 Perkins Coie LLP 1201 Third Avenue, Suite 4900 Seattle, WA 98101-3099 Phone: 206.359.8000 Fax: 206.359.9000 1 Plaintiffs have shown all four factors necessary for the issuance of a temporary 2 restraining order: that Plaintiffs are likely to suffer irreparable harm in the absence of a 3 temporary restraining order, Plaintiffs are likely to succeed on the merits of their First and Fourth 4 Amendment claims, the balance of equities tips in Plaintiffs’ favor, and a temporary 5 restraining order is in the public interest. Accordingly, the Court enters the following order. 6 7 ORDER Pursuant to Federal Rule of Civil Procedure 65 and Local Civil Rule 65, the Court 8 GRANTS Plaintiffs’ motion for a temporary restraining order and temporarily ENJOINS the 9 City of Seattle as follows: 10 1. The City of Seattle, including the Seattle Police Department and any other officers, 11 departments, agencies, or organizations under the Seattle Police Department’s control 12 (collectively, “the City”), is hereby enjoined from employing chemical irritants or 13 projectiles of any kind against persons peacefully engaging in protests or 14 demonstrations. This injunction includes: (1) any chemical irritant such as and 15 including CS Gas (“tear gas”) and OC spray (“pepper spray”) and (2) any projectile 16 such as and including flash-bang grenades, “pepper balls,” “blast balls,” and rubber 17 bullets. This Order does not preclude individual officers from taking necessary, 18 reasonable, and proportional, and targeted action to protect against a specific 19 imminent threat of physical harm to themselves or identifiable others. Under no 20 circumstances shall chemical irritants or projectiles or any other weapons be deployed 21 indiscriminately into a crowd. 22 2. In the event that Plaintiffs seek relief for an alleged violation of this Order, the City 23 24 must respond to the motion for relief within 24 hours. 3. Because this is a non-commercial case, the balance of hardships favors Plaintiffs, and 25 there is no realistic likelihood of harm to the City of Seattle from enjoining its 26 conduct, the Court waives the security bond requirement.
