Farnan Mr. GEDIMINAS PAKALNIS, a lawful blood relative and the only relative of Ms. GENYTE DIRSE in the United States would like to request any permitted information about his aunt. During this unusual health care crisis COVID-19 and declared international Pandemics, Mr. PAKALNIS is concerned about Ms. DIRSE since nursing homes and assisting living facilities are vulnerable to fast-spreading Coronavirus. Mr. PAKALNIS should be entitled to such information because he is a lawful Ms. DIRSE’s blood relative. He is requesting this information and does that in a good faith. IMPORTANT, ATTENTION PLEASE! Mr. PAKALNIS would like to remind a new guardian about the existence of previous rulings by the Court: I. Verbal ruling to keep Ms. DIRSE’s health information sealed and attorneys eyes only (The Court has issued this verbal ruling, however no transcripts or any documentation can be found that proves this ruling’s existence), Exhibit A. II. Order not to disclose the location of Ms. Genyte Dirse Exhibit B. Mr. PAKALNIS is aware about the April 15th, 2019 Order which does not permit him to know the location of his aunt and, therefore, he cannot call or be given the address of the facility through direct means or inadvertent disclosure through another person. PLEASE BE AWARE AND DIRECT YOURSELF ACCORDINGLY Mr. PAKALNIS is a lawful blood relative and as described by the Court Appointed Attorney Mr. Jeffrey Albinson: “As a relative of the Ward and as a potential heir under Section 732.103, Florida Statutes it is possible that Mr. Pakalnis might have standing in this guardianship matter <…>.” 01/28/2019 Mr. PAKALNIS is requesting for confirmation that his aunt is doing well and/or any other information that is permitted about her. Mr. PAKALNIS has not seen nor talked to his aunt Ms. DIRSE for many months (last time he was able to talk on the phone with his aunt was on March 13, 2019). Last time Mr. PAKALNIS was able to see his aunt was one year and five months ago, Exhibit C. Until the current Order keeping Ms. DIRSE location confidential is removed, Mr. PAKALNIS would like at least to ask a new guardian to provide him with information that is permitted about his aunt. Mr. PAKALNIS hopes that his aunt is in a facility which maintains good hygiene and has good staff. MEMORANDUM OF LAW According to Florida Statutes: • §400.022. Residents’ rights, and the pertinent part states that she has a right: (b) The right to private and uncensored communication, including, but not limited to, receiving and sending unopened correspondence, access to a telephone, visiting with any person of the resident’s choice during visiting hours, and overnight visitation outside the facility with family and friends in accordance with facility policies, physician orders, and Title XVIII (Medicare) and Title XIX (Medicaid) of the Social Security Act regulations, without the resident’s losing his or her bed. Facility visiting hours shall be flexible, taking into consideration special circumstances such as, but not limited to, out-of-town visitors and working relatives or friends. Unless otherwise indicated in the resident care plan, the licensee shall, with the consent of the resident and in accordance with policies approved by the agency, permit recognized volunteer groups, representatives of community-based legal, social, mental health, and leisure programs, and members of the clergy access to the facility during visiting hours for the purpose of visiting with and providing services to any resident. • §744.3215 Rights of persons determined incapacitated.
