SCHEDULING ORDER

This matter came before the undersigned Senior Judge of District Court, appointed
referee, for telephonic scheduling conference, on June 17, 2020. Petitioner was represented by
Keshini Mary Ratnayake, Esq., Senior Assistant Director, Office of Lawyers Professional
Responsibility. Respondent was represented by Paul Engh, Esq.
In accordance with the discussions and agreements of counsel and the referee, IT IS
ORDERED:
1. The parties shall continue discovery informally as appropriate, and may contact the
undersigned to assist in resolving any discovery disputes.
2. The parties shall disclose any expert witnesses who are expected to testify at the
hearing, including a brief summary of the experts’ opinions, by August 18, 2020.
3. The parties shall exchange exhibits and witness lists on or before August 21.
Simultaneously, the parties shall transmit copies of these documents to the
undersigned by electronic means (which may consist of attachments to email or
documents stored on a flash drive delivered to the undersigned). No hard copies shall
be transmitted unless specifically requested by the undersigned.
4. The hearing in this matter shall be held on September 10, 2020, at 9:30 a.m., in the
OLPR hearing room at the Minnesota Judicial Center, continuing, if necessary, on
September 11. The parties shall meet promptly thereafter to prepare a joint stipulation
of undisputed facts, if agreement can be reached.
5. The parties shall each serve and submit proposed findings and conclusions, including
memoranda in lieu of oral closing argument, on or before September 17. The parties’
stipulation of undisputed facts, if any, shall be included with petitioner’s submission.
The parties shall transmit copies of their submissions to the undersigned by Word
document attachments to email. Responsive memoranda, if any, shall be submitted on
or before September 21.
